Your video was helpful, as Im sitting on Pins and Needles for the Position Statement from my Employers. Now I understand that the simple act of filing Charge is the beginning of a Legal Battle which may culminate in Court. For something as common as firing someone, it sure is a lot of Headache and Acid Reflux for Senior Management, once the EEOC is involved. Being the CP, I appreciate the EEOC and what it stands for!!!

How is a claimant told they have a right to sue, when it has been found (by EEOC) that there was no discrimination?

You should receive communication from the agency once they have concluded their investigation or you can contact them directly for an update.

A right to sue is a not a garentee of verdict. Nor is it a garentee that you'll even find an attorney to take your case. As far as I can tell, an individual cannot be denied the right to utilize the justice system. If a case is frivolous or unfounded, it's on the justice system to throw it out. At that point, the claiment at least had the opportunity to present their case. But I'm not a lawyer so know, this is simply my perception of the matter.

The EEOC will not help you at all. I know from experience. I’m being retaliated at this moment and I couldn’t find a lawyer to help me in the 90 days you get to sue.

Then maybe file a new complaint for the new retailation open a new case. As far as not finding a lawyer file a suit as pro se " as yourself. Good to the Court and research similar cases use the language as a sample to draft your own complaint. In most cases you can get. Filing fees waived if you are low income. Once filed. You have 90days to serve your complaint to your employer and seek free legal aid services.
