The plaintiff did try to scam the defendant. They actually ate a regular cake before she called her. She used the Dick cake for display only with the intention of returning it. It's like women who buy a dress, leave the tags on, then return it after wearing it to an event. You wear the dress for free. Similarly the plaintiff was able to show off a sexy cake and didn't have to pay for it. Judge Mathis got played on this one.

Having studied defamation in a law class, I'm actually surprised JM sided with the plaintiff. The defendant honestly believed the plaintiff was attempting to scam her. Therefore, in her mind what she said was true. In order to prove defamation, you have to prove the person defaming you knew what he or she said was a lie. What the defendant said was her opinion and therefore, not the same as a life. Yes, I know JM is a judge but in this case, he was wrong. Wish the case had been heard by Judge Milian. She would have been a better choice and I believe would NOT have sided with the plaintiff.

where the defendant went wrong was not giving more details to the plaintiff about the cake...also when she said she didn't want the cake at 2am you should've requested she brought it back at that moment or in the morning and at 7am and if she didn't you would've won.
