One of the achievements of the movie is how despite Monty's awful life choices, we are still rooting for him the whole time. Spike Lee makes the audience hate the DEA/cops and pretty much any authority figures in 25th Hour more than the criminals.

Yes, it's like even when Frank says: "What, are you driving a vintage super B? No, he is. Paid for by the misery of other people." Even though we know Monty is a drug dealer, and in many ways is one of the worst kinds of dealer, in that he doesn't use the stuff, but gets rich from it, his character comes across as a tragically decent guy at heart, out of his depth amongst real criminals. Frank is a bit of a prick, he's the typical Wall St asshole, ladies man who has upstanding morals apparently. Jake might do honourable work as a teacher, but fancies his underage student. As you say, the DEA agents are depicted as hard, unforgiving types. It's a brilliantly executed film in my opinion.

Monty would've been fine. 7 years actually means 3 and a half (half date with good behavior). He was a good looking guy but not a "pretty boy" plus he never snitched and even got beat up when he went to prison. This would at least keep people from messing with him. Monty was smart enough to not let the pigs rattle him. Even if he did rat out his supplier he would've still gotten around the same sentence (maybe less but then he'd have a target on his back as well as his dad). Actually Monty shouldn't have talked to the cops at all not even one word.

Why are federal agents talking about charging him with a state crime and then saying "tell the US Attorney we got a hard ass here"....feds can't enforce state law, besides federal law is much more tough, some people say federal sentences are absolute because there is no parole and early release is not as common.

FBI won't investigate in the first place if they expect it to get kicked down to the state level though, they want everything to stay in the federal system if possible. Family friend was an Asst. US Attorney for over 15 years, he led an drug / organized crime taskforce that consisted of Fed/State/Local LE officers, he actually RICO'd a large gang. Generally the State/Local officers will be deputized as Special Deputy US Marshals so they can enforce federal law (or Special Federal Officers if the FBI is doing it but Marshal Service has most coverage to enforce fed law). However the reverse is not true, Feds will almost never be deputized as a Special Deputy Sheriff for a county or SBI Special Agent because that would kind of look like a violation of states rights. Its pretty versatile, AUSA's and Fed Judges do NOT like light charges like obstruction so if the feds need to serve a warrant on someone they'll bring a State Trooper or Sheriff so if So-and-So's girlfriend hits an officer or blocks the doorway they can charge her on the state level without tying up federal resources. Or in the case of the DEA regularly they will grab a State Trooper or Sheriff's Deputy when going to bust a dealer, if the dealers friend knows something and has a quarter ounce in his pocket the state charge is easy so they hang that over his head. Also Fed's do not have Jail's (they have prisons but no jails) so they have to use the County Sheriff's Jail (most every county jail in the US has X amount of empty cells no matter what designated for federally charged persons only). We had a big organized crime problem around my area and the State Prosecutors were more or less completely inept at handling it even when Local police were giving them everything on a silver platter, in fact many times the US Attorney would defer a case to state prosecution and they couldn't get results so in my area the US Attorney handled most of the serious organized crime stuff, unfortunately organized crime is making a come back and the new officials don't seam to be as up to the task. There is so much politics just within one county when it comes to law enforcement its not even funny, some City Police Chief's daughter will get pulled over by a County Sheriff and he'll hate on the Sheriff's office's because they won't cover it up and be a pain whenever Sheriff's come in the city, or some DA's son will get caught dealing drugs by a Town Y PD and from then on Town Y PD has to cross their T's and dot their I's extra carefully or the DA will arm twist and say the arrest was 2 feet out of Town Y, go call Town X's chief, or one of the DA's prosecutors will bend the truth in court or on admitting evidence and piss off the Chief Judge and from then on the Judge will screw the DA's office by requiring more than one prosecutor to sign off on a warrant along with an officer...I mean never mind the fact that in many areas policing is riddled with misconduct, the prosecutors officer is full of blatant prosecutorial misconduct and incompetence, and the Judges are so overly partisan or soft on crime that they'll give a serial rapist probation or some crap like that, the system works in theory but human error is and fault just screws it all up. Its all a mess.

Feds can get involved in state court cases and then let the District attorney try the case. That is often the case when state law is far more harsh than Federal law as it was in this case. And while Federal law is normally much more harsh this certainly was the case in New York in the early 2000s. For example when this movie was made in 2002 in order to trigger a 15 year sentence for heroin it required at least ten kilos for the Federal sentencing guidelines to be that harsh. Granted when you factor in enhancements like leadership position or if you can have way less and still trigger those guidelines. Still though it would normally require a lot of heroin. Under the New York laws in 2002 it only required a person trafficking 2 ounces (around 56 grams) or possessing 4 ounces (around 112 grams) of certain hard drugs to trigger a mandatory minimum of 15 to life.

I love this scene and this movie and have since I saw it in the theater when it came out. People forget that this was the FIRST real post-9/11 NYC film ever produced at the time it came out. Was the first movie to really acknowledge those events and to be set in the aftermath in any meaningful way. But I gotta admit that the way Benioff butchered and shit all over Game of Thrones makes me less able to appreciate this film in retrospect.
