The concept of "owning" mechanics or genres is killing creativity. Most of these you named already existed in other prior games, so these developers are basically saying "I'm copying this thing, but I will sue you for copying from me." It's bullshit, and it's affecting many industries like music where people are getting sued for similar compositions that likely never even heard the source. Sure the lawsuit may not succeed, but independent/small artists and developers don't have the resources to fight against big corporations that don't care about creativity, only isolating their profits.

That ping system exists LONG before EA patented it, so they basically did something stupid for once Pretty much every FPS games out there have that system, so EA just wasted their time patenting something they haven't created themselves to begin with

I thought the same thing. EA something good! No, something must be wrong. Then, I had a scenario in my head where someone at EA initially made the patent to block other publishers from using the mechanic. But their lawyers told them they couldn't. Seeing they already wasted time making it, they thought that they might as well use it to uplift their image.

Aspiring German/European patent lawyer here: 1. Note how most of the patents are merely active or enforced in the US (as can be seen by the country code "US" infront of the repsective patent number)? This is because in other countries you are unable to patent concepts relating to playing games. For those interested see for example the European Patent Convention Article 52 (2) c) which specifically excludes it. At least in most of the countries, patents can only be granted to devices or methods resulting in a technical effect, whereas mental processes, such as mathematic formulas as such, are not patentable. 2. Note that some "patents" referred to in the video are not granted patents but patent applications (such as the Sonic Corckscrew). That is a common misunderstanding, so no blame on the creators of the video;) It was very enjoyable and interesting to see. To clarify a bit, everyone can apply for a patent but there are several criteria that have to be met before you are granted a patent. For those interested you can identificate whether a patent is granted based on the letter following the patent number. "A" indicates merely an application, whereas "B" refers to a granted patent (also true for non-US patent/appliactions). 3. As was already stated by others here: Just because you are granted a patent does not necessarily mean you can also enforce it. Actually it is quite common that if you try to enforce your patent on a competitor, they respond with a nullitiy lawsuit against said patent. This may cause the patent to be withdrawn in its entirety or to be limited. 4. Every patent proprietor is free to allow others to use their patents. This may be for free (such as EA apparently does with the Ping system) or you could license the use. 5. To respond to some comments condemning patents in general: Patents are not necessarily bad. In fact, many inventions only occurred because some people wanted to circumvent existing patents thereby creating even better devices, methods, etc. So patents actually (should) fuel inventions. Hope this shed some light on patents:) Again: a very cool video.

Let's be honest here, no other developer will manage to do a proper nemesis system even if the patent wasn't there. Look at Assassin's Creed Odyssey with it's mercenaries, nowhere close to Shadow of War. And turning the nemesis system into another souls-like where every second game tries to half-assed copy the original is not good.

Game mechanic patents is just shitty behavior. They do not patent that shit so they could use it, they could either way, they only do it so they would get cash from anyone else who could use it, just like SEGA did with crazy taxi arrow. Of course it also ensures competitors have harder time making better games, it is just shitty all around.

The Game „Fairytale Fights“ has a very similar mechanic, you can make precise cuts and the cuts are visible in real time. It’s set in a cartoonish fairytale world, but the cutting mechanic definitely has something in common with what Metal Gear Rising later perfected.

Because it is crap. It's the reason why MG rising came into being because kojima found it to be crap and couldn't make it work in a game for the next MGS so dumped the tech but got platinum to at least make a game out of it as to not waste the work put in already creating the tech. Really, what is it useful for outside of looking nice. Even gameplay wise in MGRR it's just an inconvenience to the player. It's more better to just mash buttons or do one slice.

Thing is that companies exist to make money so there's no incentive to stop making patents. Keep in mind that patents like these could be used by third parties but the patent owner will demand a percentage of profit in return, so no one ever really tries to do anything already patented. Best case scenario is do something similar but with a twist, maybe 2 to cover yourself legally.

This isn't legal advice and I'm not a lawyer (though I did study law to a degree for work-related resons), but patent law is designed to protect unique inventions and, in most cases, the specific mechanics used in playing a game don't qualify (i.e. moving a piece across spaces on a board or placing letter tiles to form a word) because they are able to be implemented in any number of innovative ways to create something wholly different. There are multiple patents for manufactury processes of copper wires, but making something that uses copper wiring is not an infringement upon said patents because the invention itself is unique from the wire it contains. I don't believe any of these patents are enforcable just based on the nature of video games as a medium unless you can prove the code itself was lifted from one game and placed into another. 🤷

Also, there's a thing in law (I know that it exists in trademark/copywrite, so I'd *guess* it applies to patents too) where you have to *aggressively* defend the disputed thing (copywrite/trademark/patent). If you *don't* even once, you might accidentally relinquish said thing. Now, that might only be in U.S. law though. But if it's at all similar in Japan, then Nintendo might have a fight, because they *knew* about Palworld for *years* and did nothing...only suing when it became very successful.

#1 - *The Wonderful End of the World* comes to mind. It's a rather small game from a small studio, but the basic premise is saving parts of Earth before it gets destroyed. The only difference (aside from the very much 'indie graphics' look to it of course), is that you're controlling puppet that incorporates the objects into itself, rather than a tiny alien that pushes the ball that absorbs things.

How does it? These companies created the system, it makes them unique and gives the games a selling point again by it's competitors. Arguably it amplifies creativity as if a gaming company/studio wanted to they could 1. Buy the usage of the patent 2. Create a new style of said banned innovation.

Jumping in general can't be patented, but if the character does a specific animation in the way they jump, it could be patented For example, the way that Lara Croft can climb up a ledge by doing a handstand and flipping her legs over her head in the old Tomb Raider games. I think that can be patented since it's directly associated with the games and the IP

You got the Sega lawsuit wrong. They didn't sue over Simpsons hit n run. They sued over Simpsons roadrage. Which is much closer to crazy taxi than hit n run. It's the same premise and they have the exact same arrow above the driver

This thing of patenting game mechanics is one the biggest setback in the gaming industry today. Pokemon games are a great example of how far behind Nintendo is compared to an indie company that made Palworld.

Reviews for Nuts and Bolts were positive, blame the fans for not buying it. Players wanted more Banjo and got a building game. Zelda fans got more Zelda along with something mostly optional.

As a video game producer, this is a really useful video! I'd heard of the loading screen minigame patent and I'm very happy to learn that it has expired. Personally, I don't think anyone should be able to patent a game mechanic, as you mention in your video all it really leads to is stifling of creativity 😞

I mean, you want to use your original mechanics as your "secret weapon" to ensure people will only play your game. But what's the point of that when the rest of your game isn't so great? You can find great mechanics in bad or boring games. Shadow of War has the *Nemesis System,* but is so repetitive game for me that the mechanis alone it's not enough to make the game better. Lookslike they're afraid talented devs would take their mechanics and make better games.

Just a clarification. Patents have to be specific. This means that a game mechanic cannot be patented, but rather specific implementations of a game mechanic can. This mean that others can implement the same mechanic, they just cannot do it the same way as in the patent. (And a footnote - we do not yet know which patent Nintendo is suing over. It may be around the Pokeball, but they have over 3000 active Japanes patents right now)

For me, two battle systems in RPGs are the best I've ever encountered. The first one is from a really old game, Ambermoon on the Amiga, and the second is the one from Last Remnant. The ATB is a close third.

Hey @gameranx just wanted to give a heads up about patent law as this is kind of my area. Patents for video game mechanics protect the actual functionality of the mechanic itself (in this case its usually method patents, so the actual method of user interaction with the system from the video game). The "look and feel" mentioned here is in reference to copyright law which allows you to protect the expression of the idea. All of these games have copyright protection for the expression of the ideas in the games, however those with actual patents allow for the exclusion of others from making, selling or using their patented mechanic (essentially the functionality).

The ping and that last one, gathering things into a ball, are legit good ones. One helps others with no tricks, and the last is so unique and clever that you can't really get in trouble. So they can totally call dibs on that patent because it's their's no doubt about it.

The nemesis system is an innovation of earlier games that introduced persistent interactions with npcs. Personalized enemies, and dynamic hierarchical systems where enemies could climb the ranks are certainly unique as far as I'm aware. Hopefully, a studio will take inspiration from this and come up with something even more ambitious. Adaptive AI outside of this has been rather disappointing, I can't think of any games that are doing anything special in that area.

@@McYeroc well, where to start... While it is one thing for a company to claim ownership of for example, the Dragon Age universe, or the Resident Evil universe, as that much makes sense. When it comes to game mechanics, and can become very limiting for developers and result in lower quality gaming experiences for the consumer. Let's say, that like pokemon, a developer team wants to have a creature capture mechanic for their game with dinosaurs (like Ark), so they have to make something different, they patent that idea. Then the next team comes along, with a new world, new premace, new story, new and totally different gameplay, blah blah, but they also want to be able to capture creatures in their game. So they patent their Idea. Then along comes a small indie dev, and they have what could potentially be the best thing EVER. but the ideas they have are all patented out, they either have to change things drastically to make things fit, or fork over a ton of cash to use an existing patent. Make sense yet???

also, with the rise of "a.i programming" (game design) it will happen some scenario where there will be a need to input "overrides" to big programming A.I, because it will/may "compute" that the best solution for its task is some 2020's patented solution

Warthunder's patent on physics-based mouse aim flying is also crazy. No other game is then allowed to actually do simulatory physics calculation for aircraft to do mouse aim flying... It's so wild when they patent science in games.

The first side scrolling video game showed up in 1977, eight years before the first mario game. Imagine if the makers of that game had patented the whole concept of side scrolling video games. We wouldn't have had mario or sonic or castlevania or any of the other classics. Nothing regarding a game should be allowed to be patented.

Pokémon is the biggest waste of an IP I’ve ever seen in my entire life…. GameFreak and Nintendo have been coasting on mediocrity for decades now, and rely solely on nostalgia. I would’ve loved to see the Pokémon games stick to sprites and do the 2.5D beautiful artistic backgrounds like Square Enix does for Octopath and games like that….. Instead of the derpy, ugly 3D models. Edit: Or if they were going to do the 3D models, at least make it with a beautiful art style…. Not the lazily made BS fans have been getting! Especially with the budget that they have to work with. Companies like Square make way better games with much higher quality. Despite having a tenth of the budget.

In Freedom Fighters I loved directing alíes to Defend/Attack/Stay where you pointed at. It was a great mechanic. I set up so many traps in Capture the Flag type missions. It saddens me no other game has used it.

That's the kind of stuff that ruins the video game industry... When you make it so nobody else can do something even remotely similar, you end up not making an effort because... well, there's no competition. And if there's no competition, you have no incentive to upgrade on the formula and make it better, so you don't. And you end up with something that becomes boring after two or three entries in the series, because you never have to reinvente anything so you just do the exact same thing over and over again...

Guys, love the channel - but have been meaning to say this for a while, we do not need 6-10 seconds of nauseating, obnoxiously loud gameplay in the middle of Jake or Falcon's narration. It completely disturbs the flow and takes us out of the video. I get having it to illustrate your point, but half the time it's not needed and even when it is, the editor leaves it on screen for far too long. It is infuriating. For anyone thinking I'm being OTT - skip to 24:10 - WTF is the need for this? Then literally 30 seconds later we've got 24:43. Enough already!

Patents used to just be a way to protect your intellectual property from big companies and knockoffs, but now, it's only used by big companies to monopolize features and fun.
