In the US, the EB3 visa allows three types of workers to go to the country permanently and work. The number of visas issued each year is limited for the EB3 visa. EB3 visas account for 28.6% or around 40,040 of the total 140,000 visas issued in the employment category. Hello, I am currently on OPT STEM extension working for an employer. Can the same employer initiate the EB-3 visa process for me? And while my EB-3 application is in process can I apply for H1-B as well? Also, while I am in the United States and my EB-3 application is in process, at what stage can I travel outside the US? Sorry for the complicated question.

The NVC is currently scheduling 31,700 interviews per month, but this can vary depending on the case's priority date. After the NVC sends the approved case to the Consulate, the applicant will receive an interview date for their visa interview at the U.S. Embassy or Consulate. The U.S. Consulate in Guayaquil is currently processing all immigrant visa categories, but due to a backlog, the Consulate is unable to guarantee the issuance of a visa before a fixed travel date. Applicants should not make final travel plans or buy tickets until they have a visa.

If you are currently in the United States on an F-1 visa, you can convert to an F-2 visa by completing Form I-539 and submitting it to U.S. Citizenship and Immigration Services (USCIS). After form submission, you will get a new initial Form I-20 from your authorized school official (DSO). You must also pay the I-901 SEVIS cost. After that, you can apply for an F-2 visa at a U.S. consulate or embassy. To be eligible for F-2 status, you must apply for an F-2 I-20 and submit proof of financial support and paperwork proving you are currently in lawful non-immigrant status. If your F-2 visa application is granted and your F-2 visa is issued, you may re-enter the United States using your F-2 I-20 form and F-2 visa. Your F-2 status will be checked at the Port of Entry. You can also convert your status from F-1 to F-2 by traveling outside the United States, applying for an F-2 visa type at a U.S. consulate, and returning to the United States with your new F-2 visa.

No, you can't do it. You must remain in your home country until your EB-3 visa application is accepted. If you leave while your application is still pending, it will be withdrawn automatically. Also, you cannot apply for both an EB-3 and a B2 visa at the same time; you must choose one or the other.
