The plaintiff says she bought a camper from the defendant. When she went to the DMV to register it, they informed her the camper had never been registered before, so the defendant needed to fix that before she could get the title. The defendant is refusing to do so, so the plaintiff is suing for a refund. The defendant insists she told the plaintiff the camper had never been on the road, and it was an as-is sale.

The defendant has some nerve acting so annoyed about the plaintiff taking 7 months to register the camper when she NEVER did. I live in MA and she knew whether it was on the road or not, it needed to be registered and titled in her name. Nasty attitude when she started the domino effect by jumping title. You can't jump title anywhere.

her attitude about having to pay the taxes she tried to skip on is wild. even if the plaintiff did the registration immediately, the defendant still would have to pay. it’s her own fault! it’s annoying to shell out a lot for taxes but it’s no one’s fault but her own - she should be mad at herself & not the person who bought her camper. some adults are so unable to take responsibility it’s astonishing but not surprising at all

@@MrV41N It’s ridiculous for you to attribute the problem in this case to the fact that both of the litigants are women. That’s just your glaring bias on full display. The fact that they are both women makes no difference. The defendant caused the problem by jumping title, whether due to a sincere misunderstanding of the law or just a way to avoid some taxes. If you replaced these women with men, please tell me how that would change any of the facts of this case? Do you just assume that no man has ever jumped title when selling some sort of vehicle? Because I have definitely seen several instances of men doing exactly that on The People’s Court.

100%, she knew what she was doing. She didn't want to bother with the taxes, you could tell she wasn't happy about doing it. She just wanted the camper gone and wash her hands of it.

Me too. Or requested the judge put a time limit of a month on registration of title, after which the deal is undone. The defendant had time to register the title in her name before the court date, and she didn't bother.

Idk why the defendant thinks she has the gall to be irritated when she was the one who made the mistake in the first place. Even if the plaintiff waited, she knew damn well she couldn’t get away with not paying taxes… she knew what jumping title meant. She just didn’t want to be out any extra money

Like JM said, if she had kept it and never sold it then okay she gets away with it. But it’s worse to acquire a product that then has to be yours forever (aka never sold, never to potentially appreciate or get back most of the purchase price back) than to just have paid the damn taxes and been done with it

@@colleenknapp8626 hmmm , why do i think the plaintiff already used the camper and now she was hoping to get a free camper rental by getting her 1500 back ? she must have known when she bought it that there was no title with the defendant's name on it . also the buyer is responsible for paying one of the 3 years of sales tax .

Defendant is mad that plaintiff "took too long," when defendant never registered it at all. This was the equivalent of her selling something she didn't own. She knew what she was doing, and she had a lot of nerve ghosting plaintiff. What a nasty woman.

If the defendant moved to New Hampshire right after selling the camper, then it really doesn't matter if the plaintiff waited 1 month or 6 months. The defendant was always going to have to head back to Massachusetts to sort this out.

Most definately! It was exactly what she was looking for at a great price..now she will obtain it for this upcoming summer. The Plaintiff should have gone to the DMV right away but probably would of still had to deal with the non-tax paying defendent difiance on not wanting to pay the registration fees..@@chynacash3138

I wouldn’t have accepted this settlement. Give her the burden of the camper again and make her pay taxes on it. The defendant ruined a camping trip and had the nerve to ghost the plaintiff who was completely reasonable and didn’t rush her at all? Disgusting. Hope MA forces her to pay penalties for being so late.

Yes, but the Plaintiff really wanted this camper at this price plus she would have to drag it back 25 miles to the defendents place and could be picked up by the cop pulling it on the highway with no registration. All stems back to defendent not paying the sales tax initially.

The judge said it might only be a couple hundred dollars for the defendant to get the registration updated. The defendant waited 3 years so that registration fee is going to be a lot more than $200. Cause the fact of the matter is if you wait several months or even years to update the registration and title on a car, boat, camper, full-size RV, or even a trailer that tows a car the DMV loves to charge extra late fees, taxes and penalties. So the defendant might end up paying what the plaintiff paid her for the camper just to get everything up to date.

The DMV has every right to charge a late fee. Especially when it is 3 yrs too late. Your ‘DMV ‘loves’ to charge…’ is not warranted here. (Nope, I don’t work for them)

The judge is not often as patient as she was with the defendant. Asking the judge of all people to tell her what she needs to do? That's not the judge's job. And then whining after essentially trying to break the law and is just mad that it caught up with her? I wish the judge scolded her like she has in cases where it was undeserved.

This should have been common sense to the defendant! If you don't have a title then you don't have anything to sell! Doesn't matter how long it took the plaintiff to register. If she wanted to SELL the camper to the public then it had to either be done legally or send it to the junkyard.

The plaintiff only sued because ole girl blocked her. Had the defendant just did what she was supposed to do and fixed the title situation, then all of this could have been avoided. The defendant got lucky with Milian. Because usually Milian does not care and would make you just return the money.

@@michelehemlokhexwhite4310 Exactly! If she was playing games about going before, what makes Marilyn think she's going to go now just because she's suddenly willing to "cooperate"? Plus she tried to use the 'as is' clause as an excuse for never transferring the title in her name. When even if the Plaintiff had of checked when she first got the camper, they would probably still be right where they're at now.

‘IN MY MIND’- In your mind lady, it’s dusty & filled with cobwebs! Your kids could have slept in a tent, not a camper. Just b/c it’s not on the road, doesn’t mean it doesn’t need to be registered/ RETITLED. It’s considered a dirty title. You can’t sell it. That means, that ‘as is’ sale is VOID. PS PAY THE TAXES & REGISTER IT.

Once the defendant pays the taxes and gets the title paperwork done, they can "Hand Carry" the title paperwork to the capital building that prints new titles that same day rather than wait weeks for them to mail the new title to the defendant. I do it all the time, you just have to tell the clerk handling the paperwork that you are wanting to hand carry it to the department of revenue and they will put everything in an big envelope for you.

I don't understand why the defendant is getting mad at the plaintiff for not registering it when the defendant repeatedly said the reason she didn't register it is because she didn't have it out on the road, well the plaintiff didn't have it on the road either so according to the defendants logic she shouldn't be getting mad, also when the judge started talking about how the defendant didn't have the right to sell it she knew the judge was going to order the trailer back to her and for her to return the $1,500 to the plaintiff so she quickly started talking about what she needed to do to get the title in her name 🤦‍♀️🤦‍♀️🤦‍♀️ I was hoping the judge would just order the trailer back to her, the defendant knew exactly what she was doing and I do not believe that she didn't have it on the road.

I live in Tucson where a lot of people have yard ornaments/additional space, and it's legal, as long as you don't have HOA and it's not in the street. Tucson is dirty, all but where the money is, foothills.

The Defendant is completely at fault, and definitely entitled. Everything going on in her life is more important. Plaintiff is also at fault. She got a good deal walked away, forgot about it, until a week before her trip. She didn't bother to check the title before completing the sale? You walk away with a bad title on your own. Most people in this day and age, finish this type of sales at the Motor Vehicle's office, for liability and title issues.

You can't jump title. Duh, how does the defendant not realize that you have to register something in your name saying you have the right to sell it. That's how we know a vehicle or vessel isn't stolen

There are plenty of states where there is no sales tax on private party sales...."title jumping" is not a thing. Obviously, this will only work if the buyer's info was left off the title. Generally, you wouldn't have a title if the vehicle was stolen....

The defendant is a fool for thinking she can hold the plaintiff accountable for something she herself didn’t do prior to selling her an unregistered camper. She also doesn’t have ownership of the title- something she didn’t sign over so she wouldn’t have to catch up the taxes. Foolish.

That interviewed Doug or whatever at the end ALWAY says the stupidest most cringeworthy things to the people. I feel embarrassed as soon as the litigants walk out of the court! Also, I cannot believe the audacity of that woman trying to sell the camper without registering it, AND trying to get out of paying her taxes. Who does that except a CROOK. No one should cheat on their taxes, especially defrauding the next person that paid money for your vehicle that you did not pass clean title to. I would be so livid if I were the purchaser, I'd want the defendant in JAIL.

The defendant knew EXACTLY what she was doing by not registering the camper. She knew EXACTLY why the plaintiff couldn't register the camper, it's just like a car: you have to get a title in YOUR name and then sign it over. I'm kind of surprised why the Plaintiff didn't realize that the title name wasn't the name of the seller (ie the defendant), that would be my number 1 question. All the defendant had to do was download the form online, fill it out, print it out, go to the DMV early in the morning and title it + pay the sales tax. She just wanted to be cheap and not pay the sales tax since "it never hit the road". It doesn't matter if it never hits the road, it still needs to be registered under your name. What would have happened if a tree took it out and you wanted to file an insurance claim? Oh wait, you can't do that because the TITLE ISN'T IN YOUR NAME. Yeah, the plaintiff should have done this sooner but I understand her train of thought, why get it inspected and registered if you're not planning on using it for the next 6+ months? Also, this could have all been solved if the defendant was up front about the state of the Title not just, "I never took it out on the road". Yeah, going to the DMV at 7am on a Saturday isn't fun, it never is but if it helps another human being out, why not? Then you'll never have to deal with it again. She can be out of your hair.

I DONT BELIEVE FIR A SECOND DEFENDANT NEVER HAD THAT CAMPER ON THE ROAD. Her kids didn’t wanna be in the same house with her but they stay in a close quarters trailer ? Can’t believe she was annoyed that the lady took 7 months when she had never registered it so that she didn’t have to pay taxes. She knew she didn’t have a clean title if she never registered it and she knew she wasn’t supposed to sell it

I had a pop up camper, we used it for one week. 4 people with no toilet or shower, no privacy. Never again.

The defendant seems intellectually slow. She is being told the law over and over again and doesn't seem to understand a simple rule. She is really confused.

hmmm , why do i think the plaintiff already used the camper and now she was hoping to get a free camper rental by getting her 1500 back ? she must have known when she bought it that there was no title with the defendant's name on it . also the buyer is responsible for paying one of the 3 years of sales tax .

I believe the defendant knew she was title jumping. She should have found out what the 3 years of back taxes is (probably a few hundred bucks), and just include that amount into her selling price

Who buys a camper and never register's it???? It doesn't matter if it never hit the road. It is an RV. It is required by law to be registered.

Plaintiff should have said “Nope!” to the settlement and gotten her $1500 back because she now knows all the work and fixing the camper needs. Defendant jumped title so the sale is pretty much voided.

She bought it "as is". That is the problem of buying out of impulse. It's pretty much her fault for having no knowledge whatsoever on those types of purchases.

Both buyer and seller knew about the title at time of sale. Seller never intended to register as she didn't need it on the road and didn't want to pay the property tax. Buyer would be dumb to not realize the name on the title was different than the person selling, not to mention, you're given I think 90 days to register before paying late fees. Buyer waited longer than the 90 days because she "knew" the title wasn't dated so she could date the title before taking it to register. What was unknown to both parties, was that the ORIGINAL seller who's name was still on that title, had reported to the dmv proof of sale so that they themselves would no longer have to pay the taxes. So when the new Buyer went to register, the dmv knew it had sold 3 years prior and the title had accrued late fees for registration. This at least is how it works in my state.
