A Battle with The Navy! A Guide to Anchoring in Key West | S3 EP 45 | Sailing The Space Between

So after we sailed from Bahia Honda to Key West we anchored in what we thought was Key West's Anchorage. A $300 citation from the US Navy is how we started our morning off in Key West! We figured we may be able to help someone else out there avoid the same. Even though the chart has an anchor on it and there are other boats anchored next to you, it doesn't mean it's ok. Our Raymarine plotter was down and we missed the "restricted area" notes. Have a look as we give you an in depth look at where to and where NOT to anchor. Fleming Key includes a dolphin research center, marine corrosion testing facility and bunkers where the Navy stores weapons and ammunition... can you say BOOOOM!!! The bunkers have "explosive safety arcs," or areas that could be blast zones in the case of an accident. Sailing and especially anchoring within those areas is prohibited.

Can't find it. Numarine, Bering, RKM, etc. Super shipyards in Turkey. Depending upon the size, Numarine is several million less expensive than competitors. 😎🌴, Found it 😁👍 at the end.

The reason it is a restricted zone is we train our Special Forces underwater operations course in that area. It is where we open water swim and do scuba training. We have had problems for years with the anchoring and more importantly motor craft zipping through the area. Boaters have been warned excessively over the years and with no luck. Navy, CG, and Marine patrol now enforce the zone without warnings. Key West NAS just had a new commander and that means they will enforce every rule to the T. I spoke with both the Cdr and the Cdr of the military dive school and volunteered my company to lead the cause of properly marking the zone with piling that state Restricted Zone. MTF. If you are still in the area have fun.

Thank you for your service and yes having it properly marked and charts updated would be beneficial. We saw fishing boats after they left there, but they didn't get popped. We appreciate your efforts to do something about it.

Aberdeen Proving Ground puts out red buoys and has patrol craft out at critical times. No tickets. But they do have signs that read "IMPACT AREA" - they work remarkably well. Also clearly marked on charts. We don't need boats hitting or hooking divers. A US Commissioner would not sustain a ticket where there is no consistency of enforcement. My SF career did not include underwater training as I was classified as a "sinker."

If you've had problems there for years as you say, why is it not marked on charts ? And why is the Coast Guard not the one enforcing civil law on coastal waters. Seems to me the new Commander needs in education in posse comitatius. It's not like they sailed right up and anchored next to a destroyer.

I notice you have synthetic teak. I have synthetic teak on my 2016 Leopard 40 but i have a stain on the starboard lower platform. I believe it is a unnoticed diesel spill. I have tried pressure washing it and other recommended cleaning but nothing has worked. Have you experience a stain that and gotten it out?

I dont think so army is usually on the other side and if they were protecting them they would have been there longer than 30 min because right after they left the fishermen pulled back in there zone and stayed all day.

It is just dont come out when the navy comes knocking or you will get a ticket. Everyone else stayed in there boats and they went away.

The navy is not allowed to enforce civil law. They can not issue citations. That is a violation of posse comitatius. Only the Coast Guard can enforce civil law , I would file a complaint for violation of posse comitatius.

Lol! The NAVY has no authority to issue any citations nor to enforce any state or federal laws. Next time ask them. What authority they have to issue such violations. Only state PD and USCG under 14 USC 522 can enforce such regulations.

There are some valid questions hereL 1) Is there a properly approved restricted zone? The reasons for an approved zone are not relevant. 2) If there is a legal zone, it comes under a federal law does it not? Many MPs and SPs are made Deputy Sheriffs so they can enforce civil speed laws on roads passing through military installations. That does not empower them to enforce federal laws. If those sailors were SPs (not so identified) they could encourage civil vessels to move out of a restricted area. They cannot arrest people and issue tickets. Where does the ticket say that you can appear to contest the ticket and when? 3) The friggin Base Commander is irrelevant in regard to civilian conduct unless you go on the base. Although he is responsible to ensure that his sailors equitably annoy (not ticket) all civilians parked in a valid restricted zone. 4) Probably, they are getting away with capriciously issuing tickets with exorbitant fines because no one has contested their authority to do so. If they somehow do have that authority, then they must treat all "offenders" equally. If an owner is not aboard or refuses to answer, they still should be issued a "parking ticket." 5) You do not reside in Key West and are probably disinclined to go to court there. I would do at least 2 things. First write a letter to the court (assuming one is cited) and question the validity of the ticket and the inconsistent enforcement on that day. Second, I would ask the city of Key West if they were aware of this ticketing of bessel; question the legality and method of enforcement; AND say that this is detering you from bring charters to Key West. Send the letter on "corporate" stationary. The latter course of action is the easiest. Personally, I'd pick up the phone and call the USCG District Commander, a local marina, and the city manager of Key West and their Chamber of Commerce.

Let's ask the NAS Key West Public Affairs Officer what is the basis, in law, for NAS Key West's issuing tickets to civilians for violating an unmarked restricted area? His name is Trice Denny (305) -293-2027. Let's inundate him with calls. I searched for an email address but could only find one for a staffer on the base newsletter.

If you are protecting swimmers, you mark the area with buoys and not an invisible line. You are assuming that the Navy has the authority to issue tickets and to do so inequitably. @@seansean9675 I know that he respected the restricted area marked on his chartplotter. I know that he anchored where other vessels were anchored. The reasonable thing for an enforcement authority to do was to tell all intruders to move - period. I suspect that the sailor lacked the proper training for his job. The enforcer did not enforce the law equitably. He should have given a "parking ticket" warning ALL first-time offenders. Law enforcement is not a job with cookie-cutter answers for all situations.

@@seansean9675 No, I was aware that his chartplotter was down. However, at 2:33 in the video, he shows us the electronic chart after the fact. What I did not realize was that the inshore red dashed lines are not the only markers for the restricted area. There is another red dashed line that touches the "R" in Harbor out in the channel. So, the entire area where everybody was anchored is restricted. As a former city mapmaker, I would place the words Restricted Area out in the middle of that area. Now we are down to the legal right of the Navy to issue tickets. Their inequitable enforcement, and their failure to give a warning instead of a $325.00 ticket. During the height of terrorist tensions in Norfolk, there were and are restrictions on how close you can approach moored Navy warships. Identically garbed sailors in identical unmarked boats merely asked offenders to steer away. They also puttered around marinas observing the boats moored there. They were very friendly.

On KZbin, there are videos of several Italian builders who produce boats with that appearance. It seems to be the new style, albeit ugly to me. About that ticket. Screw the local newspaper, this ain't no local zoning notice. If this wasn't published in the Local Notice to Mariners, that it ain't legal. But, it probably was. LNTM is available online and you should check it regularly. The USCG will place you on an email list. If practical, I'd go to the US Commissioner;s Court in that area and dispute the ticket as unjust for a first offense. Especially since you checked your latest charts to ensure you were NOT in a restricted area. I would also point out that they failed to ticket other boats just because their owners did not come out on deck. On that latter point, I'd politely query the Base Commander on his/her inequitable enforcement policy. $325 is a disproportionate fine for a poor little boat owner. BTW, the US Navy is part of OUR Armed Forces and not the Navy of Iran.

We paid the fine right away and accepted our negligence, although the same lesson could have been learned with a warning instead of a fine. This video is to serve as a warning for others not to make the same mistake.
