If the original dealer has collected and spent the insurance reimbursement money. Then this matter can be settled in court between the second dealership and the present owner of the car. The second dealership regardless resold stolen property knowingly or unknowingly. That is why you have business insurance for such events. The present owner either gets to keep the car or receives a full refund. No need to keep posting alter media scenarios. Obviously this matter should only be between the second dealership and their own insurance company.

They have probably done this to others who didn't have the energy or knowledge to navigate the small claims court process. The dealer is required to have a bond, if something like this happens and they don’t pay up The customer can go after their bond or insurance. The dealership, on the other hand, must guarantee that it can legally sell the car when it sells a car (warranty of title). So legally, the dealership is responsible. The dealership knows this but tried to avoid its responsibility.

The state is liable. The dealership went through the legal process to buy the car in the state of Georgia. You can not register and tag a vehicle without state approval. There needed to be a form of car insurance on the vehicle and the insurance company verifies info from the states motor vehicle system. The state failed.

It's the state's fault. George is liable. Think about it in all states you have to go through the state's government to own and drive a car on the road. Car insurance companies verify information with state governments. The state actually failed. The dealer was able to register and insure the vehicle, without red flags.

In the end they forced the family to small claims court and lost. Not a good look for the business, because now they have a judgment against them instead of just doing the right thing.

If the customer is inconvenienced, loses his car, and is being harassed by the dealership's financing company, then the dealership did not do everything right. The dealership got to the find out stage once the court ruled and found it liable. The dealership had to pay $4,500.00 as ruled by the court because the dealership is shady, predatory, and dishonest. I'm glad the young man was made whole. I hope people avoid that dealership and post negative reviews until it goes out of business.

Thank you, Wells Fargo is very shady, I worked for them and they said they were so diverse and their people were very racist, one girl that was mexican, she was 21 and the white girls would make comments about tacos and burritos and she just laughed with them, not even realizing what they were doing. She said well "My mother is 1/2 white and my dad is mexican" I just said, "Girl, you have a lot to learn" I quit right after that. The manager did not want me to go and wanted me to not say anything about this, she allowed this to go on, I went back to visit AFTER I graduated and found out that she had died of cancer and all the tellers were fired for racist comments and then they close the entire bank.

It’s not the buyers responsibility to verify the legitimacy of the vehicle they put up for sale and if if they were scammed as a business it’s their problem to sue where ever they got the car from or file a insurance claim on their business insurance. The issue is that the bad ones are protected by the system with qualified immunity, lower sentences if they even get any, or the classic relieved of their duties only to be hired at another precinct.

As a former car salesman, I agree. There's a chance the dealership unknowingly bought a stolen car and got scammed. If this is the case, they still knowingly sold a stolen car, passing the scam onto the buyer. The more likely scenario is they acquired the car very cheaply, knowing it was stolen and made a huge profit by flat-out scamming the buyer. When they're eventually caught, they claim ignorance, hoping enough time has passed to try to shift the blame. This dealer is likely under investigation after this news story. At the very least, they won't be able to scam anyone else for a while because they know they're being watched. The reporter should have asked the dealer where they got the car from.

This particular story just showed up randomly in my "side bar" on YT...so I clicked on it, of course. By the end my eyes were welling up w/tears. I am SO happy that this young man was able to get this resolved, not *only* thru Wells Fargo financing, *BUT* also thru the local Courts when he won judgement *for him* and AGAINST the dealership and awarded judgement for $4,500 too!!! Because, as the new broadcasters were saying on air.....THIS could've ended up soooo tragically for this young man & his family. And strangely, many of us watching this probably never thought that "a legitimately & LEGALLY purchased vehicle" from a DEALERSHIP *could be* a stolen vehicle.....now we know..... that IT CAN HAPPEN TO ANYONE....

Sounds like the dealership does this to scam people. Hide a "stolen" car. Make a report. Sell the car. Then lead police right to the vehicle. After they been paying on it for 1-2 years. They need to do an investigation on these dealerships, especially if they report cars stolen.

I had this happen a few years ago to my mother. My husband and I bought a car from a car lot and then sold it to my mom. When she went to register it, my husband and I didn't have it long enough to do it, it came back as a stolen car. Man was my mom pissed,we gave her back her money and then we sued the car lot and dealer and got our money back.

While you can legally register a car in Georgia without an attached title, you cannot legally sell it. Evolution Cars had no right to the customer’s payments in this case. This does not prevent Evolution from seeking damages from the Ohio dealership from whom they purchased the car.

@@jackm3040 - Vehicle ownership is determined by a valid title. It doesn’t matter what due diligence is performed, what database the vehicle is listed or not listed in, or valid vehicle registration. Evolution Car, Wells Fargo, and the customer may ALL be victims in this case. I believe it is highly likely the car WAS Stolen. The police came for it because it WAS reported stolen. Evolution purchased the car from a dealer in Ohio who likely sold the vehicle with a counterfeit title. Evolution may have believed the title to be valid and sold the car to Wells Fargo, who provided the auto loan to the customer and also did not detect the title was fraudulent. At some point, someone determined there were 2 titles for the same VIN#. The owner of the older title had reported the vehicle stolen, and the more recent title was determined to be a fraud. By selling the vehicle to Wells Fargo, Evolution legally implied their title was valid. This was not the case, and Evolution had no legal right to sell the car. It doesn’t matter what Evolution believed or what due diligence they performed. They are responsible to return the money to Wells Fargo and the car must be returned to its rightful owner. Evolution can seek damages from the Ohio dealer (as I stated in my reply to @Jeremy S), who also had no legal right to sell the car. However, I’d suspect that Ohio dealer is long gone with Evolution’s money if that was the case.

I once got charged for unauthorized use of a motor vehicle(a felony) for a scooter I had purchased, registered, and insured under my name. I bought it from an individual who bought it from an auction and had done all his necessary due diligence. That auction he purchased it from turned out to be the police impound auction. I've seen this happen before. That is someone bought a stolen vehicle and yet was able to get the car registered and tagged without any red flags during the process. The incident I witnessed an officer working the stolen car recovery task force saw the vehicle and stopped just to check it out. At the time the particular vehicle was one of the hottest stolen vehicles according to the officer and he told me that anytime he sees one he checks them out regardless. The poor guy who bought the thing dropped it off to us to have some work done to it and we had finished the vehicle and pulled it around front for him to pickup later. I saw the plain clothed officer out front going top to bottom on this vehicle and I walked out there to ask this guy what the hell did he think he was doing to one of our customer's vehicles! I was soon pulling the vehicle around back again so that the officer could go over the vehicle in more detail without having to worry about a suspect walking up on him. The officer soon discovered that the engine numbers had been removed and the vehicle was impounded! When the guy who owned it (at least thought he did) came to pick it up that's when he was informed that the vehicle had been impounded for being a stolen vehicle. The officer didn't arrest him. As the story goes from the suspect he answered an add in the paper (yes this is how we did things back then) for the vehicle and it was only $11,000. At the time it must have been worth at least $23,000 or more! So the guy selling it gave him a song and dance about a hardship and needing quick cash to take care of his problems. Well our suspect aka buyer smelled blood in the water and told us how he talked the guy down to $3500.00!!! Keep in mind he doesn't know the vehicle is stolen. This dude thought he was getting a $23,000 vehicle from a desperate person for just $3500.00!!!! LOL At first before knowing that he had talked the desperate seller down to a ridiculous lower price I actually felt sorry for him. But after hearing the story I didn't feel that way anymore. I felt like a heartless prick trying to take advantage of another human being got what he deserved.

THat's a HUGE NO-NO, and that probably isn't the only car on that lot without a clean title. Be careful of those "fly by night" dealerships, I've had run-ins with them and they're looking for SUCKERS with no experience to swindle for every single penny.

Thank goodness that officer had a brain. Not many do. They usually escalate the situation. This officer was calm, patient, received all the information and made an informed decision. That is rare these days. I can acknowledge a good officer when I see one. Hats off to him. Now that dealership.. the nerve of that guy.”I see what you are trying to say.” You mean the truth?
