There's an issue more of us need more information on. That issue is an effective date. Veteran's are getting denied on effective date appeals because of the rule that says they can be dated accordingly to last increase. Well, what if they weren't rated at ptsd in the first place. Then, they became rated at 100%?

Got out of the military in 2002. Last year, I filed for non-combat PTSD(car accident) and 13 other conditions. I won all 13 conditions except PTSD. I did a high-level review and it took 2 months for them to find a duty to assist error. 3 months later, I was awarded a 70% PTSD rating and now considered 100% total and permanent. My family's lives have changed forever

Great information. i appreciate it. I filed for PTSD submitted stressor stament. 2 personal psych medical opinions. The VA did one telehealth and one in person psyhc exam. Totaling 4 mental health exams. The VA has yet to move my claim at all. They have just shelved it as it seems and are taking no action. I call i get the same response over and over. We need no more data from me yet still no action. It's been since January 2024. I thought i provided what they needed this is insane.

I got out in 1972 and have been dealing with PTSD since then, I tried to file a claim for an injury as soon as I got out and was told that they could not find the records of my injury. long story short I gave up. the PTSD is out of hand anymore so I'm going to try for that. thanks' again.

I clearly understand the video and the point made for ‘Combat Related’ which helps. Those who research this will see that it’s part of a CRSC form that begins with…. “All of these must be true: You’re retired (and entitled to or receiving military retirement pay), and You have a VA disability rating of at least 10%, and You currently have your DoD retirement payments reduced by the amount of your VA disability payments”

Yep that's to actually receive CRSC, which isn't really the point, the interesting part is what they say qualifies under "combat related" which is the only way the VA has a set definition for combat related PTSD. It gives us a look into their playbook of generally what they consider when seeing if something is combat related 👍

Dear sir, I have just turned 66. I was in the Navy 6 years and Army 8 years I am currently receiving disability for Ptsd and have been receiving it for the last 10 years. I also have been diagnosed with hearing loss and tinnitus in recent years And now have to have hearing aids. And I am have debilitating back and feet issues which cause me extreme pain 24/7. The VA hospital which is 2 hours away say my back and feet are not service related. I am only at about 90 % disabled but now I have no teeth and am trying to get to 100% so my dental will be covered. I can hardly eat and it was the Army and Navy that took care of my teeth for 14 years. I went to Medicare this year just because I have no teeth, I am desperat and extremely depressed and feel like The VA does not care anymore. The pain I have in my back and feet are real and have pretty much kept me from going out of my own home. In the Army jumping out of Hemets and Mlrs vehicles constantly and doing a 100 mile march in 4 days. But they won't recognize my back and feet issues because I did not complain about it while in the service. Because if I did It was frowned upon like I was Gold bricking. Very disheartening to say the least. Can I do anything to get to 100%. And get the Dental which I feel I deserve? I don't know where to start. Sincerely Ron McVay. (mcvayron08@gmail.com)

I've been denied PTSD 3 times. All three evaluators rammed me through the "eval" in less than 10 minutes and I got my denials in the mail in about 3 weeks. ….. And I've seen REAL combat with SOF units and I have a combat parachute assault under fire. Meanwhile I know guys who've never fired a shot in anger that got 90% PTSD rating 1st attempt, straight out of the gate.

The form 0781 is key for a PTSD claim. This form is all about STRESSFUL EVENTS with verifiable dates and locations, If you don't have any, this form only has your name and signature in it. You would be extremely lucky if it gets approved and rated. Good luck with your claim.

You are such an amazing source of knowledge and inspiration for so many of us vets! I served as an MP in the Army, mostly in Germany. I saw many traffic and training accidents with dismemberment and death. I’m certain that this is the source of my PTSD. I have no proof, though. Do they view first responders a little differently, because we have to deal with things like that?

Thanks for the kind words! Great question. For those types of claims I would personally recommend getting your hands on a nexus letter to help put your claim over the top. However, if one of those accidents could be considered “combat related”, that’s could be a smoother one to focus on potentially 👍

@onepalerider Yes, first responders like medics and MPs. The nature of your MOS corroborates your chances of being involved in traumatic incidents and strengthens your case, but you will still need some form of documentation: Newspaper articles, your duty reports, and maybe someone who was there with you (buddy statements). That's how I proved my claim.

What about claiming combat PTSD for other than special compensation. For regular disability compensation, the -21is vague and just says during armed conflicts and lists war time engagements by name.

I submitted a ptsd claim for non combat stating how seeing the military therapist on base exacerbated my ptsd by reporting my story to the police in my hometown over a sexual assault that happened before the military. I ended up having to tell my story to my entire family when I wasn’t ready to, in turn I haven’t been back to my hometown since that happened in 2014 and i ended up having to cutoff my entire family which further exacerbated my PTSD. The therapist the va had me speak to for the claim said her medical opinion is that it did exacerbate my PTSD during military service and diagnosed me with ptsd, depression, anxiety and all that. but the va still denied service connection. Should I submit a supplemental claim? I was deployed as well in the terrorist capital of the world but chose to go the non combat route bc that situation has truly messed me up the worst.

Hi brother, I have a question. I haven't been officially diagnosed with apnea through the Army, but I do have some comments in my military files of having symptoms of it. My VA rep has told me that if if there's no file in my medical file it will not fly. Question to you. Could I just file on my own through the VA web site? And yes I'm have been diagnosed with apnea through my civilian dr and I'm on the Cpac machine.

Buddy statements are always helpful, but in my experience they don’t always make or break a non-combat PTSD claim. In my case, a personal statement, current diagnosis, and nexus was enough to get me there. That being said, if you can get a buddy letter, absolutely get one. It can only help.

Have 70%, non-combat related, didn't even know that training circumstances Qualified for Combat Related.. Being on a carrier, we did live fire training and had 3 planes go off the end of the ship, causing Man Overboard Events.. so in reality I could get this last 30%....

Reminding us to talk about how it impacts our life in our Personal statement, it will be good to direct us to the CFR 38 to see what line items the Va looks for such as forgetting names, etc. once I saw that list, I realized I had a lot of the things, but I wouldn’t have thought about it without seeing the list of qualifiers. 38 CFR for mental health, right?

I am a purple heart veteran from Vietnam and meet all five requirements to receive PTSD. I applied back in the mid 80s, and the psychiatrist at the VAMC in Palo Alto, California refused to diagnose me with PTSD. So my claim for PTSD denied my claim initially. I applied twice more over the years and continued to be denied. Then finally in 2017 I filed yet another claim from Thailand and was sent to a social worker in Bangkok for an exam. He said absolutely I had PTSD and had it since I left Vietnam. The VA then approved my claim. I filed for retro pay in 2023, but they refused it due to the time that had past. But I was wrongly not diagnosed by the VA in my original claim. Do I have a valid claim for back pay that should have been paid to me for obvious reasons in my original claim. I also had attempted suicide two times but that psychiatrist told me I had not symptoms of PTSD. Do I have any recourse against the VA?

Pretty common the first go around, especially if you relied on a VSO. Many of our best clients who end up with high rating have been denied on everything previously. You are doing the right thing by researching how to strategize a smarter claim for this next push

Talking about PTSD and the compensation from this is despicable to me. I refuse to even claim it for 15 years a white knuckles my way through life for that long with no help because I didn’t want the label when I didn’t give a shit how much money it was worth. $1700 times 15 years of monthly payments is a pretty big number.I literally told the doctors that you dare put that shit in my record. Typically people leave you alone unless you convey an action plan to harm self or others. Almost everyone has a 70% mental rating. I had a TS/SCI clearance and most people in the SCIF had mental ratings averaging 70%

I hate to tell you this but the VA right now is on a record high for Denial for PTSD. You need to talk to some Raiders because they're gonna tell you the burden of proof for the in-service event is extremely high and CNP examiners are very specifically told to look for pre-military mental disorders

Yes. I waited about 8 months for a C&P for MST (they already denied all physical claims and combat PTSD, because they lost my records). The examiner diagnosed me with PTSD, but said she could not verify the stressor because no service treatment records, no markers in service records that they did not have, because the government lost them. So. They clearly stated that I was in my unit l, at the time and place the “alleged” stressor occurred, but they could not prove the MST happened despite Buddy letter. They even have records that I was in AFG 2002-2003 doing what I was doing and denied without review. Mine was a documented open shut case but they lost my records. Now I have to PROVE the MST happened the combat related happened to link it to the va diagnosed PTSD and hope they do right. Bottom line it is not that easy, because VA workers do not understand the criteria.

Your videos are very helpful. As for this, agreed. MST should’ve been easy, especially since the examiner herself diagnosed me with ptsd. Not sure where she thought I got it from, but she pretty much said you didn’t report it, you didn’t get mental help, and you didn’t start acting a fool in service afterwards. And words like “alleged”. Now I have to jump up and down to further humiliate myself to beg people to believe me again. Not cool VA. Not cool 🙄. On the fair side to the VA, I had a psychiatrist diagnosis for PTSD linked to my MST and a prepared personal statement; but the VSO told me to hold off in case I need to do an appeal. I knew I shouldn’t have listened to him. So now I’m doing what I knew to do from the beginning despite them losing my records. BTW… Your video on VA lawyers was excellent. Maybe some of that VA funding should transfer to better training so we don’t have to go to shady lawyers 🤔.

It's a different diagnosis but anxiety can be downstream of PTSD. If you're looking to claim PTSD specifically,make sure you have that diagnosed specifically too

If you don't have evidence of the in-service event, your optimal claim would look like a nexus letter from a medical professional (will make a vid on this Monday) and a well written personal statement

I fought for my ptsd for 47 years, I finely did a doctor interview on line a few months ago and the VA rated me at 70%, is there a way to get it up to 100%? it is combat related. I was on ship in the navy.

I had on my claim Combat PTSD given to me as by the VA as Non-Combat PTSD 10 years ago with all the proof easily available. Is this something I should fix or leave it alone as I don't know if it will knock my rating down lower resubmitting. Thanks.

If you don’t already have a mental rating, and you are rated less than 100%, then it’s almost certainly worth fixing. Just be sure you know what you’re doing

I had a PTSD claim denied, after I had spoken to the mental health department at the VA. I'm was assigned to talk to a therapist at Angles on the Horizon. Do I refile after been talking to them or do I still need to get a C&P?

I have had flashbacks to war simulation events that I participated in at JRTC, but I didn't think I could have PTSD from it. I always have been adamant that I do not have PTSD but I am considering that I actually might have it because the events have bothered me and I do think about them but it is not a super debilitating thing for me.

You have ptsd. It's okay, its nothing to be ashamed of. That's what you were taught to do. Think you are just fine, deal with it and move on. You should write a statement about what went on etc and file a claim

@ because combat is the only way people get ptsd. I can think of 3 people that i served with all 3 which of were raped and then punished and then forced out. And all the other sick crap that goes on. I know lots that got injured not in combat and were not allowed to go to medical. They steal more money then what is spent on veterans. You think because you have proof of combat and ptsd that you get denied because of someone else getting benefits..Come on now, you can't be that nieve. I didn't go to combat but my right hand is still fkd from service. Not my fault they put the cast on wrong 3 times and now i get to do everything one handed. If you think its not depressing. There is a reason there are 4 letters in ptsd. we will just have to agree to disagree

@ Hey brother. I know that stuff does happen. Personally, I do not need a ptsd rating to get 100%. I'll have 100% just with my other injuries. However, I see your point of view but you only are saying that because you are a combat vet and because you subconsciously look down on those who never went to combat who may have experienced other things related to ptsd. Its the same for people who were deployed and they look down on those who never deployed. Infantry look down on other MOS's also. Vets in general don't care about most other Vets unless they have similar experiences. I do not think that because someone never saw combat that they should be judged or looked down on. However, I know that the VA needs to treat combat vets better. My father was a corpsman in the navy, but spent his entire career with the marines. He told me that He responded to a few Harrier crashes and had to pick up body parts for days on end. A torso and head he picked up really messed him up he said. For a long time he could see body parts floating that were not actually there and had nightmares about it. He never saw overseas combat but definitely has ptsd. He never got rated for anything though. No one is entitled to something because they did more or something else compared to this person or that person. It is an individual issue. There are a ton of combat vets who do not have ptsd in the slightest. There are people who get ptsd from very simple things like a car accident for example. My grandma got in a car accident 40 years ago on the highway and to this day cannot drive on a highway. I agree that there are guys who need help and the VA falls short, but I disagree that it is the fault of other vets seeking compensation. I think the VA should stop having Vets followed and doing everything in their power to take away their benefits. Perhaps the VA should have a completely separate system for those who have been in combat overseas to keep them separate. There are two distinctions but perhaps there should be three. But when it comes to my injuries I would much prefer to be 100% healthy and they can shove their money up their ass. But in reality my injuries will never heal unless it is an act from God.

Why should it be about dollars??? I just want help! I called the VA HOTLINE! I talked to the nicest person! She helped yea! But, she told me that someone would call me the next day! That did not happen!!! I got a postcard about a month later! If it was not for my wife and my daughter I would have taken my life! I eventually met with a VA contractor who rated me at 70%! I got 30% through the VA! I don’t care about the percent rating! I just want the help! Nobody has called me since! Am I supposed to call and follow up? This is so screwed up! I don’t know what to do! HELP!!!!

-BS, I was denied my PTSD claim because the VA said there was nothing in my 201 file showing I had any type of trauma. Even though the Dr that did my final evaluation wrote me up 100% unemployable. The VA can deny anyone they want, hoping you won't fight it. Even after severak documented suicide attempts.

Bingo. They aren’t denying that you have PTSD or that it’s severe, they deny service connection. This is super common and a simple fix, I’d say it’s about where 80% or so of our clients are at before they get to us to help fix it. You’re not that far off

PTSD does not automatically get 100% rating. I have 40% and its combined with a TBI.
