Hi there! Very typical situation. Have you considered adding a partner on utility bills? Plus showing mail addressed to both of you to that address and having matching IDs. There are a few things that can be done to demonstrate that you both reside there, just depends on the specifics of your situation. Does that help?

Thanks for the great information ! I have submitted i-130 and according to my USCIS web account, the wait time now is 2 months. I want to submit i-864 in Jan 2025 for my spouse in Singapore. I am retired and will get around $3000 in social security income by Jan 2025, which is sufficient to meet income requirement for two of us. However SS income is not taxable. To make it look good, I distributed $40k from 401k to file tax in 2024 to make my total income $40k to meet the requirement. I didn't need to file tax in 2022 and 2023. For 2025, my social security income is not taxable and may have problem with NVC process. My questions are: (1) Can I use 401K as proof of asset (as I can withdraw from 401K any time without penalty)? (2) Should I withdraw my 401K to boost my income? The problem is that this will make my non-taxable SS income become taxable. Looking forward to you advice.

So I need letters of support for my I751 form [Removal of Conditions], but I guess overall it's the same as for I130. My situation is this: prior to me moving to the US, me and my husband went on vacations together, but he did stay at my place on 3-4 occasions, like spending Christmas together, with my family or us helping my brother with his new aprtement renovations. But other than that, we didn't spend as much time together or video call since my siblings are busy with work and the time difference is pretty significant. As for friends that knows us both before or after marriage and also lives in the US we have none. Also, my in-laws don't speak/understand too much English [they're Chinese].So my only option here is ask my siblings, his siblings and my sister-in-law to write these letters. Would that be enough?

I am a US Citizen and my wife and step-children currently reside in Colombia. Everyone's I-130s were approved and everyone's I-864s were completed and submitted. Do I have to wait to submit their I-485s once their visas are approved and they are physically inside the US or can I do it now? I have not found this answer yet? Also, on the I-485, page 3, part I, I last entered the US: do I just list under other - never entered the US? Thank you!

Hi there! You would only use the I-485 if they were applying for the green card inside the US, but it sounds like they are going through consular processing!

I expedited my I-131 form. Reach out congresswoman also. Days ago I got this message on my case window: On August 26th, 2024 your request to have your case expedited, referral number *********, was assigned to an officer for response. What that means if you faced in your practice . And how long it takes now for USCIS to approve my expedite advance parole . Filled AOS in April and sent all 4 forms. Marriage based green card. Thanks in advance

Although we are still confused because during your video, you mentioned that as long as you dont falsley claim that you are a U.S citizen you should be okay but doesn't working in the U.S mean that you are falsely claiming you are a U.S citizen (part 8 item 72 i148)

Hello I been with a lawyer for a few months now and I was wondering if it’s necessary to have a lawyer to help me file for the 1-30 so my husband can get the visa or is it better if I do it on my own. I have been dealing with this company Eric Price Attorney for a while and they tell me they will send my package to immigration but haven’t done nothing since March. I would love if you guys can please help me decide if it’s better to stick or do it on my own because I am paying monthly fee for them to do nothing at this point.

Good morning! I'm so sorry to hear about your experience. You are still entitled to get your file back from that firm. Is your spouse overseas or inside the US? If you're doing consular processing, it's relatively straightforward in the beginning but it gets more complex later on. If it's a straightforward case, you could at least try to initiate it yourself and then see if you need help later down the road. Either way, get your file from that law firm since you've already spent some money with them.

Also I have a question regarding the filling of my I485 application, I enter the county back in 2001 in a I94 WT stay for almost a year and then I left US for 3 weeks for family matters and re enter US again with I94 WT in 2002 and stay up to present time. I am having issues filling the part 8 question 78a, 78b and 79a, I will greatly appreciate if you guide me to answer those questions. Thank you
