Hi I'm buying a new home with tenants in it and I need to occupied one of the units and I don't really like the other tenant cause they have to many dogs inside the unit and are paying rent below market rent prices and are not paying utilities either. What would be the appropriate way for me to ask this 2 tenants to move out after me closing on this home should I tell them that I'm the new owner and I need them to move cause I'm gonna occupied both units with my family?

Your ability to get rid of current tenants will depend on whether there is still an active lease in place. If it's month-to-month, you might be able to terminate the lease with proper notice (Texas requires at least 30 days). However, some states require more than that.

I'm in New York do you help people as lawyer in New York and how much would the eviction process cost and can I do it on my own or do I need a lawyer for that? They have to many animals inside the apartment and are not paying utilities because the property only has 1 meter and are paying below market rent prices and the landlord according to the meter laws has to pay the utilities. Can I raise the rent and charge them for the utilities they are using and pet fees?

My landlord refuses to turn on outside lights at 4:30 as the sun sets around 5. I get home at 5:15. Last year on Thanksgiving our dinner was over and my 80 + year old aunt couldn't leave until the lights came on after 6 pm. I had a delivery tonight and my delivery driver tripped coming up the stairs

You stated to serve the notice to the tenants and also send a copy by certified mail. What if the tenants refuse to sign the certified mail and it gets returned back to you by the post office?

Tenants know that a landlord refusing to take rent based on "fees" is not grounds to evict you in Texas. Make sure if you file a pauper affidavit to pay all rent payments on time and also pay the back rent that the landlord refused and tried to sue you for. The court registry will take payments for any month. It makes for a strong defense because you want a "take-nothing judgment." Make sure to ask the right questions and get the landlord to admit they refused rent due to "fees" and not your inability to pay rent. You can do the same in JP court. Show up with all months of rent and explain to the judge that they are refusing rent due to "fees" and not inability to pay but most JPs are for landlords to prevail

As a tenant, I emailed to landlard with a 30 days notice since it is coming to a natural end and didnt want to sign a lease renewal of 1 year .is that wrong? I have to do that notice of termination still ( cus I heard of 30days notice) ? There is a roommate remaing . Since the lease ended in 30 days, why do I have to fill out a "release of roommate" form as the landlord sent that to me.

The rent amount that I charge includes all utilities. Renters hardly ever pay their trash and sewer bills, and the landlord has to pay those bills before another occupancy permit will be issued. I do not rent to anyone whose employer does not pay them a per diem above their salary. These contractors do not cause trouble, damage property, require legal action, or holdover. They usually leave the property spotless and often better than they found it.

Hello Mr. Garcia, first of all thank you so much for sharing your knowledge with us! I’ve been learning a lot from you by watching your videos. I do have a question please if you could help me out. Here’s my situation: A. My tenants moved in on February 5th instead of January 1st. The lease agreement stated January 1st as the start of the lease. According to the contract they were supposed to notify me in the event that the property was going to be vacant for more than 20 days. I was never notified that they were not planning on moving until February. B. The contract lease expires on December 31st. I received a text message on October 14, 2024 that they were moving out. They failed to notify me in writing that they were moving out and they were 3 days short of a 30 day notice. C. Tenants moved out on November 8th, 2024. It’s now 11-21-24 and I haven’t been provided a forwarding address for me to send them an itemized invoice. D. They left my home with a fruit fly 🪰 infestation due to leaving a bag of dog litter with poop. E. Personal property was left behind such as cellphone, jewelry, and heavy furniture. F. Upon cleaning the home we found out that the house had a plumbing problem. The sink and toilets were clogged, the washing machine was not working properly and other maintenance issues that were never reported to me to address. My property is located in Connellsville Pennsylvania. The home flooded due to a freeze that occurred in late January and as a result I spent close to 20k to properly repair the damages. My insurance didn’t cover the damages due to the power or heat not being turned on. Had my tenants moved in on January, this costly incident could have been avoided. Doctors do not feel mold is a threat therefore they never diagnose sickness from mold. The same thing goes for meth or any other sickness that can come an unpopular Source. And indeed somebody who is already sick can get worse by mold. As a matter of fact if you're already sick you are susceptible to threats in the environment. That should go without saying.

You can't garnish wages in Texas, but if you know the work address, the defendant can be served at work.

Sound's reasonable the way you put it, what's not it measuring the lawn to ensure that it's not to tall On the other hand if a HOA has rules about lawn care they should have a crew come out on schedule dates for the communities Lawn Care (with the opportunity to opt out and taking responsibility yourself) and fit the lawn fee to the HOA fee

What happens when a tenant presents a doctor's note for a "Support Animal"? Can they legally stay on the property, if they present such a notice after-the fact? A landlord that expects the renter to "leave the place better than they got it" is a fool and the renter that does the most of a rental house is an eveb bigger fool. I've seen it so many times where a renter can forget that it's not REALLY theirs, they're at the place years and years and so they're doing major projects on the place, improving the value of the place, only for the landlord to now want the place back for themselves OR the renter can have the place sold up from under them after years, and as can be expected, the renter loses all, without any recognition for improving the property value. All is lost to them. Never ever, as a renter do any major renovations or costly projects for a home that isn't truly yours. Not a thank you, not a sorry about that, just out on your butt at the end of the day, same as you would be if you were a useless, late paying, terrible tenant. One of the major perks of renting is the fact that the maintenance and major repairs are not on you as the tenant. Landlords, if you want your renters to treat the place as if it is their own, set the arrangement up as a rent to own, so there's some guarantees at the end of it for them. Otherwise , do your job and keep YOUR maintenance up yourself.

I made the mistake of trusting a family friend to run my property. In the UK, when you sign up with a wifi or water company, often times, it is for a fixed term contract and can be hard/impossible to get out of. So, you cannot transfer the bill to someone's name. I should have included the bills in the rent but I didnt - assuming they would pay me on time separately. Big mistake but definitely a learning curve!
