my father died yesterday after a long battle with cancer, I feel absolutely lost and like I'm living in a world that isn't real. we all agreed to use money for the funeral. I would literally give every penny of it back just to have one day with him again. he was an amazing man. it's actually shocking to me some people think about cars and stuff when their father dies, makes my skin crawl.

First, do not kick caregiver out of the home. In fact sign house over to her or him. The caregiver has destroyed life for x years and health and is probably broke due to cost of taking care of dad or mom. Parent probably promised caregiver something for giving up job, selling house, giving up life, never going anywhere for years due to parent afraid and fearful of them leaving. Now have a bitter, resentful, heart broken caregiver and you say, " Are you going to pay rent now. Where is all mom's money? She and you did not spend it all on her care or you? What did she leave?" The caregiver will look at you bitterly and think, wow. Hardly ever came to see ma or pa. Never came to help or volunteered to give me a day off. Never came and took mom out. Did not come and clean dads bed pan or fix him breakfast or wash his poopy shits and sheets five hundred times and now they are talking about me paying rent. What about me. My knees and back are messed up due to lifting parent for 3 years and here they are, all my brothers and sisters with their hand out wanting their share. Guess they forgot to do their share all the three years. Just a phone call now and then. Should have never said I would be the caregiver. Loved mom but it has left me sick, tired, bitter, angry, and glad I took care of her. I have no home now, no car, no clothes, no money and they all dance in here with their hand out. Wish they had danced in here with a broom or mop for the last three years and cleaned the house. That is what the people need to know. Get in there siblings and heirs and clean the house. Watch the parent for a week. Turn your share of the house over to the caregiver who has given her life and health to your parent and made their last few years here better. Hope you all read this and realize what you are not doing and how the one is doing it all without your help. Start paying them. The going rate is 15 to 20 an hour. Sell moms assets and use it to pay them. Working for free is not right.

well i, for one, know that most families usually have that one person that does the sht jobs for the parent/grandparent.. i mean, its always been that way.. it may be that one guy that always cuts the grass for them, or takes them shopping, fixes stuff.. you know, its been that way since the begining of time, because most people are just jerks.. lazy, dumb, jerks..but, usually in a clan, theres at least one person thats decent.. and they just wind up doing all the work, the others dont want to do, and they dont do it, because they know the decent one will do it.. and ill tell you something that can make it even more annoying, is if the parent or grandparent acts like they love those jerks more than the one doing everything for them.. because absence makes the heart grow fonder.. and, you know, those jerks just show up and spread the love for a few minutes.. and granny is all, 'oh its so nice to see you all, my darlings!' heheh.. but with you, shes all, stop bothering me, as you do her laundry.. or even worse.. yeah, i know how it can go, im no dummy.. and i know that those people that go through the hell of caring for a parent/grandparent, when theyre in their last horrible years.. the years of dementia, pooping all over, and god knows what other horrors.. i know how traumatizing it is.. the physical and mental toll it takes on whoever is taking care of them, god forbid its just one decent person.. not saying your parent was a narcacist or anything, but if they were like that, well thats a whole nother hell on top of it all.. maybe they werent at all, its still very hard on you.. i mean, theres all kinds of people.. some people try to slip in at the end as a caregiver, just so they can try to swipe the house.. it happens.. theyll come in, and stick the old person in the back room, and just neglect them.. maybe even poison them with morphine or something.. all a big sinister plan they have, to swipe the house from someone in the family that actually deserved it.. well, anyway, if you were a decent person, that actually deserved the house, you shouldv got it

In California NO WILL uncle refinanced house got a bunch of money out shortly before grandparents died. He skipped town left my aunt paying two mortgages. when she couldn’t do it anymore she called me To move in and pay mortgage $2500/mo. now my uncle returns Storing his stuff here coming and going as he likes paying me no money at all. If I leave, the house is lost nobody can pay the mortgage. But no one can afford to give me my $30,000 I’ve already put in. so I can go on with my life. My last resort is to call the mortgage company and tell them what’s going on. I’m fine to stay here and continue paying the mortgage But it’s a lot of money and I can live for cheaper I fear I’ll never get my money back.

However, I still have yet to find any Substantial Info, be it Online or in a Video, explaining what would happen IF the Decedent's 3 Kids, who are his Listed Heirs to his Pension (& get along) & it's their Dad's Wife who's alleging that the "Survivorship/Death Clause" Voids their Inheritance (ie. Pension, but she "allowed" us to have his Non-Titled Belongings, saying that was in the Will, yet I didn't see that... But, then said we couldn't have anything of Value, had those things Appraised & then Auctioned them off & Donated the Other Non-Valuable Things to Goodwill.) & that the Survivorship/Death Clause left her Everything we were supposed to get & we got NOTHING, bc of the way she explained the 30 Day Survivorship/Death Clause? Even though the Will stated his Pension was to be Split between us 3 Kids? While she got his Bank Accts, Life Insurance Policies, etc. She won't Probate his Will, she wouldn't allow us a Copy, forbade us from taking Photos of it or Writing anything down from it & won't tell us his Lawyer's Name who Prepared it. What does this Mean & are there other ways to Obtain a Copy of his Will or Find out who his Lawyer was? My Dad died suddenly before the Executor Paperwork was Signed, so his Wife took Control of his Estate... His Wife also made sure to tell us that we'd have Problems if we made Waves for her & she found out we were doing anything behind her back. I'm Located in Pennsylvania & just don't know where to go, how to begin or if a Survivorship/Death Clause actually does Supersede what he Willed to us. My parents were divorced. My dad had a last will and testament. He had dementia. When he bought his condo he was still coherent. As a couple of years later he along with my sister went to attorney and had his last will and testament. When he bought the condo I am sure it was in his name (if not somehow my sister and her husband put the condo in her husband's name). Anyway, he had 3 daughters in which we all lived in a different state. He named my older sister (that his estate somehow was put in his name) as his executier. So he had a severe brain hemorrhage and was in ICU could not talk or anything. Anyway, he passed 5 days later. My sister said he never paid any mortgage or any bills. He was retired from oak ridge TN. He had 24 he care. And was well taken care of. We (my sister's) went to the cemetery and picked out a plot that was across from his parents. And then we picked out the head stone and my sister actually bought the site next to my father. The total cost for this was over 30,000.00. never seen such a beautiful marker. My sister said " daddy deserved the best). Which I agree. She said she bought life ins almost 2 yrs before he passed and lacked 2 weeks of being 2 yrs. On the day we were receiving friends a man from oak ridge TN came to funeral home and my sister signed paperwork. So she did get money from oak ridge. At least 10,000.00. anyway, after everything said and done my sister read daddy's last will and testament. his condo was not on there. Before he bought the condo he and my mother (they are divorced) my sister and her husband came down and did some work ( he is a contractor and she is an interior decorator) the house sold for almost 500,000.00. a 1/2 million.on his will he (I am middle child) left me with everything inside home and his vehicle. My younger sister was left nothing. She profited everything from our mother and supposedly stole from my father. Property was in my sister's husband's name. He said in his will that his home would be splitter between me and my older sister (the executior. My father had no idea that his property somehow was put in his son in laws name. Nobody knew. So where did the 1/2 million go. I have legal pads upon legal pads where my father wrote his budget for each month. Mortgage hoa power etc. My sister said he never paid 1 mortgage payment. But when I went to stay with my father for 3 months (before he had 24 he care he only had about 1,000 in his account. He received 3,000.00 a month from oak ridge. Anyway, how do you sort this out. Was he taken advantage of or just theft. It really bothers me. My sister and her husband are well to do . But after my father's passing things changed a little bit. Plus COVID-19. How do u find out if they actually bought the property in my sister's husband's name or later on had him sign over the condo and did not know due to dementia. The condo sold for almost 200,000 which I was to get 1/2 according to his last will and testament. But I can't because it's in my brother n laws name. Help!

You research through the title and property tax office. You also sue your sister. Make a report with that states elderly abuse holiness, a police report possibly, and go from there. Lawyers won't be free. The problem stopping most of us from Justice from inheritance fraud.

I have already split cash assets and investments and added “Payable Upon Death” in every instance I can for each of my two children since I’ve been a widow for 15 years. Gave my property to them years ago since I was no longer wanting to handle the upkeep, etc. No debt other than utilities and insurances.

Why didn't you just schedule an initial consultation to discuss your question and needs? Your question likely couldn't be answered easily or quickly or Brooke could have answered it (such as"How long has he been in practice?" or "Is he accepting new clients?" or "Does he work with heirs located in other states?"). Anything much deeper than that requires a full understanding of your situation and that is not a quick, simple thing. You already mentioned that your case is "extensive and complicated" and that requires a consultation. That is fair to both you and to him.

My step father died and will was changed right after. My mother died 20 days after his death. My half brother was appointed to the estate until his death. Afterwards his family will get 50% and the rest divided equally between me and my 3 step sisters. I asked my half brother if I died before he, would my 2 children get what was left to me by my mother. Absolutely he said. Should I get an attorney or take his word for it?

My father passed away last year. My siblings and myself are all on the will equally. All that was left was a property he owned. My oldest brother is listed as the executor and is wanting to sell the property and is wanting us to reimburse him for expenses he incurred. I believe that his so called expenses are unreasonable and we’re not previously discussed. I would expect that everyone involved would be responsible for the attorney fees to probate the will and the taxes on the property, but I am not comfortable having to pay my brother for his travel to the property and “labor” to cut the grass and check on the property. Am I obligated to reimburse him for his own determined cost or anything he has paid for even prior to my father passing?

The executer is entitled to expenses for doing the work required against the estate. You can do research and consult an attorney, but he is indeed. As long as he can show work time, receipts, then yes, he is in the right.

Question is, a parent has his kids as beneficiaries half and half (2 kids) via the bank and also for the mortgage they are listed as beneficiaries. Are designating beneficiaries enough if there is no trust or will established? Or are those assets liable for seizure if not protected by a trust or will. I am an only child. I have been a good daughter. My dad married a woman who had a daughter. His wife died. Now this daughter who of my stepmother child has taken over. She pushed me out years ago. I would call to speak to my father and she would say what do you want ! When my father had cancer I went to the hospital every day for 3 weeks. But all I heard was how my step mother ‘s daughter was the only person there for him. I’m really concerned. I didn’t get anything when my step mother died not even a photo. But this is my father. I am his only child. He is oblivious as to the games his late wife’s daughter have put me and my children through. I married young and I had 2 daughters. My stepmother’s daughter didn’t marry. But proceeded to have 4 kids by 4 different men. And my dad was stuck having to house them for years. So I’m in a bad situation. Honestly I’m the only beneficiary to my dad’s estate. Or should be. I know that this step daughter has a father. I know she collected something from her grandparents estate on her father s side. And she collected something from her mother’s grandparents. And her mother. So do I contact an attorney immediately to prevent her from coming in and stealing my inheritance. I’m not well myself. I have a rare autoimmune disease. The past couple of years have been very difficult. My father is 80. He had the cancer surgery back 3 years ago. And is about to have a hip replacement. I called to see if I could help. Drive him to the hospital or to therapy. But he told me no. The step daughter makes everything about my father her business. She literally lives 6 hours away in another state but is coming for two weeks to take care of him. I feel so pushed out of my father life. But I think she is trying to get my inheritance. It’s crazy I know. But about 20 years ago my X father in law asked me what will you do when your father dies. I said I’m not sure what you mean. Now at this point I had been divorced from his son about 6 years. I had remarried to my current wonderful husband. And my X husband was about to get remarried. I was just there having a cup of coffee while my X mother in law was finishing up a visit with my daughter. They were good people. And they even had dinner with us a few times. Sadly they have passed now, but at the time my X father in law just ask out if the blue (what will you do when you dad dies? ) I didn’t understand. He said because of your step sister. Witch we were not raised together. My father did not raise her either. I said well I might need to call am attorney. He looked at me and said “ good girl ! That’s exactly what you need to do .” So all these 20 years I have known that others see her as a problem. They see it , I feel it. What would I say to my own children if she steals my inheritance. I know I would feel very bad. He and my mother were married 10 years. And he was not kind to her. And I guess I’ve felt that all these years too. It just will not be right if I’m pushed out of my own inheritance. It’s not about $. I put myself through school. And I had a nice career. Before I got sick. I own property and I’m ok financially. The next attorney soaked me for $20k then said she was not a litigation attorney and dropped the cases. She didn't want to fight with my brother... F the legal profession.

What happens when a child is excluded from a Will and property (real estate) was deed to them, but excluded from all other assets?

If you are under aged when your parents passed away: the court will decide a guardian for you. In case there are none, there is a mechanism so that your are at safe hands!! Now after the funeral is over, you sit down and think about your pulling together your life!! That’s the immediate thing that one should do!! About siblings, no matter how bad are they you stick together!!

You have to look into everything to have it straightened out. Maybe even get power of attorney over her. Talk to an attorney it must be done. Get prepared

My stepdad just died. “Planned kill” is a better term. I don’t care about inheritance, but am very pissed off I got NO say in the care he received in the hospital, or at home with hospice care, or in funeral arrangements. As a result, my dad had a rushed death from my psychopath sister. No IV fluids were given, so he passed away much quicker. Guess I’m just venting here more than anything. Romans 12:19 (KJV) Dearly beloved, avenge not yourselves, but rather give place unto wrath: for it is written, Vengeance is mine; I will repay, saith the Lord.

Similar experience here. It’s awful. Sorry it happened to you too. The estate distribution is following the same path unfortunately.

I feel a similar situation but he was my father & his wife controlled his entire relationship with her...i got no say in funeral arrangements,weren't allowed to send flowers wasn't informed of his burial & given 1/2 hour in the funeral parlor to view him. The day he died I drove 3 hours to the hospital to say goodbye & wasn't allowed to see his body 😔 the nurse told me I was an hour too late. Horrible experience with horrible people...but I believe in KARMA. May God rest his soul

@@jday2581 I was extremely close to my dad & unfortunately he moved to another state years ago...his wife is a monster. I went to the cemetery & she went too far, she had his name plate removed from the mausoleum wall! Anytime someone leaves anything it gets thrown away...she doesn't want anyone to know where he is. Too bad! He's dead for God's sake let him rest in peace! She told no one he died & didn't have enough respect for him to leave an obituary or inform his friends. His estate is a disaster, I got a lawyer to request a copy of his will, he told me to get a copy & explained that his wife stays in the house until she passes & then HER son & I split the estate. Well, she sent a 20 year old Will that says I am entitled to NOTHING & her brother is executor 😕. They haven't spoken to her brother since hurricane Sandy. She has all my family heirlooms & so far I've received nothing. Even though she knows they belong to me.

so what about, " Power of attorney, Durable power of attorney, and Medical power of attorney? " Well there comes a time where that goes away, and you have to deal with becoming the, " Executor to the will handling the estate. " Just hear me when i say this. " The financial advisor and the power of attorney that worked with your father " may not be the ones you want surrounding you. Keep a close eye on them so they cannot embezzle money from you when you are hurt and down ..

You can request a copy from the county that Stanford is located in,, can not remember off the top of my head, look for the records department. Or try request a copy of her medical records from hospital. If she possible had you listed as a family member to contact I'm a emergency exdra. Bring your ID and proof your maiden names were the same buy bringing in a copy of your own birthday certificate , marriage certificate to show any name change that differ from your maiden name. Call the funeral home from there, if you are not able too know what the procedures are . It's public knowledge. Trust me , do your own research. Hope a little help. So sorry for loss. My youngest son passed away at Stanford , but in the pediatric side of the hospital. I had know idea what or next too do. It's heartbreaking 💔 Hope things go in the proper way of what your sister wanted. Godbless

Our condolences on your loss of your young son in paediatric side of Stanford hospital. We have spoken with the hospital people. They stood by us during her short visit there. She was a good sister and a good aunt to my son. We got through to the social security office and they were very supportive and guided us to apply for her death certificate. We are in the process of getting one.

I just found out my dad died by a third party calling me looking for who was in charge of the estate , my brother told the insurance bcompany he was a only child , I thought it was a joke he died like 8 months ago , nobody else knows he has past why keep it secret , he is living in my dad's home and all his stuff is in storage boxes , what should I do , my brother has also been charged with assault on my dad plus he tried to kill his ex wife , he is very violent . I need help. I know ZERO about Lawyer Language and Zero about how to, Transfer a Property that my Mom owned. The house is paid for. We (sister) want to avoid Probate cause were not fighting for the property. My mom gave my (sister) her inheridense while my mom was alive. Im next of Kin or Heirs all i know im next. I still dont have death certificates. Whats next after that. I live in Florida. Im worried that the County will take the home. Please, i dont a paper will. What i do have is a voice recording of my mom having a stroke and final wishes saying the home belongs to me. My sister can aprove it. So, so....worried...

If he buys all assets with his brother as owner. Leaves absolutely nothing to his only son. An atty is going to..say my son has no grounds. Effwctively terminated all contact from them, the greedy brother and sister.. never aunt ir uncle... they are never to communicate with my son again. Preparing to relay just that message. We asked nicely but ah I dont bla.e my son. I'm almost giddy just thinking about telling his uncle to rot in that hoise, alone

You didn't answer your own question. Supposing you have all this information already. The question is, now what? What gives any of the children authority to do anything on behalf of the estate, on behalf of arranging funerals, etc. What gets the ball rolling?

Great information! My dad died 4/16/21 he lived with me for over 30 years. He had no assets and he spent nearly all monies he made through SS. I was his executor and he put me on his bank as POD. As you suggested, I waited until SS recalled their last deposit and only $500 in the bank. I closed the account about 3 weeks after dads death when I received the death certificate. Dad had no debts including no credit cards because he choose to pay cash for everything. I was lucky. However, now I am getting bills from the hospital. I never signed anything except once when he was placed in a rehab center. The letter I got from them said "you are required to ensure DADS NAME pays the charges." Since dad had no money, I personally paid for cremation and burial plot. Should I pay his medical bills? Do I have to file probate with the court?

petitioner is pro-per, mother died intestate, real property has reverse mortgage lien, [pg&e, water, garbage] no other creditors, property listed and buyer placed an escrow, petitioner is only child and mother never married, petition filed and accepted san joaquin county requested special administrator with letters & full authority. In a case where heir is only child, needs to sale property to satisfy reverse mortgage company ASAP listed real property buyers placed escrow. lien is $160,000 and $305,000 is purchase price. petitioner needs to sell due to interest accruing and money from sale to move? Reading through my panicked state can a list discripting 1-? or forms that can be filed to ex parte it all??

Hello, I am a surviving spouse in Arizona. My husband and I have two children age 14. There are 8 bioligical children to my husband from prior relationships. No will has been found. We have searched the whole house, and RV which he was living in. I have decided to go to probate in order to insure that everything is done in accordance with the law of the land. What are the rights of the 8 children all age 18 and over, and no disablilities, and what are my rights in Arizona. I want to make sure everything is fair, to myself, my two minor children, and to the other 8 children. We have searched for a will and have not been successful in finding one. What is a reasonable time that I should wait for will location, and how do I convience the other children that I am trying to be fair?

If there is no Will why probate. Don’t you need a Will to probate? I would think each child would get 8 shares equally. But if you are his wife maybe they get nothing. And it’s yours.
