AI doesn't "doesn't store images" and "observes art" (what does that even mean lol) . That is just factually wrong. I make AI models. AI needs to be trained on downloaded digital material in order get it to a usable state in many cases, especially fanart. There is software that does this. Unless the base model is already trained on the copyrighted art (which anyone with a brain knows that in order to get it that good, they mixed a ton of private IP into it) it'll produce poopoo. Also every company/open source model is different. So AI trainers do what I mentioned: they go scrape/download the copyrighted material, train a model or a specific network on the images, then use the networks, or re-release the network either for free or a premium, often even literally referring to the specified style of output for the exact IP/copyright holder in their distribution. Its a neural net generator, it doesn't surf the web looking for pictures unless its a specific hypothetical AI observation-generation system... which you didn't specify. So no and yes, with how you currently phrase it, the AI itself is only generating similar images based on training data (no copyright), but guess where it got that original "training data" aka the copyrighted images from (yes copyright)? Its like saying the arsonist didn't create the fire, it was the match that did it. You should brush up on your data laundering law before you start using words like irony.

I really hope they finally take Rattle down. IMO the guy has been a scammer in Canada since 2017 and makes videos to show he is on the level, but in reality is just as bad as the rest if not more so. I've dealt with him since he went by RattleBear, when he scammed me out of over $500, despite what you may feel. He has no credibility and deserves to be fully investigated.

I would love to see, through the process of civil discovery, evidence that leads to the basis of new criminal charges against Mr. Bassik that can be prosecuted in criminal court. You start talking discovery and deposition, you better be squeaky clean or working along on a very tight leash under the advisement of very, very good council or you can end up with a lot more attorney fees defending more than just your reputation!

Even if there isn't much that damning, nobody likes to have their professional and personal life under such a large microscope. @@ManUtdTobbe I have bias because (1) I favor Rattle's side and (2) I generally have a strong view of the First Amendment (but this is an area of law I know decently well!). That being said, I've tried to discuss Rattle's case objectively. However, no matter how good Rattle's case is, that doesn't ensure that he's going to win. A lot depends on money and lawyers. My analysis assumes that both sides have the means to pay for lawyers to duke it out. But if that doesn't occur, then who knows. Also, my analysis is based on the information we have publicly available. It's very possible that, during discovery, new information could come out that makes Rattle's case weaker than I originally believed it was. But that's an unknown.

AI would be unable to produce the images without the initial training data to create the AI. The issue is that training data is (most of the time) not licensed and is being copied directly by AI to create it's "algorithm." It's unfair to say the original images aren't part of the AI, because they are (just translated into a very complex mathmatical model). I think it'll be interesting to see how courts side on IP and AI, because public opinion is so negative towards AI, mostly due to companies abusing it and trying to get rid of jobs.

This is wrong the images are not stored in the model. This can be easily proven by the simple fact the models are usually 1-10 gigs while the training database of images after compression is terabytes if not petabytes. What is in the model is abstract concepts like human,dog,cat and concepts of art style etc. some very popular images like starry night may be an able to be somewhat recreated by a diffusion model if prompted explicitly to do so. But this is simply because starry night for example has appeared In the data set so many times with the tag starry night that the model learns to embed a lot of the aspects of the painting. But even in this most extreme example models cannot accurately reproduce starry night.

To add, the phenomenon of machine learning models producing results that are too similar to its training data is called overfitting and it is not something you want in a model and is avoided as it hurts the model’s understanding. As it learns to “remember”. With all this being said I do sympathize with artists and hope that people still value human art as I do no matter what even if a ai could create the same quality as a human there would still be times in witch I choose to commission or buy from a human as I value human creation.

Like, America's literacy rate is terrible due to a lot of factors outside of children's control. So, even though it would seem reasonable, I wouldn't expect every single person to have basic reading comprehension, because I know like 30% of Americans actually can't read. If our literacy rate were genuinely 100%, then yes I'd have that expectation. Similarly, if we had a system where everyone had the same upbringing as you or me, my expectations might be different!

But in all seriousness, when you're raised without having taken America for a given, it becomes a lot easier to accept a life of more difficulty. 90% of people raised in America already have significant luxuries when compared to the average upbringing of an immigrant from another country. My mom's family had a car in her home country, which was something that only the "rich" could afford. And even then, it was only used for road trips, not for the daily commute. My dad's family had no vehicle. Both my parents grew up in multi-generational three-bedroom households (where either two kids were sharing a room, or one of the kids slept in the living room). So it wasn't nearly as big of a deal for them to live with their parents til they got married in their late 20s. (As I suggested in the video, they also got a LOT of help from the country/state's welfare programs).

@milehighpokemon I've mentioned before but enabled not entitled is something I am going to try my best to raise my kids. I feel a ton of Americans are just so damn entitled and point the blame elsewhere who otherwise could live their American dream but they don't try anything to propel themselves towards those goals. I'm all for the welfare programs done well. I just know so many people in lower and mid classes that cry about the welfare programs as if that's what's making the country run a deficit relative to all the other spending. Worrying about what others get vs what they have themselves. Huge problems out there and many are too lazy and dumb to try and help themselves lol

I think my biggest privilege was having parents who instilled in me a work ethic and demonstrated to me a healthy loving relationship and I watched them grow over my lifetime. If you are born to parents who blame "the system" and say the American dream is dead and eternally victimize themselves you are more likely to not advance. Sadly many poor feel and act this way. Would be hard/impossible to measure but I stand by this.

Although my parents would have tried to pursue the same goals regardless of where they immigrated to, I think most other countries would have had significant structural barriers blocking their success (either because of language, lack of social programs, or anti-immigrant sentiment/discrimination). Although, I think they probably would have also done pretty well in Canada as well.

My view is that you shouldn't break the law. But I think the law should be changed to loosen up copyright and expand fair use. I don't have an exact proposal for you. However, stronger copyright laws add only marginal incentives for creativity and stop a ton of new art from being created in the first place. For example, I believe that extending the copyright term from 70 years to 90 was harmful, and it almost exclusively helped large corporations.
