Brother... What you said at the very end... is exactly what I needed to hear.. The Government rented me... and fucked me up.... and "its nothing personal, and its not taking a handout".... Ive been fighting with what to do for a decade now, the entire time I thought my back pain was unique and come to find out its actually really common what Ive been suffering through... Ive never asked anyone for anything my whole life, and I didnt want to be a burden on my country by "accepting a handout".... But you're right man they rented me and jacked me up good... Im tired of making excuses on their behalf...

Same here, been sucking it up for 30 yrs. We never went to sick call, it was frowned upon. Legs go numb when I lay down or sit down.

@@Gales_of_Gaelic I'm 52 and the only way I sleep is in a complete fetal position. Looks really weird but got to do what I have to do to sleep. Shoulders are hurting just as bad, can't reach over my head. Got kicked in the back, shoulders, and head in Korea.

I’m rated at 0 percent back pain since 2010 and I filed for an increase for back and migraines separately . They combined both claims gave me an ace exam for my migraines but didn’t give me no type of exam for my back yet the claim is in preparing for decision stage .. like what the hell 🤦🏽‍♂️🤦🏽‍♂️

Great video, I am waiting for my first appointment to the C&P for a back injury in the Air Force from 1967. I was asked by a doctor in the past, why I didn't get a MRI back then. I replied to him, MRIs did come out till 1988.

If Noone have told you this lately. YOU ARE AWESOME. I wish I had seen your videos before my exams, or I would have received 100% first time. I am grateful for the 90. But at the time of the exams. I just answered the questions, but I never thought to mention the tingling or pain I was feeling down my legs. Smh...20 years later, fighting for what I didn't know I could have been receiving. Sigh!! I'm going back to see if I could get it adjusted.

Go to medical if on Active Duty or Reserves, and be persistent, no shame! Wish I did, injured back on first tour and struggled for entire remaining 20 plus, still affects me daily during civilian life. Learned one thing, went to medical once, Navy only took X-rays and gave me Motrin called it a back strain. After retiring saw civilian doc who had MRI done to diagnose two blown disk and disk degenerative disease. Doc said X-rays don’t show that! Great video!!!

Always excellent advice! It never occurred to me that there is a legitimate secondary component of my back disability which is the mental aspect. My whole life revolves around my physical limitations and it's incredibly frustrating and at times sad. I never thought that my bad back, (L4-L5-S1 fusion) would impact me in the routine tasks like showering, taking out the trash, yardwork or laundry. Some days I can't do anything at all. I'm definitely going to get this addressed at my next VA doctor's appointment. Thank you!

Thank you. My husband hurt his back in boot camp. His words “it locked up.” I think he went to military doctor once or twice. I have listened to him complain about his back since that event for over 25 years. He’s to the point now he needs surgery. He would never seek help because he said I don’t understand “they” don’t want you to go see doctor. “They” give you Tylenol and tell you to go on. I’m trying to figure out the best way to explain how bad his back has become since that initial issue in boot camp. Any and all info really helps for most accurate explanation.

Jordan I have been out 40 years - and just now now got service connected at 10% - the military cannot seem to find my medical records - and I have been trying to a couple of things service connected - no luck so far - however i have been trying to educate myself by watching your videos

Congrats on getting that first win David, you have momentum now. Your med records could have been lost in a fire considering you mentioned being out 40 years, I would pivot to relying on nexus letters and well written personal statements to max out your influence over the process. Great work!

Great info thank you Jordan🙏. Desert Storm veteran. First time filing claims was 2019, got connected for some but denied my back. Injured en route to Saudi in a C5 , rolled my right ankle, sprain. Ambulance had to get me from the aircraft. I fell with my 50 lb backpack and it landed on top of me. I was given crutches and continued with duty. Aeromedical Evacuation Technician. Lifting up to 200 lb patients on liters, filling and carrying 50 lb sandbags to build our bunkers. Airear started within days of injury so crutches were ditched. I continued working through pain. My whole body hurt but only ankle was examined. Working and building transit hospital on concrete for 12-15 hours a day, sleeping on hard cots and hanger floors. Denied back pain in 2019, had an MRI done by private doctor and now being sent to a neurosurgeon ( waiting to see what’s happening and causing my pain) I’ve have bad back all the years since but getting worse. Determined to get connected because even with age It’s beyond normal that I should have this pain Sorry long winded. So helpful listening to you! Any input, suggestions is greatly appreciated I have migraines service conned Denied vertigo

Hi Penny, ouch that sounds like a rough fall. If you can get your doctor to sign a nexus letter and include the sentence “the patient’s back injury exceeds the rate of normal progression for their age” then that would be a big leg up 👍

@@pennydittl38501.write a personal statement of all of that 2. Have a service buddy write something similar who witnessed; or who knew you’ve had the issues since military. 3. Get a current diagnosis 4. Get a nexus statement, and the words as Jordan mentioned, “injury not typical to age - it is as least as likely as not due to military service.”

I opened 2 Claims with the VA, they went and combined my claims. I argued that each claim are regulated by its own Code of Federal Regulations and all have separate DBQ's. By combining these, they are preventing Injuries from being properly evaluated. The trick VA is using is not to deny the claim but to simply closed the Claim and attach/combine evaluated symptoms into a Single Claim although they are evaluated differently.

So happy to have found this page this morning. I'm at 30% for knee replacement. During my 20 years of service in the Air Force as an Administration guy, I didn't jump out of planes or carry 50 pound packs. But most of those years was spent loading and unloading trailers of official mail for the base. We sorted the mail, then delivered it around the base, often times carrying a 70 pound bag on each shoulder up a couple flights of stairs. The pain slowly crept up on me until the sciatic nerve problem hit full force ten years after retiring. Because I never had a specific injury to my back it never occured to file a claim for that. Started working on that now. God bless you and everyone who work to help better the lives of Veterans!

Two years ago in my C&P exam for my back, the lady examiner only had me bend forward and backward… she said to let her know when I felt pain… i did… then she said “PUSH THROUGH IT ANS GO AS FAR AS I CAN” There was my mistake… I was able, with lots of pain, to hit maybe 80 degrees… I was marked as Service Connected but full range of motion and given 0%… I’m still fighting it.

The decision letter said their doctors medical evidence was more persuasive and there was more rationale and medical literature to support the Va doctors decision to deny Vs my doctors. I figured they’d grant it cuz if my doctor says yes and there’s says no it’s still 50-50 for their threshold to grant but I’m going to get another nexus and reload they can’t keep refuting multiple medical doctors opinions.

@@carlosmark9840 thanks man. I’m gonna keep hammering nexuses hopefully I only need one more to get through. They did the same shit with another claim I did and it got approved after I got a nexus from another doctor. I feel like they can’t refute numerous doctors making the same positive nexus when all they say they need is 50-50 at least as likely as not.

@@ACigarReviews higher level review will help you win the claim. They have to use your independent medical exam and nexus as long as it is proficent.. look at sub par an and b on the 38 cfr. Something of that nature .. facts

I am 60 , I finally filed a claim for my back . Military records show I had a back injury. The claim was denied twice. Basically said it was too late. What a slap in the face.

The VA treats us older veterans pretty shoddy. I am 71, I was in the artillery, and they tell me that my hearing is not "service connected".

The VA now contracts with Loyal Source to set up C&P exams. The appointment was within 2 miles from me, awesome job. On the way to the exam, Loyal Source called me and said the doctor had to cancel, and they could set another appointment in 2 weeks, but with another doctor over 2 hours away. I said I couldn't do that, my back pain gets bad with that much time in the car. The lady with Loyal Source said she will turn my file back to the VA and I can start over. Loyal Source started out with good service, but quickly went south. Now what?

My increase claim is in the rating phase. My examiner didn't use the measuring tool, but she asked a ton of probing questions throughout the exam for all of my claims. I also brought medical documentation and volunteered information as well. We shall see.🤞

@productivity5465 No problem.She asked me if I had shooting pain down my legs and if I had headaches. She also asked about another condition that she felt like I should have been rated for because I was already rated for something else that's connected to that.

The CFR that covers disabilities specifically that age cannot be used to deny a disability. All a service member needs is anything in their medical records, a report of any radiology findings or PA/physicians report, as proof of injury. Any records after discharge showing recurring incidents of pain or immobility and treatment adds to their case.

Make sure you can find any and every treatment you have received. I was put in a T.A.D. status at The Naval Hospital for 6 weeks due to a knee injury. I have ordered all my medical records twice and can't find any notes or records on that treatment. I need a knee replacement on that knee due to those injuries and V.A. refused service connection.

Ive been rated 60% bilateral for back and legs and 10% for right foot since 2013. My knee buckled and I fell off a ladder on concrete in 2021 and broke my back four times, strained my neck and had huge hematoma on my skull, Im lucky Im still here. I have a C&P exam on Wednesday. My back up to my shoulders, legs and neck are a total mess! 70% Anxiety disorder also. I hope the examiner does me right, I see he is one 0-1 year C&P qualified. Im 52 years and the VA gives me Prednisone when I cant move or sit!! Everything's in my VA files including X-rays. They always say "mild to moderate" on the x-rays.... yeah OK! It doesn't feel like that to me!

I was told not to stop when I feel pain. Also, the examiner wanted me to bend forward and put my head against the wall but it was farther than I could lean forward.

None of my doctors will take the time to put together a Nexus letter. When I discharged from the Air Force, the medical examiner said they will let me out within a couple of days if I sign this medical release rather than waiting for medicals records from overseas. I took it as, I can never ask for VA help. 50+ years ago. I have my first C&P exam for my back in one week.

Please make a cervical spine video in this format. I am scheduling my C & P exam now. I have claims for lumbar and cervical pain due to a car accident in service and documented in my service treatment record. I have a current diagnosis for each with x-rays and MRI’s showing nerve pinching.

If you have had any numbness/tingling or pain in your ARMS or hands, make sure you let them know. For neck you can get radiculopathy for your upper extremities

Fishing has been on my mind all day and seeing your username doesn’t help 😂 If you’ve had procedures done, they will still be measuring your range of motion to determine your rating. My best advice is to simply stop at pain, or where pain would normally be during say, at the end of a work shift

So true, examiner wrote 70° instead of 20° on my RoM. Just means more work for me and another exam. Measure twice cut once. VA should dock the examiners if they screw up making more work and another exam. I find it gross waste of public funds to continously screw up creating more work and more spend.

I broke two of my vertebrae T12 and L1 and had to have urgent spinal fusion surgery, this was a year ago (in OSUT) I’ve had aching and stinging pain ever since and am waiting for med board to be approved just now, I’m hoping this video will help once I get discharged and I hope I can get a good percentage with the VA.

The problem is that the types of back injuries you get in the military deteriorate and get worse over years. So what started as a nuisance you could push through when you were younger wind up being paralyzing by the time you are thirty. Plus you might be able to bend over and touch your toes once during an exam. The problem is that it's like a ticking time bomb that you never know when it will go off. Activity that you do easily one day the next day you twist or turn the wrong way and you are down screaming in pain and can't move without assistance and then you're stuck that way for days or weeks. And this becomes more and more frequent over time with the intensity of the pain getting worse and worse until it becomes completely debilitating. But they say "touch your toes" and you do a half ass toe touch when your back is not out and they just deny you from that one interaction. My advice is go to sick call and get everything documented no matter how minor it may seem when you're young and in shape and no matter how much they bust your balls for going. Later in life you will need those records and the "good soldiers" who did as we are trained and "sucked it up and drove on" are the ones who mostly get screwed because we never went to sick call for anything so they say "there's no record of that condition".

Hey Jordan, first of all, thank you for all of the informative videos on different aspects of the VA claims process and how the VA works. I do have 1 question, I was discharged just a year ago and I already filed my VA claim about 2 months ago, am I at risk of not getting service connection for the different claims I filed for. I will say, all of my C&P exams, each doctor did agree with all of my claims. I’m currently on step 5 in the claims process. Thank you!

Great video but I wish I knew about it long time ago. I was rated a while back for only 20% for Lumbar. But good news I have C&P exam next week on Monday morning for increase. I’m surprised I did a Supplemental Claim been almost 2 weeks and all the sudden I get C&P exam quick. I must did some em right by watching video from you and others give me the path to success. I’ve been trying to get compensation for my back. I’m not quite bed ridden but it’s getting there. And sadly they won’t even give me anything for pain. But they will give me crap and experiment on me with other drugs. Go figure. And yea combat engineer. Don’t jump but did carry my share of heavy guns. M-60 along with my regular gear. And this was on nearly every drill we did.

Jordan, thank you for the video! I am currently rated at 10% for lover back. I've been out of service for two years and would like to file for increase. If file for increase for the back pain - can I get rated for radiculopathy on the C&P exam for the back pain? Because initially I though this should be filled as a separate secondary claim for the back pain. Thank you!

Service connected for back. 10% for that one Issue. But every single time I've been to the V.A and they ask if I'm in pain I always have said yes and atleast 5 or higher pain level or above.

Did C&P exam and examiner didn't ask questions only asked if I had any thing to add after asking when did it start? She also kept telling me to move more because she had no reading, but I was in pain just standing up. She said you sat down so you can move more, I said yes but I was hurting. Worst C&P ever attitude from the start to include taking a phone call during exam.

I hurt my back 3 times while in service and have the medical records to prove it. I put in for claims to include back pain and radiculopathy in May. Haven't had a C&P exam yet. I have clinical notes from my chiropractor diagnosing me with Meralgia Paraesthetica. I also have a solid personal statement and a solid NEXUS letter from my doctor diagnosing me with all the claims I put in. I uploaded my medical records and personal statement. Should I upload the NEXUS letter too?

Ok every one find your training jacket it will show your unit and what you were trained on thereby what you were exposed to. Mine showed I was trained how to dispose of hazardous materials. Some are listed on the Pact Act. Defueling aircraft required removing external tanks and the chance to hurt my back

So can you use the same event for multiple injuries? I was a parachutist for 17 years and 5 deployments in between. I did have a compressed L1 fracture that is documented. My question is for my knees, hip, and shoulders. They are mentioned in my records several times but can I use the same jumps or hard landings for multiple injuries?

Bend till pain hits is what I did which is almost immediately upon bending slightly. Examiner immediately questioned me about how I do certain things if I can’t bend at all. Obviously if you can’t bend much than you squat. Like he said don’t forget to bring up the shooting pain in both your legs if you have it. All the best brother!

I appreciate your videos. So I had a bad C&P exam where the examiner did not go over a DBQ with me. She asked me a couple of questions and wrote the answers down on a stick note. Therefore, I was denied any benefits. On a previous video that I watched, you stated to go the supplemental claim route. My question is how do I request another C&P exam?

in 2006 I received a 20% rating for Thoracic/Lumbar spine condition (lower back pain). Now Ortho has said I have spinal stenosis and next week I am going for lower back injections. Can this be increased or is this the normal progression? I also have a 20% rating for Cervical Spine condition but is also says neck condition with residual scar - the small scar has faded away which was from a mole removal anyhow.

You’re asking the life-changing questions if you’re still active duty, keep going down the rabbit hole. In the medical condition field should be your official diagnoses, the best way to set yourself up for a great VA claim when you transition out is to make sure (visually confirm) that EVERY condition you are suffering from is official diagnosed in that record. Without that you’re in a rough spot

Records show that i should have been covered for thyroid issues but it was denied. I was sent to a private doctor by the va and they told me it has been in my records all the time. Can i claim for all the prior years that i was denied.
