I forgot to add the illegal search that took place when the SGT. stuck his hands in the kids pockets. There was no arrest made so there was no search incident to arrest foundation met, making the search that was conducted a 4th Amendment rights violation. This Kid showed cops how it should be done. Good to see but sad at the same time.

Don't forget the assault and kidnapping by the cops. They had no legal basis for their actions. Therefore, their actions were illegal. When cops start getting arrested for their crimes, they will stop.

Something I noticed as well.. Police cannot go into your pockets. There was ZERO doubt in my mind this was an arrest. SAM(Police moron #1) was ready to take him to jail and the Sgt was too.. The SGT also delayed his release and continued to detain the Young man so he could "talk to him". As if that an exception to holding someone..

Got to agree. Cops love suspects talking so they can gather evidence to use against the accused. When they try to shut the conversation down, it's a clue that they are giving more than they are getting.

I'm a retired police chief and I can't believe departments tolerate having officers this ignorant of the law. It baffles me how many officers think they can cuff and detain someone prior to doing any sort of an investigation.

The dumbass cops should have taken the time to go inside the nursing home and educated the staff and residents that photographing from the sidewalk is not "disturbing the peace" and is not a violation of anyone's privacy...instead they preferred to lie like pigs and escalate the situation. Should we be surprised??? The female cop is likely an ignorant quota hire.

The Sarge knows well that the detention is unjustified; you can tell by his conversation with the girl cop, but whenever he talks to the kid he won't give up the fight and keeps arguing to assert their authority.

She was so eager to arrest him. So excited she couldn't stop talking. Even when the sgt said its not illegal, she continued on as though she didn't hear him. She was adament about that disorderly charge. Sgt had to stop her dead in her tracks. Then he ended with his lies. Absurdity at its finest.

If an officer asks you where you got your law degree from, you can say, "If I need a law degree to know my rights and basic law, you absolutely need one in order to enforce those same laws. Fortunately for you, ignorance of the law IS an excuse you can use."

Cop finds out his staff is in the wrong - still has to copsplain legal behavior as illegal to the kid. Also, love the "there are women in there comment." It doesn't matter officer. He didn't do anything illegal. The kid is 100% correct. They didn't have a lawful order to do ALL OF THIS. I hope he sues.

Continuing to detain him until he gets a copsplaining lecture is 100% UNLAWFUL!!! There would have been NO PROBLEM or drama if LAW enforcement would OBEY THE LAW!! LAWSUIT!!! I have 3 sons. From an early age, they were taught to respect their elders and law enforcement. The thing that worries me is a lot of cops don't respect the rights of citizens they have sworn to serve and protect. Why wouldn't a cop praise someone for knowing their rights and laws of the local community? Instead, it's frowned upon by most cops. That is why you heard the officer say, "Where'd you get your law degree?" You don't need to have a law degree to challenge someone who's trying to violate your constitutional rights. I've never been told by cops that ignorance of the law is no excuse. I don't know anyone who has been told that by cops. I think I might have seen it in the movies before but I cannot remember a specific instance.

The thing that gets me is how arrogantly the sergeant acted towards the 16-year-old in their interaction and insisting that he was properly detained, and then when they get him in the car, he is very clear that he knows that nothing was done wrong and the arrest was improper. Why allow it to continue so long if you know it's not a legal arrest??

That Sgt is gaslighting him hard to get out of their mistake. Gaslighting is one of the worst things abusers do to people. And then demanding he talk to the police when he has a 5th amendment right to remain silent is just unprofessional.

I like how they have to cuff him, put him in the car, and THEN discuss how what he was doing was not illegal. Also am amused how every time they say "I'm not going to argue with you," it's because they HAVE BEEN arguing with them up to that point and clearly are suddenly realizing they can't justify what they're doing. It is hilarious that from their perspective you are not expected to know your rights, and if you exhibit any signs that you DO know your rights, rather than PRAISING you for being educated - as all citizens ought to be - you are instead excoriated for being pretentious, NOT KNOWING YOUR PLACE (which is far below their thumbs), and knowing more than they believe is good for you. Then, even when they let you go because they are wrong, they have to extend their detention of you so that they can gaslight you, lecture you extensively about how sky is blue and EVER questioning authority is BAD, and try to make you believe that it wasn't really the cops who were wrong, but YOU who were wrong somehow, even though you weren't and they have to let you go BECAUSE you weren't.

I'm sure they're out there, maybe, but I have yet to see a cop with a law degree. Then they want to ask citizens where did they get their law degree. Do they think 6 months of officer safety school gives them a law degree. Do they think that a citizen cant read and learn their rights on their own? This is cop logic at it finest

There isn't a single cop in the US who has gone through EIGHT years of university to turn around and become or remain a law enforcement officer. The diligence it takes to get a law degree, the money it requires to get that education, and the disparity in pay between an attorney and a cop is substantial enough to prevent someone with a degree like that from wearing a badge as their day job.

So, did anyone notice how the Sgt. treated the female officer the same way the young man treated him, asking legitimate questions but not getting a straight answer? It's amazing the Sgt. didn't shut it down right off the bat especially due to his questioning of the officer. Unbelievable!
