How would this apply to the federal ada law , in your opinion? I’m epileptic; I can accept not being under/ over the influence while at work! But it feels like this law is helping those like me find work and help throw pennies into the economy!

Caveat: we're not lawyers. That said, cannabis is still classified as schedule 1 federally, which means that it has no recognized medical use, and is not legally prescribable. That means that there's no ada recognition of the medical uses for cannabis, which likely would mean that there's no ada protection for cannabis users.
@AllenJanek

@@gaize so even if cannabis was puscribed by a doc , because it's not federaly legal it's moot ? Ok 👍 what about job classification and the rehabilitation act because it's discrimination to the disabled to pay less or refuse work due to disability if the person can work, no?

Which means nothing. There are a number of reasons why someone might exhibit signs of Nystagmus, including simply being nearsighted. This, as a "test" of alcohol, is pretty much useless, as are field sobriety tests in general. They're mostly useless, as any number of things can cause people to fail them even when completely sober. Police aren't optometrists, and they're not qualified to test anyone on their medical ability to walk a line or balance. The only one that really matters is the blood or breathalyzer test, as that's the only way you can tell how much someone has been potentially drinking. People usually don't exhibit completely obvious signs unless they're very, very drunk (or a lightweight).

This is fascinating! I always thought they just looked for the bouncing at maximum deviation, but here I can see that even when in motion the eyes look rather, for lack of a better word, "glitchy" too. Is that actually part of the alcohol induced nystagmus too? Or is it caused by something else unrelated?

The "glitchy" motion is called "lack of smooth pursuit". It's one of the clues that law enforcement look for as well.

Also, it doesn't take a genuis to spot a drunk person. Anyone can pick them out of a crowd. And not to mention the overwhelming smell of alcohol when a drunk driver rolls down their windows is a huge indicator lol. People cannot hide that they're drunk. And a cop logically cannot spot the jerky eye movement of an impaired driver just by talking to them. They have to have them focus on something and follow it with their eyes.

Urine and blood are great for showing the presence of THC, but that's only indicative of prior use. These tests cannot show active impairment, which is what Gaize is for. We don't care about prior use, and can only measure the impairment as it's being experienced.

No, the jerking, or Nystagmus, is caused by a huge number of things (like simply being nearsighted)--alcohol only being one of them (and not even guaranteed). This is NOT any kind of indication if someone has been drinking, and honestly it shouldn't even be admissible as a legal test in court.

I'd really like to see tech like this in the field for all DUI investigations. Since human cops are using their own observations, and biases inherent to humans, much of that process is subjective. And, don't get me started on DREs! They're so certain that their knowledge is infallible that many people's lives get turned upside-down by the system. Replacing them is fine by me. Equal justice, without bias, can be possible. I totally support what you're doing.
