@rogerborg8 ай бұрын
What makes it "aggravated"?
@jeremy56028 ай бұрын
@@Sniperboy5551That is not true. The law does not always distinguish between direct threats and conditional threats, nor does it always dismiss a conditional threat as not being a “true” threat. In this case, the prosecutor would have a good argument that she fully intended on punching the cop if he broke her arm or if she perceived he was hurting her arm too much. The best way to avoid this legal question, and to avoid charges of threatening a police officer, is to not make any kind of threats in the first place. Side note, “true threat” is a poor term for it, as conditional threats can very easily be carried out. Any threat made which makes a person believe it may be carried out is a “true threat”, regardless of whether or not it was made using an if statement.
@jeremy56028 ай бұрын
It would actually become battery in most jurisdictions. Nowadays, assault is a term used for threatening violence or attempting violence, while battery is a term used when physical contact actually occurs.
@Unfortunate.Soul.8 ай бұрын
That's not true at all. I myself, have an assault on an LEO charge from when I was younger. All I did was threaten to headbutt an officer. 🤷♂️ ~~ And in jail before I bonded out I met someone with the exact same charge, except that he literally kicked an officer in the nuts. We both had the exact same charge. ~~ Aggravated Assault would be like, spitting in the officer's face, putting body fluid on an officer, or repeatedly punching or kicking an officer.

It always makes me laugh when after being told they're under arrest, people say, "No I'm not." Like they are Jedi mind-tricking the officer. "Oh, sorry maam, you're not under arrest." These are not the droids you're looking for. 🤣
@veger20018 ай бұрын
According to federal law if a Police officer orders you out of the car you DO have to obey that order even if your a passenger. However IF your a passenger you not have to ID unless your suspected of a crime!. In this case officers had a right to search due to the arrest and since they found an illegal substance they could claim reasonable suspicion to ask Id from all occupants.
@thomascrutchfield45725 ай бұрын
If an officer asks you for ID whether you're a passenger or not or accused of anything you must give them ID and that's the problem with the juice box generation they're so coddled and so wimpy they think they can say I don't have to do that or I don't feel uncomfortable please check the law know exactly what it is you must obey the police officers when they pull you over whether you want to or not that includes drivers and all passengers
