Vince, I love your guest and her DEI example about interviewing the black guy from the south side of Chicago AND the white frat bro. She totally gets it. That is exactly what DEI was about...casting a wide net to consider / reconsider / re-imagine the talent pool. This would discourage hiring managers from automatically ruling out the person from the lesser-known school or the person who lacked connections etc. That stated, DEI practitioners are not blameless in its demise, and I wrote a comment about that in response to your video from yesterday. Happy Sunday Vince! I currently have a charge in investigation with EEOC for discrimination and retaliation. My case is a “failure to promote”. The hiring manager edited my resume, reduced my years of experience from 20 to 15. I have the documentation to prove this. Can I sue the hiring manager personally for fraud? Would it affect my EEOC case? Thank you for your time in advance!

We do handle cases in all 50 U.S. States, but I always suggest you check your local options first. Local options tend to be cheaper because they are probably not flying attorneys around the country like our firm does.

Could you please make a video about the latest accommodation lawsuit against Wells Fargo and how that affects employees and case law? 2024 Wells Fargo was ordered to pay $22.1 million due to failure to accommodate using work from home... there have been 2 lawsuits against Wells Fargo for Accommodations and Telework, and they lost both.... how does this affect us employees looking for an Accommodation, and how does it affect case law?.... Billesdon v. Wells Fargo Securities and Arbuckle vs Wells Fargo.. What happened? Billesdon requested work-from-home accommodations after pandemic restrictions ended, but his managers refused and terminated him. What was the outcome? The jury awarded Billesdon $22.1 million in compensatory and punitive damages. What does this case mean? This case serves as a warning to employers that they must take ADA accommodation requests seriously.

IMHO I think the law is such that it is applied on a case by case basis. Wells Fargo is a huge corporation. I think if you look at guidelines for small businesses it might be different. I think the word reasonable accomadations might be key. Define reasonable for a business of that size and scope.

@studentaccount4354 Yes i agree, but case law ( similarly situated cases) sets precedence. In my research a lot of judges require case law when filing (especially for summary judgment) to back up your claims and rebuttals.... Case law precedent is important because it provides a consistent and predictable application of the law by ensuring that courts follow previous decisions in similar cases, thereby treating people in similar situations alike, and promoting fairness and stability within the legal system, all based on the principle of "stare decisis" (let the decision stand).
