The Blurred Lines case wasn't a bench trial, so it was decided by a jury. But yes, jurors who aren't musicians, don't know music theory and probably cannot even read sheet music are not exactly competent to hear a case that depends upon highly technical expert testimony from professional musicologists. This results in dubious and unpredictable verdicts. Moreover, the possibility of getting a multi-million dollar award for damages over vague similarities only encourages other owners of older music copyrights to use the justice system as a casino in the hopes that their calculated gamble to put the squeeze on successful artists will strike the jackpot.

What if someone states in a video and/or in the description that using any portion of their video(s) is 'prohibited' without their permission? Can this be done? I'm planning/hoping to register/launch an LLC/ORG with a membership website (which will probably be linked to my ORG). Could I restrict members to only show any given page of the membership website in videos for the purpose of promoting it to others that may potentially become members? @@25Andre25 Dodging COPPA is likely the biggest reason. If there's a massive amount of administrative overhead and legal nonsense you need to know just to make a KZbin video, I imagine most of the creators switching over are just saying "fuck it" and taking the simplest route possible. KZbin and the FCC are stifling creative expression unnecessarily and, creators, just like water, are taking the path of least resistance. KZbin has/had the opportunity to stand up for their creators and get between them and the FCC with COPPA but they did nothing. That "no loyalty" stance they've taken is probably hurting any faith a lot of the creators had left in this platform.

@@bobby45825 Good point. But if enough creators move to Twitch to avoid COPPA, eventually the FTC will take notice and do to them what has already been done to KZbin. COPPA is a federal law that applies to all websites, but the FTC's first target among video sharing services was KZbin simply because it was the biggest target. It's very unlikely they will stop there, which will lead to a game of whack a mole and creators repeatedly jumping from one platform to another. I realize that KZbin could have done a lot of things better in implementing its COPPA obligations, but the FTC was quite heavy handed too in making demands of KZbin and its creators.

I see the point of fair use, as someone who's done KZbin, and Twitch before for political shows, mainly doing political critiques to conservatism ideology, and to conservatives you run into the idea of what is considered very used by what the court sees as "proper editing of video clips" it's the video edited is similar to what they use on mainstream media outlets "meaning there is no deceptive editing" then no legal action can be taken against the person who owns the KZbin channel, Twitch channel, or podcast. Deceptive editing is a term used in court or in legal since to define when content has been edited to deceive people away from what the original content was intended for, it's terminology that can be brought up not only in DMCA cases, but much more severe cases like perjury.

I don't put all the video as it is original, but I use some stock footage that is free. But I am using the audio that is there in original, with some other copyright-free music.
