use AI to do a pencil scetch of house frontal one pic only is required in Ny. Mls one key says same thing about owning any info and pics submitted. My photographer said NO NO NO put my photos on your private site and upload to Zillow and it willpropogate out.

Super info mls is planning its funeral arrangements. My Broker has a clause in buyer broker form stating they can cancel any time however if buyer bfoker showedand/or informed buyer of property then the commision is still due reguardless of whether they procurred a new agent. Only in very rare insatances ie problem with selling agent would my broker release the buyer from the contract. terms of payment. I think more and more buyer agents are going to be interviewed before getting a client to sign with them. as for sellers mls cant do anything to a seller that puts their home on facebook huh food for thought!!

Clear coop was implemented because most agents would unethically start marketing a house before it was available on the MLS to try to get both sides of the commission. While repairs, staging or marketing were getting set up, these agents would put up yard signs, send mailers, and market to their database. Trainers taught this, brokers taught this, other agents taught this. This practice ends up hurting sellers bottom line because the property was not exposed to the entire market. Ethical agents who did not engage in this, also did not make noise to stop this practice. It is sad that this clear coop rule was needed.

I believe the bigger question is why would a seller not want to be on the MLS. There is no one that doesn’t want maximum exposure for their listing to sell it, but I believe that most do do not want it on the MLS for safety or privacy factors.for example, when you search for an Airbnb or a VRBO, you were looking within a certain area you don’t get the actual address. I think this is what we are missing.

It comes down to what the industry thinks MARKETING is. Imagine a policy like CCP in the film industry or the auto industry. Anyone in the marketing world would laugh at this policy. If we go into a listing appointment and we say we are “marketing” experts in anyway, to me is unethical.

This lady from Zillow is absolutely right. If the seller doesn’t want the house in the MLS , they should deal with a wholesale agent, someone who is not a licensed Realtor, otherwise , if you are a Realtor not advertising your listing to the public, you are in violation to the fair housing law.

Currently rolling out a new CRM that isn't part of the usual big name real estate players like follow up boss, lyfty, etc. I stopped two days in and went down a rabbit hole thinking I was really messing up not using one of those platforms with all of their flashy features... This is becoming a big trend... Zillow acquiring FUB, and REAL owning Lofty. This video just solidifies me feeling good about building out Copper CRM. Nothing like paying to have your data mined and sold.

I keep making this same comment on forums b/c I don't think agents understand what behavior clear cooperation was addressing. <COMING SOON> Zillow listings --- when inventory was down, Zillow needed more houses to to sell to agents for impression based marketing or to its lender members. Agents got into the habit of listing a home in Zillow and holding an Open House prior to entering in the MLS (in our market it was a big problem). Listing would sell after being exposed to ... 500 or 700 people? Office "pocket listings" or Exclusive sites listing homes for sale does nothing to help the home sell. ABC Brokerage (and I don't care how large they are) does not have the reach of the MLS -- the entire reason we all agreed to cooperate in this system. Office exclusives serve 1 purpose - well here are 2 lol: build the brand not the agent / and ability to double side the transaction. "Mr Seller ..I will reduce the commission to 4% if we sell it in-house to our exclusive pool of vetted and approved buyers" (looking like the hero) -- manipulation at its best and hurtful to our industry. There is a boutique brokerage locally that for the first month only markets internally via the office exclusive listing - is the consumer really making the choice? So as an agent, generally we set up searches for clients directly into the MLS via Auto-emails that are triggered the very second a listing goes on the market. Some may use 3rd party providers but the reasons are the same. Your out of town/out of country clients across all brokerages in the the World that have an IDX link, get immediate access to when a listing goes live....exposing it to the most amount of buyers looking to BUY RIGHT NOW. By the time an office exclusive is placed in the MLS, important time has passed and the buyers looking at the time it was listed may not be in the market anymore as they have purchased something else because XYZ Realty may have excellent SEO and exposure but the data is not fed or shared or placed in the spirit of cooperation with fellow agents who the majority subscribe to the MLS. MLS provides accountability. The Code of Ethics and its enforcement by your local board provides accountability. Do we want to be like the commercial real estate industry where there are multiple sites and each one is quite expensive to list a property on? If 80% of buyers are using buyers' agents to purchase, why do you want to hide the listings? Exclusivity allows for slick market manipulation all at the expense of the seller. Appraisers use MLS data as subscribers in order to make accurate valuations on properties. Those off MLS sales on Zillow were not entered in to the MLS (even as Stats only) listings and hopefully were caught through public records. I get it though -- brokerages are operating on razer thin margins as teams have continued to get reduced caps from their team members in exchange for agent growth/supervision/training. Firms answering to Wall Street shareholders that helped to fund mass expansion, need to differentiate themselves from others by offering exclusivity. Entrepreneurs and business owners do not want to answer to any authority or be told how to run their businesses. The shocking growth in equity and home prices during the pandemic and strong years that lead up to it, has allowed for many to rebound from the Great Recession, where as sellers in foreclosure, paid NO closing costs or commissions (the irony of this looking back now!) and agents' commissions were actually protected after NAR lobbied for us. We need to move on from the divisions we are creating. We are still stronger together and accountability makes sure that we are always placing the interests of our customers/clients before our own desires for profit. Instead of focusing so much on Clear Cooperation and upending affiliations, we should focus on 2 segments unaffected by the lawsuits but need more scrutiny: Builders and their use of complicated 1-sided contracts and incentive programs that should trigger RESPA/cut out non-in-house lenders (yet use those incentives to offset increased closing costs with little to no transparency)..and 2) The We will buy your home for cash / corporate buyers who keep sending me texts on the commissions they offer on every home LOL AND claim to make. Realtors who must abide by the Code of Ethics routinely produce ULTRA low valuations coupled with fees that can exceed 8% not including repairs. Check out the top 50 markets and see who the top firms / brokerages / entities closing each month -- it was alarming to see OpenDoor listed with a high volume of purchases and sales (repeatedly number 1 or 2 for Years!). I do solicit them first when working with a seller. On the last home I sold, the difference was 75k between what I sold it for and the revised offer purchase. That's a heck of a convenience fee. Sorry for the Book long response! [a little on my background and experience: 19 years in business in Florida, previous owner of a large team (personally made 1m GCI over 4 years post recession and days on market closer to 60 Days with zero starting funds), assisted with the growth/rebuilding of small teams after the crash, coach/mentor for a mega team in middle of expansion, closed about 375 homes, gave over 125k back to community, got into the business selling condo conversions (!! like used cars....also known as the wrong way to sell real estate), worked for KW for 15 years, eXp 1 year when they had 4k agents, back to KW, back to eXp to be Dir of Productivity and Expansion for their 6th largest team in the state, now I am parked with an independent broker ] 😀 Thank you BAM for continuing to offer these podcasts and many other generous ways for real estate agents to stay informed!

I know Realtors who have not used the MLS for years. They are on all the social media sites. MLS were smart they would tell NAR to go walk the plank. To me each state should have main MLS that covers that state minus NAR.

This conversation concerning a FB listing seems a little confusing to me. Normally you guys know your stuff, but to me seems like you both just began using Facebook:) When an agent lists a home on FB, they should be dropping the ICON form friends to PUBLIC. At that point anyone even non-Facebook folks will see the listed Home on that agent's PUBLIC page. There is no argument as to who will see the home, all will see it. What's going on with you two?

It’s against the Clear Cooperation Rules because the listing is not listed on the MLS. Putting it on FB is the violation as the only out on CCP is office exclusive. That was the point or am I missing where you’re coming from?

@@ByronLazineRealEstate Understood, btw, I meant no disrespect. I'm seeing listings here in MD still being put on FB but as I mentioned, they are under the Public drop down. You may put an MLS listing on FB, I don't believe there is a violation there. To be clear, these are MLS listings clearly stated as such. Am I wrong on this. I may have misunderstood you both. You are speaking of listings NOT on the MLS but on Fbook? Correct?

I'm in California. I can't cite the bill number, but I've been told that the limited duration for buyer contracts is in anticipation of a new law in January. I don't see how it's a benefit to anybody. I think the law just slipped through without any scrutiny.

NAR has offered little more than MLS for decades I've been a Realtor. Wouldn't be, wouldn't have been if not needing MLS access. Rules and requirements which promote mediocrity, and then don't enforce those rules effectively, so bad actors and weak Realtors benefit over hard-working, rule-following Realtors.
