The main issue with youtube's copyright system is that people also use it to get personal information about a content creator, but the person sending in the strike doesn't have to give *any* of that, and youtube makes it super difficult to have a copyright lawyer represent you

This has been like so for 10 years almost. It's not gonna change. I remember when I used to watch Jim Sterling in like 2015 or whatever when he had a copyright dispute with a "gamedev" who was selling an awful ripoff that was obviously using store bought assets clumsily slapped together by an amateur. It was the same stuff. He had to basically doxx himself to get rid of the claim, and what happened after that is the gamedev went out of his way to file a lawsuit on Sterling based on the information he got. He lost the lawsuit, of course, and the judge basically dismissed them in 15 minutes, but Sterling still had to take energy, time and money to fight it. It was an absolute circus. And all that because conmen can't just leave well enough alone and feel the need to silence their critics. And I hear there's plenty of similar cases (maybe not in scale but still) across the years. If they haven't done anything about it yet, nothing's gonna happen now unless an outside source intervenes OR one of their big cashscows somehow gets involved. They have proven they don't and will not care no matter what. I guess it's to appease other companies so they don't get flak or pressure, I dunno.

The problem isn't even KZbin's fault. KZbin is required under Section 230 and the DMCA to comply with takedown requests. They have a legal obligation to accept requests; they can't reject them. The DMCA does a good job of protecting copyright, except with regard to technology. It's a very old standard that hasn't been updated to account for changes in technology. It's a lot easier to play games with the system, and KZbin has no reason to open themselves up to possible 230 sanctions for individual creators. Developing a system that would enable them to authenticate what are essentially legal documents would put them in a position of risk that no company would willingly accept. I actually think it's crazy the few times I've seen them reject takedown requests that were "likely fraudulent". That's a huge liability that they're taking on, and they still had to allow the takedown to be submitted.

There are literally no penalties for filing false claims in fact there's an option where you can take someone else's monetization on a video even if the claim is completely false. so if a cheat maker says, "Hey your video exposing us, that's our video 100%" they get to take all the money that KZbinr would have made until they file a counterclaim, and even if they never fight it or if they proved to be wrong they still get to keep all the money they made no questions asked

The original creators suffer while the liars get away with it most of the time and youtubes people are not doing anything to change it. They have to fix their rules about false claims eventually. Also there should also be a grace period before any action is taken on an account, a strike shouldn’t result in immediate action on your channel. There should be time to notify KZbin that a claim is being disputed and until they received the counter claim and account shouldn’t be penalised and most importantly there needs to be actual repercussions for false claims

@@xoxo5296 Yeah, the algorithm doesn't kill videos after restrictions are lifted, it just takes away the "new" tag, so they're not being fed to "recently uploaded" feeds. The fix for this is basically just calls to action. Like, comment, subscribe, and use your subscription feed. IMO, the last one is the most important. Most users just click on videos from their favorite content creators on the home page, which reinforces the algorithm's delivery mechanism: it sends videos your home screen for your subscriptions, because that's where all of your engagement is. The only thing that sub count currently does is determine, approximately, how many feeds the video can be sent to... but, it's based on users who are subscribed and actively watching... so channels with dead subs are unable to use their subcount to influence their reach. How many times have you seen "less than 20% of my viewers are subscribed" on channels with over 1m subs? And these are usually vids doing 150-200k views in the first week, so what, 60%+ of the subscriber base is basically dead, no?

The copyright system blows. Terroriser lost a video because the automated system picked up on HIM doing an impression of Michael Jackson as a piece of MJ's song but the radio edit. He just re-uploaded it with the offending section cut. You think that would put more strain on KZbin's data expenses when a workaround is to upload more videoes to skirt around claims. There was another guy who just read reddit stories with soundless gaming footage and they were struck for using copyrighted music. They just talked, no music whatsoever. I'm sorry you had to deal with this Kaif. I've had a similar experience, and it's very demoralizing for every content creator. The automation is ridiculous. It gets to the point where despite doing everything correctly. You are still treated unfairly, but the fraudsters can face no consequences for their actions. Forcing you to either pay for a lawyer, get yourself doxxed, or have to deal with the risk/stress of going down the legal BS yourself. I got lucky that I didn't need to resort to a lawyer, but I know others choose not to fight it and move on. Happy that you won in the end. I would have threatened charges against google because they're based in the US and under US law they are violating copyright regulations and if you want to, you could argue their actions as being defamatory, which is also illegal in the US if it provably false.
