Should you provide your married or maiden name on all the USCIS forms? Often applicants have this common misconception that they need to change their name on all their documents first (like passport and other IDs) and only then can they use their new name on the forms. This ACTUALLY causes a lot of delay and stress so let’s look into the USCIS Policy Manual for the answer! However, the manual says that for purposes of requesting immigration benefits, a married person may use a legal married name (spouse’s surname), a legal pre-marriage name, or any form of either (for example, hyphenated name, pre-married name or spouse’s surname). Requestors must submit legal documentation, such as the marriage certificate and the rest, to show that the name used is the requestor’s legal name. If your state allows you to change your name on the marriage certificate, go for it since that will serve as proof of your name change! Meaning your marriage certificate is all you need to fill out the forms with your new married name. Don’t worry about changing your name everywhere, just apply first and then take care of the rest.
