As a common citizen who does not understand law I would say that “whip” system is completely wrong! Why Aaya Ram gaya ram is bad thing? If we pursue Sonal’s argument then Party Chief concentrates all power without being part of the legislature and as a result become more unanswerable to people than a legislature who has got elected with votes of people in his constituency and hence answerable to those voters who elected him. Hence Legislature party should be real party as they are real elected representatives. If the decision of the court goes against breakaway faction then we run the risk of concentration of power in the hands of party chief as a single person. That should not be allowed. Power should be more decentralised! Also if a party chief goes against pre poll alliance and joins hands with other parties after polls isn’t that distortion of the mandate. If that is allowed then breakaway faction should also be allowed and in this case the faction was majority faction
