Zuma and MK party calls for six Constitutional Court Justices to recuse themselves

Jacob Zuma and the Umkhonto weSizwe party have called for six Constitutional Court Justices to recuse themselves, from hearing the IEC's matter involving the former president. According to Zuma, Chief Justice, Raymond Zondo alongside judges Madlanga, Majiedt, Mhlantla, Theron, and Tshiqi are all tainted by bias - and are therefore not fit to hear the matter involving him and his new party MK.

I agree with Mpumelelo. There is no enough time to waste. Seconding Supreme Court justices will assist in expediting this matter. As it stands according Zuma submissions the Court will not quorate. If they proceed they will have to decide on recusal application first before the actual hearing of the appeal.

You can approach the Concourt directly on constitutional matters. So, the problem here, is the love for Jacob Zuma clouds our judgement in that we forget that JZ was trying to teach us that we can disrespect the Concourt. He learned a lesson as a result. We need to defend our institutions of justice because they represent all 65 million of us. Not just Jacob Zuma.

I don't think they will recuse themselves. There is no ground of reasons. The Bunch may comprise two of these Judges, which out of the total 8 will have no significant voting power. The contempt of court was clear, so no reason to believe the Judges could have been bias. Now, it is the interpretation of the law, so the reason for the decision will be definitely on the basis of law.

Mpumelelo is wrong this time. When this court made a decision to sentence him to prison they were not looking or considering the Section 47(1)(e). So now they will not be dealing with the actual sentencing but deciding what it means in terms of the relevant provision of the Constitution. No apprehension of bias there as they will be deciding on two completely different issues. Good thing is that the same judges must weigh the application for recusal themselves and then decide whether it has merits or not. The apprehension of bias is created by Zuma himself and none of the judges have done anything to suggest they'd act in an impartial manner. Even the adhominem attacks leveled on them by Zuma they have not responded.

The analysts is mixng issues. This is a matter of remission and applicability of section 47 to sentence. What fresh minds is he talking about. This is a differente case. There is no requirement to re-argue the President Zuma sentence. If Zuma wants to re-argue he will be reminded that he tried a recission of judgement and was rejected. Now, all those judges decision will clarify the law and make case law for the country as a whole, all of us and not for President Zuma alone. We want to know from the Concourt Judges and not some Supreme Court judges what is the full effect of a remission on a sentence and whether a Concourt sentence without option of appeal applies to Section 47(1)e. No one else other than concourt Judges must tell us. This is a serious matter and people are trying to make it about Jacob Zuma. By the way Electoral Court carry the same status as a Supreme Court. From Electoral Court you appeal directly to Concourt, not to Supreme Court. No Supreme Court judge will sit on this matter. I predict this request will be rejected.

And that is important because it means you submitting wrong information here. All MK supporters are mislead because they think there will be a backdoor move to challenge Zuma conviction and sentence. Electoral court cant tell Concourt that they are wrong. It's just an opinion but it means nothing. Unless the law is changed by politicians in Parliament, that the Concourt cannot sentence anyone which will never happen.
