3 People Who Were Wrongly Convicted Because of DNA Evidence

DNA is often considered the “magic bullet” when it comes to forensic evidence. If someone’s DNA is at the scene of a crime, it’s hard to argue that they didn’t commit the crime. However, in a few rare cases, bad DNA evidence has been used to wrongly convicted people.

I feel really bad for Mr. Chen he had to sell his business and divorce his wife and spent 5 years of his life in hiding. I'm glad he was exonerated but he won't get that time back again.

Jpay What really bothers me is that after these guys get out of prison, they wanna give them money just to compensate for the time that they took from them. Money isn’t gonna make up for time that somebody lost, especially someone really young. Time is something that you don’t get back. Instead of money, an apology for wrongful conviction should be issued.

We hope that few people are unjustly imprisoned, but I can honestly say that here in the US, we know that at least 200 men have been executed for a crime they were later exonerated for... That is extremely scary to me.

Emerald kat Please get your facts straight. There have been *1474* executions since 1976 (I haven't researched how many in totality, only from when the death penalty was reinstated in 1973) There have been *161* people exonerated from death row (which means that they were released from prison before they were executed. Unlike what you stated, which was they were executed then exonerated. _They can't fucking kill them then set them free smh_ ) There have been *12* posthumous pardons (meaning they were executed, then later declared innocent, _all of which occurred before _*_1945_* ) There are *16* executions (since 1976) in which some evidence has been brought up to suggest that someone could possibly be innocent (only 5 of which have questionable physical evidence , the other 11 are mostly just people changing their testimony. _IMO only the 5 should really be considered for true innocence_ )
@emeraldkat2167
@emeraldkat2167 6 жыл бұрын
You aren't talking about the same thing. A posthumous pardon is given to those who there is enough evidence to say that they may not have committed the crime they were sentenced for. What I'm looking at are the hundreds of executions that have gone on in the US before the death penalty was stopped (not anything after the reinstatement in the 1970s). These are cases where historical evidence exonerated the person sometimes to the tune of centuries after their death (btw, exoneration doesn't mean setting someone free, it means their innocence was proved or absolving someone of blame). Many of these are cases of black men (and about 10 or so women) who were pinpointed by police or locals as committing a crime, and then executed. They didn't sit in prison for years. Most of these are not officially exonerated in any way, but there is enough evidence to show that the police or some other party faked evidence or testimonies (or both) to get someone executed. Some of the cases have been counted as officially unsolved again due to overwhelming evidence and others are too old for even that. The sad fact is that while the numbers you state for contemporary cases are correct, even those can be considered skewed if you take poor forensic work (I won't call it science, since much of it isn't) taken as hard evidence, when it was later shown to be not as reliable. There's no way to count those reliably either. I would say give it another 50 years and we'll probably see more and more of these cases coming up to show how fallible much forensic work is/was (especially anything before 2000 or so). Even dna, which has been portrayed as the ultimate indicator of guilt/innocence is not perfect. There have been cases where we've convicted someone with partial dna matches (of which juries were told it was impossible for it to be anyone else) and it turned out to have been poor work putting together the partial match to begin with (leaving the odds of a match to be something closer to 1 in 20). The point is, there are a lot of modern cases out there where we just don't know if someone was truly innocent or not, and no one will look at retrying the case or appealing it again.
@KayKayon
@KayKayon 6 жыл бұрын
These cases highlight why every murder case/rape or sexual assault case needs both good DNA analysis and good circumstantial evidence. When you study Forensic DNA analysis, the first thing most lecturers say, or should say, is that DNA evidence should complement the circumstantial evidence not the other way round.

Common sense is increasingly uncommon. A lot of people, as the description says, think DNA is a magic bullet and will often disregard contrary circumstantial information.

The justice system is full of incompetent people and corrupt to the bone. In the future, when creating completely identical synthetic DNA will be a possibility, it will get even worse because planting duplicate DNA to get somebody into prison will be the norm. The justice system will never admit any error (it doesn't do that today, so why should it in the future?) even if loads of people will be punished to death wrongfully.
@KayKayon
@KayKayon 6 жыл бұрын
It's a possibility but, Forensic DNA analysis can already tell the difference between synthetic DNA and natural DNA. It is surprisingly easy to tell if DNA synthesised.

That has to be a really bad feeling when they use DNA "evidence" to convict you when you know you are innocent. I mean when you hear about DNA evidence on the news or TV, its always talked about as being irrefutable. Things like eye witness testimony can be proven false all the time leaving a person that is wrongly convicted with a little hope of being proven innocent.

Number of people crying over "innocence" of the guy in the last case is too damn high! His match for the DNA wasn't ruled out, it was just stated that there's also other possible matches existing. There's not enough DNA left to do conclusive comparison. He's still right age, right area, previous similar crimes and even the method (dressing as an officer so the victim lets him in, hence no signs of forced entry) AND his DNA matches the remains of the crime scene DNA (of the markers that could be examined). They are not enough to convict him, but more than enough to land serious suspicion. He still should be a strong suspect in the case, among other matches that fit the profile.
@girloninternet1188
@girloninternet1188 4 жыл бұрын
It's more than enough to convict him. Combine all of those facts - do you honestly see reasonable doubt? To believe that he's innocent means that you have to believe that there's another person in the world who... 1. Matches the DNA profile. (Which, if factoring in the year of 1972, narrows it down to only 19 people in California and 191 people in the US) 2. Was actually in San Francisco at that time in 1972. (San Francisco's population is, even today, still less than 1,100,000, which further narrows that 19 people down to _a single person_) 3. Would commit a rape and murder in the exact same fashion that Puckett was known to attack his victims. There is no reasonable doubt here. All of the evidence suggests that Puckett is literally the only person in the world who actually could have committed this crime.

Yeah, since it seems that he actually was a serial rapist I'm far from sympathetic. It's a huge injustice that this woman's murderer was never caught, but I sure as hell don't feel bad that he got sent back to prison. I don't care how long ago it was, if someone is a sexual predator they pretty much forfeit their rights as a human being and deserve nothing but misery for the rest of their pathetic lives.

So, Puckett may have been the murderer. Without finding who else it could have been and Puckett dying before the trial was over, he really doesn’t fit the title of this video and on surface looks hella guilty. He “just happened” to line up with a lot of criteria that lead to him being a probable murderer. Too many I think.

This is what I was thinking too because the DNA could have been his, he could be including or excluded because of the quality of the sample. However, his MO of his prior rapes matched what happened to that poor nurse, I think the CSI effect has a lot to do with some of this. Because not every case is going to have usable DNA evidence. Still a great vid though.

Y'all are some fucking haters tonight. Be grateful! Criminally Listed is a goddamned KZbin singularity and he has graced us with his presence tonight. This dude is an amazing researcher, reporter, and narrator. I dare any of you out here to even find a single article that says it was even an Explorer or an Escalade. You don't know! Don't act like you need to correct him for slipping up about details you don't even know about!! Until I see otherwise, it was a Ford Escalade :)

Abdul-Med Bangura Jr. he wasn't innocent of being a serial rapist. Even if he never murdered anyone, he got precisely what he deserved. The only injustice there is that the woman's real killer was never caught.
@AbdulMedBanguraJr

Sara Joachim I'm not defending his past. You don't put the blame on someone because they DID things BEFOREHAND. You blame someone when they did what you persecute them for. He answered for his crimes and he served his sentence. He payed his debt to society by the criminal justice system. Condemning him afterwards when we don't know if he he killed this women is unfruitful. HOWEVER, "IF" he did, then id be inclined to agree with you, but you have as much proof of this man being guilty as anyone.

Viciously raping someone is as good as killing them. That person is NEVER the same And I doubt his sentence was any where near long enough anyway. Serial rapists should get a life sentence. No sympathy here.

so what did we learn, kids? always bring a lot of random dna to your crime scenes. u don't even have to worry about your own dna being there, because forensics cannot determine what is what. makes crime much more efficient, because then you don't have to spend time cleaning up.

@chrisx2k6 I was thinking the same thing. You could maybe argue reasonable doubt given the misleading way the DNA evidence was described during the original trial but he is still by far the most likely suspect. The DNA did not prove him innocent.

Puckett: • Was the right age • Had prior rape convictions • Lived in the right area • One of only 32 people on the state who could have provided the DNA sample Sorry, that is still a pretty compelling case. I’m not sure you should consider him “wrongly convicted“. More like, “not a slam dunk for the prosecution”.
