More and more employers, Family Dollar, are hiring 3rd party (Experian aka Theworknumber) to dispense employee verifications at a fee of $67 a check. I had a woman just yesterday, who seemed great on the surface, try to pose as her grandmother (sent me a screenshot of her grandmother's credit score--they had the same name) etc. Knew something was up when she didn't upload the FRONT of her driver's license in my application and didn't disclose any previous addresses despite being 40 yrs old. Pulled her background check and low and behold she owed OTHER apartment managers rent money, had a terrible credit score, is nomadic, couch surfing etc. Dig, dig, dig, screen, screen, screen.

What about a broken ceiling fan pull chain. I can't turn it off. I have to turn off the breaker and that turns off my whole living room. No internet, tv, lighting when I come home from work and security system. I''m worried a constant running ceiling fan can start a fire. I've been a good tenant for over 6 years. She's always been lazy with waiting and doing cheap fixes.

A broken ceiling fan pull chain? I can't turn the thing off. It's been spinning nonstop for 31 days. I'm gonna have to cut the power to my living room and see if the motor is hot. Everything is ran through my living room. Internet, TV, security system, lighting. A stopped ceiling fan or no internet and security? Both bad choices.

I'm not an electrician and if anything happens, I get hurt it's gonna hurt my credibility so I'm just gonna keep monitoring the item and it's operation and if it starts overheating I'll have to have no electricity use in half of my apartment and then contact an attorney and go from there.

Do I know where these tenants now live or work (to serve the new lawsuit on them)? 2. If I win, can I reasonably expect to be able to collect my judgment from them (they have non-exempt property, funds in accessible accounts, the willingness and ability to pay, etc.)?

@@Texas_Made_ Slumlords don't screen bc they couldn't care less if the unit is destroyed. They'll just rent it to the next tenant that no one else will rent to. Better a vacant unit than a bad tenant. Of course the bad tenants want nice places to destroy and have no intention of paying rent.

If all tenants are given a notice of eviction stating "Change of Use" as the reason, contact a tenant attorney before vacating the units. This reason is often used when building owners want to increase the rent more than allowed by CA Rent Control. An attorney will check to verify that the owner has submitted required paperwork with local government offices for the Change in Use of the building.

In TX tenant can pay rent till 2 days after the due date so should I be reminding them if they always pay within that time period but we cannot technically charge late fees untild 2 days after due date

ESAs are generally BS. We allow pets and tenants do the ESAs to circumvent paying a pet deposit, etc. They also do it to have certain aggressive breeds on the property. We checked here locally and we say that they must undergo an approval process and are not automatically accepted. The local Fair Housing agrees and says we don't have to accept any breed that would cause us to get our insurance cancelled. This is in Ohio.

Here in Texas, if the Tenant has a justified medical basis for the animal, and if the landlord can make a reasonable accommodation, they would have to consider the Tenant and could not reject them on the basis of the animal. However, if taking on the Tenant means that the landlord lose her insurance protection, can that measure really be considered "reasonable"? My guess is, probably not, and rejection on the basis of the insurance limitation would likely be acceptable.

I have water making its way through the wall, getting my bedroom floor wet. This happens when it rains A LOT. I'm on the bottom floor. It's happened multiple times recently, and they refuse to fix it from the outside. They just bring in a floor fan, and pull up my carpet. They put some silicone in there the first time, but it immediately got washed out the next day by another heavy rain storm. I can't deal with water coming through the wall and getting my stuff wet. WHAT DO I DO??? HELP!! They didn't even bother to put the carpet back in place. Which is actually stull loose from when my water heater failed a year ago

I have learned that these people are called “PROFESSIONAL TENANTS”. These people know exactly what they are doing and why. They also are mostly familiar with their rights, and will push those rights to the ends of the earth. They also recognize that the owners really want their money and would prefer that, over a civil lawsuit. Nonetheless, I digress. Thank you for your videos sir.

@melpixie5480 No. That's not true. Sure, doorstops are helpful, but the tenant doesn't have the right to open a door so forcefully that the door knob breaks through the wall. A scuff, a dent, sure, but once the wall is broken through, that's crossing a literal line.

@@LandlordAttorney if a door doesn't have a door stop, it only takes a gust of wind or a slightly exuberant opening to cause a dent in the wall (depending what the wall is made out of). A doorstop is less than $10. Granted rules are different in there compared to Australia (we can't hang pictures, only 3M hooks), but surely where a door can make contact with a wall a door stop is the bare minimum

Wrong. So wrong. Doorknob through the wall happens all the time with bad tenants. They will smash the door so hard it will break a hinge door stopper. Many times the stopper will end up embedded in the door. And they'll just leave it like that and keep ramming. Don't even think about putting a stopper on the baseboard. That's breaking off the first time them run a vacuum. That is - IF - they own a vacuum. Many seemingly don't. Think you're going to put up one of those plastic wall shield discs directly on the wall to block the doorknob? Think again. They gonna Hulk smash it right through that as well.

That's potentially an opportunity for the tenant to exercise their rights against the landlord, but that tenant can also generally terminate a month-to-month lease with a written 30-day notice of termination.

I've seen them be pretty crappy on both sides. Had one claim my ex wife and I destroyed their home (we didn't, but it wasn't flawless) and kept the whole deposit. We found out ONE month after we moved that they stopped making payments a year before and the house was already foreclosed on, the bank was a week away from evicting us.

Tenants problem wanted to break the lease early. Six months left on their lease and their reason the couple don’t get along. I said we will sign early termination upon their written request with reletting fee equivalent to two months rent. Now they ask a payment plan. Atty can you do an early termination agreement? What if they failed to comply on that payment plan?

Most tenants don't have the $$$ to fight something that is such a common practice and part of a move-out: landlords/complexes retaining some portion of the security deposit claiming it was required for "cleaning" of the unit.

@i2isagrl The small claims court is meant to provide a low-cost option for the public. The key for the tenant is preserving a before and after record of the condition of the property. That can be as simple as a few dozen cell phone pictures, video, eye witnesses, receipts, etc.

You can't always have it your way. When i had houses tenants would put large holes in the walls. I didn't charge them. I knew it was better to give them their deposit and just fix the wall. You have to learn to fix walls and get them out of your house fast. Money doesn't help if you don't do your do dilligance up front. You get better as you go on in time. Good video from Sacramento.

I rented a place with wood paneling in part of the living room. The owner told us we could hang all the pictures we wanted but no holes in the wood paneling. (It was an old farmhouse built by her grandfather who had cut and installed the paneling himself fifty years ago so it had great sentimental value to her). We complied and got our deposit back, no problems. That’s the best kind of due diligence, make the terms very clear.

I mean, some families are slobs. Some rooms, like the bedroom of a 16 year old who has lived there his whole life, might have hundreds of nail and tack holes, random crayon marks, dried boogers..all kinds of nasty stuff. You end up having to skim coat everything 6 feet up the wall just to prep for primer and paint. That ain't normal use in reality.

Again, I'm not talking about paint. Rooms can be so bad that you have to skim coat the entire face of every wall with joint compound and sand. Sounds to me like its another one of these gray area "depends on how the judge is feeling that day" rules.
