They don't really need probable cause. That's a myth. They can always get a dog to sniff for drugs and the dog will ALWAYS alert to a positive (if that's what the dog handler wants). After the dog alerts positive, then they now have probable cause.

Thanks, I understand what constitutes entrapment now. I was trying to figure out if Badger was entrapped on Breaking Bad while selling drugs to the cop, and apparently he was not because he was already predisposed to commit that crime.

Living in Michigan police here pretty much ignore said smell as it’s legal to have up to 2 onces ie 56 grams on your person and up to 10 at home. Can also grow up to 12 plants so long as they are not visible by a passerby.

The smell of tabacco is so overpowering especially with a black n mild, I don’t get how u could smell anything with a black n mild in your face. Plus the officer claims he thought it was a blunt, nah u can’t blunt wrap with a black , or I’ve never seen it done, it isn’t really done.

I’ve seen so many videos of “DUI” stops. Sometimes the cop “smells” alcohol. Driver doesn’t drink. The. Cop “smells” marijuana. Cop demand field sobriety test. (Subjective, and impossible to pass) Cop demands breathalyzer. 0.00 Does that matter? OF COURSE NOT! The driver MUST BE ON DRUGS! Car is searched, nothing illegal. Driver is arrested and taken to station for testing (Which may not come back for MONTHS) Car is impounded. Driver EVENTUALLY gets bonded out. Driver loses job. I think drunk (or impaired) driving is lower than it has ever been. But police have pressure to make more arrests. It’s not right.

if an officer claims to "smell marijuana" to perform a search but doesnt find any marijuana, it should be treated as an admission that the marijuana smell came from the officer himself.

In our small town I was a known pot smoker, luckily for me I was broke and had none on me. I was 18 and heading to work one morning when I was pulled over by a young cowboy cop, he said he smelled marijuana in my vehicle. That's all the cause he needed to tear my vehicle apart, I pled my case that it was the patchouli cologne I was wearing, I was told to shut up and wait. After an hour the sheriff dog came out and found nothing, this inept officer mistook patchouli for pot, now he is the chief of our small town, he was crooked back then, I'm sure he's crooked now.

If you live in a state where marijuana is not legal recreationally or medicinally cops can often get away with this. It's their word against yours and this is usually not seen as a violation of rights but a minor inconvenience to the driver by most judges. How can you PROVE in a court of law that he did not smell something even if no drugs were found? This is a loophole that should be closed, but unfortunately officer discretion is given a broad scope. We all know they are dirty cops either fishing for evidence or in some cases planting evidence. The best thing to do is shut up and beg or borrow $ if you have to & hire a great attorney. Yes it sucks but it's your best defense. The biggest problem is cops want to be the only ones in society with the guns, you can be a felon if you get behind on child support, or if you drive too fast. This means you can never own a gun ever again in your life, temporarily you cannot vote or have a passport or even travel out of state without permission while under sentence. Regular non-violent felonies need to be given their gun rights back. Period. It was never supposed to be taken away forever.

Clearly, to finally provide men equal protection under the law, there should be a statute of limitations on how much time elapses where women can still bring charges against men for sexual assault. It is incomprehensible that women can wait 5, 10, 15, 20 years. This is ridiculous and flies in the face of 'justice' for the accused. And if this is not all bad enough, when she confesses she lied or is found to be lying about the false accusation, NOTHING generally happens to her to hold her to account. She walks away. What is that? I would call it a travesty.

Of course it is a reasonable suspicion. But if he then shows a valid licence they cannot hold him anymore. A reasonable suspicion is not the same as a proof. Now had they found him driving a year later that surely would not be reasonable suspicion.

The no contact order is a narcissistic wife's biggest weapon in order to obtain complete dominance power and control over her husband and their children and because of their very manipulative tactics they will usually get the protection order and no contact order granted to them along with their children with lies deceits and false accusations and they do not have to prove any type physical abuse that you may have been falsely accused of. What day do you use and will use is any negative eactive responses that they intentionally provoke you with and show your worst side. Then they will claim verbal or emotional abuse and they will spin a Web of lies around those intentional tactics to provoke and bring out your very worst side. And these things do not even have to be verbal in person, but rather just text responses. And although these texts are merely calling out their toxic and disgusting behavior in the form of harsh criticism as well as warranted even though there isn't any threat of violence they can claim emotional or verbal abuse, and then get the protection order to stick. From there you may as well cut your losses on the divorce custody battle in family court because they have already taken full advantage and it's an uphill battle that most men will not win if they are trying to obtain 50/50 custody. And you can completely forget about trying to get 100% custody by proving thlat your ex-wife has narcissistic personality disorder it's impossible to prove unless the court orders her to get a psychological evaluation done for it which the judges never will do because first off they are already seeing her as the victim and secondly they just don't generally do that unless there is some real serious behavioral issues problems or tendencies that can be proven and shown which is extremely difficult to impossible. The other factor is that it would take a very skilled and professional psychologist to administer many tests and sessions for them to determine a diagnosis and anyone short of specializing in this type of psychology involving cluster b personality disorders can be fooled and manipulated and inconclusive more than last likely. If not favorable toward the narcissist. I've seen two prominent very well-known psychologists who don't have a specialty in diagnosing the cluster b personality disorder in particular but rather have a good educated and discerning work in their field of psychology overall, but can be fooled just as anybody else in determining if this person is highly narcissistic. The narcissist is not going to show or reveal the tactics and behavior they revealed to you.

Why was he driving with a revoked license while on probation???
@eiland369Ай бұрын
If he’s on parole he can be searched at any time if he committed a traffic violation and a revoked license is a traffic violation. Parolees and probationers give up certain civil rights when they are under the control of probation/parole and police contact other than non-detentive contact can be cause for violation.
@eiland369Ай бұрын
If the defendant was on parole when he was stopped the first time and found to have a revoked license then that police contact alone could’ve violated his parole.

Here's a thought! Don't have illegal stuff on your person.
The smell of marijuana is not illegal. It only provides suspicion when the smell is unexplained. Solution: start buying car deodorisers that smell like marijuana. terpenes are not THC. When the officer asks why there is a smell of marijuana, hand him the deodoriser. The smell is explained and there is no valid suspicion based on smell alone. It must be a violation for police to freely search every car because they choose to smell like terpenes when everybody knows why.

Hey Ryan great short video it gave me some on-site on my traffic stop, the Kansas highway patrol has been using lincense tag reader to pull over offenders that have to register the trooper wrote it was a traffic stop for speeding 5mph over the posted limit 65. All he wanted to see or in his view was My apps on my cell phone which on my new phone was a Gmail app which he saw upon placing me in his car I saw my registration on the screen of his compute when I entered the car so would that be a traffic stop on a curious, whim or caprice ? When I went to jail I learned that the KHP have arrested numerous offenders on this tactic
