I booked a plot worth Rs 80 lakhs in Jul 2022. I have paid Rs 60 lakhs till now in 8 installments (including 2 installments of 7 lakh each from Bank loan). I did not deduct any TDS till now, as the property was booked with my wife as co-owner (hence individual share 40 lakh). However, with new clarification now it seems I'll hv to deduct TDS (80000). How to submit form 26QB in this case without late fees? Can I show the transaction date of , say 1 August 24, and deposit the full 80k showing a lumpsum payment to the Seller? I had not deducted TDS till now due to this confusion in rule 194 I-A in case of multiple buyers. Please help.

Sir please ek cheej btaye.. maine property purchase ki thi.. so mere 26AS and AIS mai wo do details dikhara hai.. ek to wo amount jitne ki maine property purchase ki, and jo 1% TDS maine seller ka deduct kiya.. Meri annual income 50 lakh se kamm hai and maine home loan lekar property kharrrdi hai.. So jo ye property purchase ki amount and 1%TDS jo maine deduct kiya tha isko mujhe kahi prr bhi ITR file krte waqt mention to nhi krna hoga na?? Please Reply.

Sir, I did agreement to sell on 20th July and the buyer deposited the TDS on 22nd July.... Registry is on 26th July can I claim indexation benefit on this transaction... I hold the property for 18 years, so far buyers paid 20% of the total sales value and rest he promise to pay tomorrow. Please advise.

You are rong date of registry is date of transaction and all TDS liability will be based on date of registration and not date of payment,there are enough court ruling on the subject.

Toh seller property ko alag alag register karale 90 lakh ki property ko do bhai apne apne register karale ab assessee wise hoga tds application alag alag sale deed karlo ab padosi ki property ka value bhi thodi le lenge.

Wrong information. As per section 194-IA, it is applicable on the total value of the immovable property and, not on the respective share of buyer and seller.

ये चोर दरवाजे सभी बंद होने ही चाहिए तथा सभी टैक्स प्रणाली इतनी सरल होनी चाहिए कि जरा जरा सी बात के लिए या हथकंडे अपनाने के लिए वकील या सी ए के पास न जाना पड़े। टैक्स चोरी के हथकंडे रुकना व नियमों का सरलीकरण व पारदर्शिता देश व समाज हित में होती है।
