I’ve been in a similar situation with my parents. I was the one who divorced, due to abuse. Parents wanted me to stay in the marriage to save “their” two houses. One was deeded to us, the other we owned and they lived in with rights of survivorship. It was worse than the divorce! They did crazy things to undermine me (lifetime movie behavior). I had to move out of state to create distance and sanity. We barely talked for years. We have mended fences, but it was truly one of the hardest things I’ve ever dealt with. NEVER, EVER do business, including real estate, with family. My husband was totally “normal” when we made these real estate decisions. We intended to live there forever. Then mental illness crept in and everything changed. You never know folks. Life throws curveballs. Protect yourself.

Dave can’t anticipate the situation to be this stupid if he isn’t told about it. She went on and on and didn’t think she should mention that there was no formal paper tying either of her parents to any legal claim on the ownership of this home. And the idea she’s allowed this to hold up the home for five years or so is absurd and is clearly an example of people who don’t understand the process. And it clearly cashed the advice entirely.

I’m British. My mum did the same thing. She helped me find a property to buy, insisted on her name being on the deed, but then didn’t pay anything towards it. She then turned nasty when I asked her name to be removed, and asked for 50:50 from a sale. I talked to a lawyer, threatened with court action to dissolve the joint ownership and get a judgment on a division of shares. Once I threatened this she backed down. Destroyed our relationship but I blame her for being a greedy trickster. I’m a Christian and tried to honour her, but she dishonoured herself by trying to rob me. She follows another religion and is going around complaining how her daughter ‘wanted to take her to court’. I still pray for her but I sure am glad her name is off my property.

This is one of the best calls I've ever heard on the show and Dave shows why he is the best! Straight, to the point, does not mince words. I think if I may theorize, that the caller grew up having to tiptoe around her parents. She tries six ways from Sunday to come up with a way where she can give them some money and everything gets resolved peacefully. But Dave is right. At the end of the day, the parents are not owed any money and the dad especially is just being a b***-hole.

My in-laws paid my wife studies until her PhD and helped me at the beginning like a son! They are good with money and they generosity is through the roof. We are so fortunate my parents would do de same if they could but in Brazil the situation is very different. When I see some parents screwing their child life I feel sad if you can’t help don’t mess. I only can afford one child but this girl will go to college debt free.🙏🏾

Thank you for answering the part about honor your mother and father. I have struggled with that even though I escaped an abusive home, but my want in following Gods word pulled me back into their lives after becoming a bit stronger and with my husbands support I was able to lay everything out on the table to them. Yet while they have mended a lot of their ways they still do things that tear open old wounds and scars that never really go away completely. They just mend again through my husbands work and the work of our Lord who Blessed me with him. Bless you Dave and everyone on your show!

😢I was in the same situation , my mother took money fromme to pay off my brothers debts and later declared to the whole world , that I paid only half of what I claimed as paid. I can identify. I have a cousin like this. This is how abusive relatives are . They take and they take and they take. It sounds like the father AND mother were owed a few thousand dollars which the daughter and her husband were willing to pay above board. But that wasn't good enough for him. Dave's advice was absolutely right. If it's at the point where the father has imposed an illegal lien, they have to fight this legally. The best outcome here is that they have the lien removed and keep their parents at arms length.

Check if the lien was filed properly , might be not legal lien , have lien attorney to check on it for couple hundreds . Liens needs to filed on strict timelines , I’m sure he didn’t do it properly

Definitely go to court to get the lien removed. Then because it is all yours they have ZERO rights to it. Now morally you do owe your Dad $5k for the down payment but they were married at the time. Then something for what they put into the property if anything. Just to keep everything equal I would morally keep 50% then split 25% each between them and just say...the end.

Sounds like my father. He abused, stole from me and lied every chance he got. I tried so hard with him. Eventually I saw him for what he was, instead of what I wanted him to be. I was honestly happy when he passed away. It was tough.

The whole time I’m thinking the house is $65k, their net worth is $500K, they make $150K/year. Something is not adding up. Why even have a mortgage?

They should have to sue you to put a lean ON the property. Now they have a unjustifiable lean that they have to pay to get it removed….crazy
