Of course.Ignorance is not a defence,especially for a cop. He cannot act on laws he does not understand and laws that don’t exist. The courts and police happily use that term to the public if we unknowingly break the law but the police seem to think the law does not apply them and happily abuse the law whenever the feel like it. It needs a strong judge to call this cop out on it. He should also be forced to pay out the compensation for this himself.

Don't be stupid. 'Defend' yourself and get arrested for assaulting a police officer. If the original offence gets dropped you then get screwed by your own stupidity. Just because someone is arrested does not mean a real offence has been commited, the officer truely believed an offence had been committed in this case. Like it or not that's why he said at the end he thought he was not wrong for the arrest. That's why there is a process to be followed after someone has been arrested and in this case it worked as the guy was released when it was ultimately found no offence had been committed.

The press won't do anything unfortunately. The national media wouldn't go anywhere near this. And the local papers enjoy a cyclical relationship with the police. The police need the press for missing persons inquiries and calls for public cooperation like evidence gathering. The press need the police for stories and statements and access. The idea that any local press would hold their local force to account, and risk the force retaliating with non-cooperation, is just a fallacy. Independent media like this are incredibly important. Agree totally that he should sue.

@@richardkinghorn4729 @Northy Completely agree, qualified immunity. If the officer has read up on the law and is acting in good faith, and has simply made a mistake, they shouldn't pay. But in any other case, including a repeated mistake, they should. This officer is clearly not acting in good faith, nor does he know the law on drones. He even admits he doesn't when asked. It's a clear retaliatory arrest with no attempt to investigate, and he should be personally liable for the settlement and court costs.

In law the opposite of “reasonable” can be “perverse”. In USA it’s based on not “just a feeling, or a hunch “. It’s what the man on the top deck of the Clapham Omnibus would think. Most law is based on what he thinks. If only we could ask him!!!

We all make mistakes? Funny how it's always corrupt cops that make the mistakes, isn't it? I don't care that he returned your gear - he only did that as he had no legal reason to hold it. Key was your good self mentioning he'd be facing 2 claims if he'd arrested you too. That's why the gear was returned. The very fact that the Custody Sergeant effectively laughed in his face should have been enough. Nope, he knew better, & was determined to make something out of nothing. The worst kind of cop. His parental duties that were his priority seemed to get forgotten after your worrisome (for him!) claim' comment. Perhaps he shat himself with the possibility of the lawsuit. Let's not disappoint him. What you witnessed was misfeasance. It is not only a criminal offence for those in authority, it is also solid grounds for a lawsuit. Please do it. Now that's for 'the accused', who probably has little knowledge of the law. Cops should be well aware of this phrase, and realise that it applies to them too! The cop still thinks he is right when he clearly doesn’t know the drone laws and photography laws. By the time he has argued the point he could have looked it up and returned the drone and gone on his way. By taking the route he is taking he is costing the force money. The real problem here is that cops do not like being proved wrong by the public and hate the fact that it is legal to take photographs of the police in public.

You try filming a mother breastfeeding, certain medical emergencies, people going in and out of court buildings and the law will show there are times when its reasonable to expect privacy in public, especially from filming. The term is a very broad generalisation, mostly true, but there are exceptions. You hit the nail on the head though. They never accept that they are wrong. Its the police "culture" to blunder through trying to retain their integrity, and sod the casualties...Their contempt for the public is only surpassed by the public's growing contempt for them.

@@auditnerd8767 where there is a medical emergency I very much doubt that any auditor I have seen would film while it was ongoing. I know I would not watch it nor would I continue to subscribe to it. Court buildings are a funny one in that a lot of them are visible to dashcams on a daily basis and or including CCTV in certain cities so again unless you actually go up to it and try and film directly in then it is a very grey area. I do know One auditor who did film towards one and could see through the window did get fined, but a couple of others haven’t been fined because they didn’t try to film through the windows.

I live less than a mile away from this police station, the police have awful response times as they claim that this police station is virtually unused, yet we can have this sort of a response to a drone flight. A young man was murdered a week ago behind the health centre in the background and they didn’t even cordon off or investigate it fully until 3 days later. Atrocious.

Hi N N Y, the fastest false arrest I have ever seen!, I hope they are as quick on paying the compensation. Possibly I missed the first part of the encounter when the coproach identifies himself and stated the grounds for the arrest but it looked as if he was doing one. I did not see any reason for the hands-on attack there was no sign of any physical threat or attempt to evade arrest. None of the standard reasons for such violence. Hardly any time passed and he was free! whatever happened there?, has he been charged and if so what with?. I do like the idea that police officers can do what ever they like if their intentions are good, sounds like he has learned a lot from pour government ministers. Cheers, Richard.

@@noelward8047 hey Noel duck I got 3 yesterday for my beliefs in the miners strike. If one's going to do audits for our rights the do it . I will never bow to any pos especially when I knew he was wrong. I wasn't playing a game for youtube. I love auditor's fighting for our rights, but not begging to be let go and saying they all learns something from the wrongful arrest .

Deffo needs a claim putting in and every claim made should go onto a coppers record that way they can keep an eye on the good from the bad and weed them out or at the very least retrain them. This guy is the worst type of cop actions before knowing the facts or the laws .

They're told what the law is. Okay, check it out, see if that's correct first, then return the property. But, to be told what the law is, ignore what that law is, keep the property through spite and NOT ignorance, depriving someone of their property is effectively theft. So, a bully steals something, whilst in the employ of the local constabulary, as a police officer, surely a sackable offence?

I don't expect every policeman to know every law, all i expect is that arrests aren't made on a whim or because they think something should be illegal. "Honestly held beliefs" are anti law and have no place in UK policing. It takes seconds to check something in this day and age so there really is no excuse. To try and claim that they should come back another day so he can check it when it took merely seconds for him to check it there and then and longer to argue is downright ignorant. The outcome was ok in the end but i still think that cop is totally underhanded.

I don't understand, if you can legally fly a drone over this police station, and yet when the person you are with is arrested for attempting to do just this, why did you run away?.........Auditors who run away from the police even though they have done nothing wrong, should not be running/hiding from the police, but you attempt to make the police know you are not doing anything wrong, point out their mistakes, and they learn something from it, running away makes you look guilty of a crime.
