(44) In 2007, wildlife photographer David Slater was photographing monkeys in Indonesia. He left a camera by a monkey named Naruto who grabbed it and took some selfies of himself as he smiled into the camera. The photos later went viral. David Slater published the photos in a wildlife book but was sued by the monkey for copyright infringement. This video will discuss the interplay between non-humans and copyright law as well as what it takes to represent animals before the federal courts.

4:31 Mr. Ferrell, I think you should mention that in your hypothetical "hacked phone" case. The photo can violate your personality rights even though the photo would be uncopyrightable. You can still request other people to take down the photo from the Internet when it has your face illegally photographed.

Wow! Shocking implication that a hack could provide legal protections to them of Your Camera’s footage! Great video very educational as always, and thanks for the free book!

I see a new video by John, I click like!! I got a question about something IP related. If I want to sell a CUSTOMISED product - example say a custom replacement part for an already existing product. Let's say it's a note book.. the part is made out of aluminiuim.. but I want to add some flair to the product and have a slim wood veener produced to the original dimensions to replace the aluminium part. Or have a carbon fibre veneer/fascia to replace it. Do you think I'd get into any legal trouble if I sold the covers by itself? or if I sold the whole part with the updated replacement veneer/fascia attached to it? Thanks.. and that monkey takes some good pictures!!

@Cyber, thank you for your comment. I am a little suspicious of the monkey photos, and have to think Naruto may have had some help.

@Cyber, the answer to your question may be a bit fact specific. However, so long as the original article is not itself protected by patent, there should be no problem with making and selling a replacement item. This happens with aftermarket car parts all the time. For example I own a very old British SUV and it's possible to buy a variety of aftermarket bits and pieces to pimp out the inside of the vehicle. Let me know if this answers your question. Hopefully, you're moving forward on your new idea. Good luck with this. 😊. -John

@@johnferrellesq. Hey John!! Thanks for the reply!! The actual product is NOT a notebook, I was using it as an example. But it is a particular ' minimalist' modern wallet that is the size of a credit card. There are heaps of copies/knock offs sold on Amazon/Ebay/Etsy. And most of these come from the same factory but with different names. The only difference is the cover having different type of material(alumiunium, carbon fiber, titanium, steel). Hmmm British SUV?? sounds like a Land Rover.. I prefer those better than the new land drovers :-)

Yo got to talk faster John an don’t have to pause after every word! Otherwise I can’t listen! I am trying but it is very annoying. I would love to see more videos.

@jeacalin, Too funny! I grew up in Texas and I guess that's just the way we talk there. 😊 Perhaps, try turning up the video speed to 2X and I will sound more normal. Or better yet, maybe you could watch two of my videos at once and you can get twice as much content for the same amount of time. Anyway, thank you for trying and for leaving a comment. Warmest wishes. -john

@jeacalin, I went back and rewatched this video, and honestly have to agree with you that my energy could have been a lot better in this one. ☀ What I didn't know at the time of filming this Monkey Video (and had since forgotten) was that later that day I would test positive for Covid. I greatly appreciate your comment, however, and will keep it in mind as I make future videos. Thank you and warm wishes, -john

@@johnferrellesq. it really helps. I watched the video again with 1,5 and 1,75 and you sound very great. I don’t mean it disrespectful but when people talk slow and pause after every word it gives me the goosebumps in a bad way. Like the Kardashians. But they have also the vocal fry what gives me boiling blood. But thanks and continue providing the good work. I will subscribe now!

@@jeacalin I totally, agree. This video is not my best. Aside from talking so slowly my eyes are swollen and red and I kept forgetting the monkey's name. 🥺 I think there was one more video I recorded while I had Covid but mercifully I can't remember which one it was. Anyway, I do appreciate the honest feedback and work every week to get better with my content. Stay healthy. 😊 -john
