1. In most street chess or unofficial casual public games , you can take the king if they don't notice check. (Read the intro) 2. Had he tried the q/r fork, Qd4 would be played forking the king/knight. Kinda like a reverse fork.

Pretty normal practice in games under 5 minutes. As long as this is established ahead of time; Coffee Chess matches are always played with this practice so it is understood and, accordingly, Dave gives no argument.
