Ironically(and this has gone right over the idiots head) he’s suing for the invasion of his privacy, after illegally invading other people’s privacy(and misusing the police database as well as abusing his position), which shows that he has got double standards and a piss poor criminal mind, as well as more money than sense.!.!.!. Especially, if he was asked on his police application forms, if he had been arrested and/or been found guilty(which is something that every application form, for the police force should ask, for obvious reasons), even if it is a spent(this is the British term for when someone has been good for fifteen years after being found guilty, I don’t remember what the commentator said the US version is) sentence, just to make sure that they have been honest with the answers that they gave.!.!.!. But, this means that his boss didn’t do a very good job, of checking his applicants backgrounds, after they had applied for the job, which means that they hired people for the job of police officer, just based on trust.!?.!?.!?.

As a Brit, I am not sure what the average sentences for those crimes are likely to be(but I do know that they tend to get a light sentence when they should be getting double, because they are supposed to be upholding the law, and they swear to do that, so I think that they should be sentenced(equal to the crime they breached their oath with) for each breach of the oath too, therefore in my mind he was only given half of what he deserved, even if he got the maximum for the three breaches), so my question is an honest one.!.!.!.

@Somar Chimon This is just one of those 'once in a lifetime flukes' as courts are rarely in the mood to grant such lawsuits. However, those are usually between a private citizen and a police officer. IN this case, the complaint is between a police officer and his superiors. I don't see this police officer winning.

@@onlyqueso actually they (police) are very rarely drug tested. There needs to be a reason/suspicion and it may not be that officer in particular, but is part of a precinct that issues are taking place in. Also, they are often given a heads up. *brother is an officer for a precinct in Detroit*

@@onlyqueso more often and more frequently than anybody else. They are given the right to shoot people dead and are supposed to enforce laws. Should be no doubt that people enforcing laws are not then breaking laws their self. If the responsibility of stocking shelves is such that you need to be drug tested, then surely the responsibility of policing is greater than stocking shelves and should be treated as such as far as requisites for the job and drug testing policies. They should also have stiffer penalties for breaking the law since they are more than willing to ruin anybody else’s life when they enforce laws on others. So when they break laws they should know better.

Of course it's all being logged. There just isn't some internal affairs teams going around printing out every officers searches and cross referencing them to the cases they are working on to make sure no one isn't searching for something they shouldn't. Till they get flagged and are investigated and their searches get pulled up. To make a guess, him searching the database for himself, (ex)girlfriends and family members is probably something a lot of police officers do, but isn't found out till they are investigated, and to be honest, if that was the only thing probably wasn't going to be a big deal. But coupled with the other stuff it can be a huge embarrassment for the police.

@@DutchFurnace That's exactly right. Everything is logged but there are so many searches, etc. that the only way to see if they're legit is to have an audit. The only way I could see to make 100% sure the searches are legit would be to make the officer tie each search to a specific open case, and that case should have to be approved for searches after, say, a week of non-use. Then to make sure that corrupt cops aren't just putting all their searches on one case that they can keep open, I'd make it so that all cases with more than a certain number of searches would be immediately referred to IA, and then later search all cases for searches that match in unrelated cases. That way if an officer tied a search for his ex-gf in Case X but then it was closed and he did another search on Case Y, the search would turn that up and refer it to IA for investigation. And that'd just be a good start. Really, the people to follow would be accountants because they have been dealing with embezzlement, etc. for ages and they have good ways to prevent it.

Some dumbass I worked with thought it was cute to run someone they should not have and a couple hours later the FBI was at the building talking with the shift sup. 99.9% of the time it's just logged and someone would have to get curious and check which user ID is doing what though.

A person trying to buy drugs is a far cry from a child sex offender. Which by the way his conviction was expunged by order of a judge. Meaning it can no longer be used against him when applying for jobs or security clearances. He's absolutley in his right to sue the Chief for terminating him based on an expunged conviction.

@@alb12345672 it may vary state to state. Where I live my SiL received a letter stating, by order of a judge the conviction is expunged and the record sealed. The 2nd paragraph said You will be treated as if you have never been convicted of a crime. So I think you're right in that you have to disclose arrest because technically there will be an arrest record but not a conviction record. That's probably why the Dept is using against him, that he didn't disclose his arrest record.

For those of you who don't know how drug court works: you receive a withheld judgement dependant on completion of an addiction program. If you complete it, the charges are dismissed. The arrest is a matter of the police department not only a court of law Many people are arrested for things that they don't get convicted of if he got convicted of it and the court expunged the record then he can legally say that he didn't do it but he still can't legally say that he didn't get arrested for it. You want people who willingly choose to obey the law you don't want people who consistently skirt the law break the law slip out of the grips of the law and just keep getting involved with lawlessness to be a part of your Police Department. Look at the video again and realize this is known information it should not reasonably be expected that this is all the information that there is. The Apple doesn't have to be rotten to its core for you to reasonably conclude that you shouldn't eat it

In regards to the databases, you must log in with your username and password (so they know who is accessing the database) and you must select a legal reason for each search performed, which must be truthful, under penalty of perjury. Perjury is a felony, and a single conviction would preclude someone from qualifying for certain legal positions.

Unfortunately, preferential treatment is the norm. When an off-duty police officer gets stopped by an on duty police officer, the first thing they say is I am an off duty police officer. They do this because they want the “club member” treatment rather than the general public demeaning treatment. Also, how thorough was the initial background check and interview with this department? If he was fired from another department, it should have been a red flag.

Why does the police force have so much information on its citizens? Social Security numbers? The system is asking to be abused. I believe the country needs to reevaluate what it means to protect and serve because a police officer should not be above the law and when found to have broken the law should be charged more than not less than a citizen. I believe this because in most cases the officer knows they are breaking the law where the citizen may not. I know ignorance of the law is no excuse but we charge and convict to fix or punish so when they get out they will not do that action again but if that person did not know they were breaking the law we should consider leniency. Police should be charged with the belief they knew it was unlawful.

When I was 19 back in 1988, I worked a part time job with a young lady who had a crush on me. I was friendly with her but wasn't interested in her. She had a second part time job as a clerk at a police station. One day, she tried to impress me by telling me she knew my address and how many traffic citations I had on my driving record. When I asked her how she knew all that, she told me she ran my car's licence plate through the police computer. It was an unbelievable experience for me. I quit that job because of it. I guess access to the police database wasn't taken as serious in the 1980s as it is today.
