Professor Dato P. Balan stands apart as an exceptional law educator, surpassing all others in his unwavering zeal for the law, deep commitment to principles like the Separation of Powers and the Rule of Law, and his consistent emphasis on the value of unvarnished truth.
Upon completing my Law Degree, my aspirations were aimed at the Bar. Yet, constrained by financial limitations, the poignant decision to return to Malaysia for the Certificate in Legal Practice (CLP) had to be made. While the initial lectures appeared subpar compared to the standards set elsewhere, a pivotal experience was in store. The anticipation of the Civil Procedure lecture was coupled with a colleague's stern warning against tardiness under the watchful eye of the lecturer.
At the appointed hour, an unassuming ethnic Indian figure entered the lecture hall. His voice, a harmonious blend of authority and approachability, cut through the room. Commencing with the impactful analogy that "Civil Procedure is to legal practice as is the vertebra to the human body," his words held weight. His conviction was tangible as he proclaimed, "Learn it well. With it, unaided and alone, you can defeat the most powerful case against you." This declaration, accentuated by a sweeping arm gesture, underscored the dire consequences of neglecting this essential facet of legal practice.
Professor Balan's pedagogy was a fusion of storytelling and instruction. He demystified complex cases, offering practical insights into pitfalls to evade and strategies to adopt. His lectures were imbued with historical context, revealing the evolution of law over centuries. This approach went beyond mere instruction, unraveling the intricacies of cases and demonstrating the inadequacies that had persisted for centuries. The House of Lords' interventions and the House of Commons' legislative actions to address these shortcomings were dissected with intellectual rigor. His wit was a potent tool, capable of both humor and gravity, leaving students both amused and enlightened.
Beyond the classroom, Professor Balan's influence extended. His tenure as the Dean of the UM Law Faculty from 1988 marked an era of growth. His prolific writing, encompassing numerous academic papers, established his reputation as a critical thinker. His legacy was affirmed by the multitude of legal practitioners at the Bar who speak of him with deep reverence, reflecting his impact on their careers.
Professor Dato P. Balan, alongside two others, reinstated my faith in Malaysian law educators. His dedication to the law and legal education remains unparalleled. Good One GK, it reminds me of my days in Primary school as a Marching Captain. Our school is a former Missionary school, and it was the last bastion of Catholic school in Penampang run by Catholic Nuns ,group before full blown Malaysian Education take over. So it is under funded but we have great teachers and passionate ones. I was selected to be the Captain of the marching team and we are about to compete a district level marching competition. We are facing well funded Chinese school in the district and Sekolah Kebangsaan, David vs Goliath one might say. We practice our drills, command in any time we get. The Nuns knows what we are up against, and only by hardwork, consistency and drills, no matter who wins the competition we are the winner in the eyes of our educator. Sure enough just like the age old story, we won. "By the Command, start March!".
