The claim is that Scott was speeding, was involved in a traffic accident, fled from the scene, and only then reported his car stolen while changing his clothing before meeting up with officers. This all within the scope of about 10 minutes. The officer that saw the individual fleeing from the accident recognized Scott as being that individual. While being detained Scott admitted to ownership of a firearm and lack of license to carry. The officers arrested Scott for reckless driving, leaving the scene of an accident, false reporting of a crime, failure to carry a concealed weapon license, and possession of marijuana.

@Metqa
@Metqa 4 ай бұрын
@@tomricketts7821 I agree! Specifically fromthe officers involved in the arrest. I got an idea: They should have some sort of insurance for this , like medical malpractice insurance! ( I'm sure someone could make some money from this, cops pay into a fund, the only purpose of which is to out if they are found liable and cause damages. If they don't cause any trouble at all their entire career, then perhaps they get a rebate when they retire) When a cop is held liable for actions they chose to take, then it would be decided what percent of the outcome was caused by their actions and that percent of the payout is tagged to their account. The insurance pays out for them, IF, they are not convicted of being personally responsible, like a uh, something they could be personally sued for. IF the precinct throws them under the bus, as far as liability, then the insurance won't pay. This could help replace qualified immunity as it works currently for police officers. Where they are shown to have done wrong but not enough to lose their entire job for it. And when they become uninsurable from too many payouts, then they would be no longer able to hold a license to be a police officer ANYWHERE! This does't seem like an undoable idea. What would be the downside to it? We might have to pay them a higher salary to cover insurance? Okay, then the ones who are GOOD Cops actually get a PayRaise. Kudos. The ones who are BAD COPS pay higher premiums, Too bad , so sad, just like the rest of us do. Any other downsides /upsides? Id like to know what others think about how this might work.

Even if qualified immunity was abolished, cops unfortunately still wouldn't pay out of their own pockets. Law enforcement officers are virtually always indemnified - a practice that shields officials from financial liability - regardless of qualified immunity, and rarely pay damages even when found guilty of unconstitutional conduct. Police officers do not pay for the lawyers defending them, either. The city an officer is affiliated with typically pays for police misconduct settlements, using taxpayer money.

@@Theydas BACKGROUND This is a civil rights action arising from Scott’s arrest on June 1, 2018. On that date, while he was visiting a relative in the City of Miami, Scott’s car, a black Jeep Compass, was stolen. At 6:00 PM, Scott reported this to the police. Five minutes after Scott reported his car stolen, Officer Jonathan Guzman observed a black Jeep Compass two miles from Scott’s location, going twenty miles per hour over the speed limit. As Officer Guzman began pursuing the Jeep, it collided with another vehicle. The driver of the Jeep jumped out of the car and fled. Officer Guzman did not see the driver’s face, but observed that he was a heavyset black male over six feet, and was wearing a white tank top. While Officer Guzman was observing the hit-and-run accident, Officer Michael Bloom met Scott where he had reported the car stolen. After asking some questions about the car, Officer Bloom asked Scott to complete a stolen vehicle affidavit, which Scott did. After Scott completed the affidavit, Officer Guzman arrived, accompanied by Officers Brandon Williams, Miguel Hernandez, and Randy Carriel. Upon confirming that Scott had completed the affidavit, the officers had Scott place his hands on Officer Bloom’s patrol car. Officer Carriel had his taser drawn and ready to use on Scott. Officers Williams and Hernandez began to search Scott, removing personal items such as his wallet. During this search, Officer Guzman noticed that Scott was wearing a white undergarment beneath his black t-shirt. Scott was arrested, handcuffed, and placed in Officer Guzman’s vehicle. Throughout this interaction with the officers, Scott proclaimed his innocence, explaining that he had called the police for assistance and that he was with Officer Bloom during Officer Guzman’s car chase. Despite Scott’s protest, the officers took Scott to county jail, where he was booked and strip-searched. Scott was released on $5,000 bond the following night. Scott was charged with reckless driving, leaving the scene of an accident, false reporting of a crime, carrying a concealed weapon without a license, and possession of marijuana. Scott is a black male standing five feet, ten inches, and was wearing a black t-shirt on the day his car was stolen. Scott alleges that he was not in possession of a weapon or drugs when he was arrested. Scott also alleges that he was not the driver of the Jeep Compass involved in the hit-and-run accident. Scott retained private counsel to defend against the charges, which the State of Florida ultimately dropped.

...and if they do find the car thief, their lawyer asks the cops if they had other suspects? Which sheds doubt on the case. No reason to run around accusing everyone until they find the car and someone in possession of it!

Please do not give out your social!!!! They DO NOT EVER need your social. Whether or not you were arrested lawfully or not all they need is your name, and DOB.

@@dgggbggg5025 Yes, it is, and some states even require address as well. I can't think of a single state that only requires name, so I have no idea where you're even getting that from. If you can back that up I'd love to hear it, but either way you can't just make blanket statements like that when we have 50 different sets of laws, you could end up being the reason someone is unjustly arrested.

I'm a widow. A few weeks ago, a strange man banged on my front door during the night. My front door is glass. I have a camera but didn't take time to look. I quickly got my gun from my safe by my bed. I put it behind my back but my finger was on the trigger. I went to the door. I did not open the door. He asked to use my phone. I told him I had COVID and tried to look sick. I told him my neighbor also had COVID. I knew her husband was at the firehouse. He seemed confused and mumbled something. Then he walked down the stairs and then picked up something he had left at the bottom of the stairs. I watched him leave. I did not call the cops. A few months ago, I would have hit my panic button. Now I'm educated thanks to this channel. I'll take care of myself.

It’s come to the point where if you’re just a regular citizen and you’re buddies with a cop, just get him to violate your rights, win the lawsuit and split the money with him. They never get in trouble anyway so nobody has anything to lose or fear!

This happens more than more. "You can work it out in court." Officers don't care about the public. Most of them do the job for the power. They think they have. If they were better trained and held accountable for their mistakes. Everyone would see a big difference.
