The plaintiffs say they had a gas leak at their home, and the scammer defendant, a plumber, took advantage of them. They’re suing for being overcharged. The defendant says he was called out on an emergency job in the middle of the night and he explained his rates. They wanted the heat fixed right away, but now they’re suing a year later.

This reminds me of the joke about the man who had a clogged sink and called the plumber. After the job was completed in about an hour, he was handed a bill for $500. "You're charging $500 an hour to fix my sink? I'm a brain surgeon and I don't make that kind of money!" "I know," replied the plumber. "That's what I used to do."

@@nevermindlaughs While I do find his comment/joke slightly amusing I definitely side with y’all for so many reasons that doesn’t take much common sense to figure out why prices can reach into the hundreds of dollars ESPECIALLY WHEN it’s a job that’s not just being done after hours but when it’s ALSO an emergency. Just an emergency job alone will cost extra for all of the obvious reasons!!!!!!!! Thanks for what you do!!! 👍🏼🙂

Defendant was the only professional willing to leave his own family right before Christmas & come to their house to fix multiple gas leaks....which can be deadly. He works in the cold, finds all the leaks, gets all the correct parts, fixes the leaks, talks the inspector into coming after hours to approve the work so the gas can be turned back on. He had someone helping him so that person would have to be paid holiday/after hours rates also. The judge was right. Defendant was their savior in their time of great need. And $3200 is less than a shady plumber charged me to jackhammer giant holes in my kitchen floor---ruined my floor & caused more leaks. That was over $4000, several years ago. (Edit: And it wasn't deadly. It was just a water leak. And it wasn't a holiday.) Plaintiffs got a bargain, and they have the audacity to sue him.

Plumbers can charge any price because it's a necessity. These people could've saved some money by waiting a few days. Go to a hotel! They kept mentioning their 1 month old. Weren't they afraid of gas fumes??

Plumbers can’t charge whatever they want, there’s a standard in general, but the client side would never be able to keep up with that constantly changing prices in the industry. When people are in crunch time like he said everyone and anyone will beg and plead and then the minute the job is done, the stress is gone, the panic is gone, calmer minds settle, and all of a sudden people change there mind on paying, bye how much it’s worth, maybe it wasn’t done well enough. It’s AMMAZING how quickly people just jump on the first avalible person and just assume they have 0 due diligence in watching jobs completed in there home, documenting, photos, etc etc. It’s your home, it’s a job, there are things you do to protect yourself. One would be price checking, one would be haggling over price, etc etc. the defendant is completely within his rights and this guy should stfu. Depending on the hotel, I doubt the price would work out in there favour, a friends place maybe? A neighbour? He asked for a breakdown after he pays for an emergency service…..after….really?…. This guy sucks

The gas company shut off the gas, so it’s not like there was a broken line constantly pumping gas into the house. This is something that needed to be fixed as soon as possible, having zero heat in a house for a couple days in a freezing winter is not good, even if they went to a hotel to wait for those days. Also, I’m guessing a hotel for a couple nights just south of Boston the few days before Christmas would have crazy high rates, not to mention good luck finding a close enough place that isn’t a total rundown motel that has vacancies. Combined with having to pack for themselves and two very young kids, money to spend for food, hotel and fees, getting a plumber to work right before Christmas, the inspector/license fee, they’d end up paying just the same amount as they did in the first place, or possibly more.

A temporary solution is to use space heaters to warm the house. This would buy you some time to shop for contractor.

I would look for HVAC contractors if I have gas leak. Wonder which type of contractor is cheaper.

They have to be licensed gas fitters in Ontario, Canada, and have a TSSA registration.

plaintiff's first red flag that he's a dope is that instead of calling the fire dept when they smelled gas he calls the gas co. which the fire dept would do anyway. he's a real dumbbell.

I am thankful I can do most of the plumbing myself, but I won't mess with gas. It is a very scary thing to mess with, so I can totally understand the prices.

These are the type of people that make our lives as contractors difficult . If you hire a licensed plumber and have a negative maybe questionable ethics experience call the Contractors license board … other than that pay them and be happy with the work

I'm in Australia, contractors always quote a job here in writing. If there's complications requiring extra work then it's discussed and added on when agree to by both parties. No worries, job done.

Yes, plumber can and do charge enormous amounts. My step dad was a plumber/ pipefitter in the Union. Recently I needed an outside faucet replaced. Cost me $400 for 1 hour of work you just hate to pay but boy do you love the results.

Homeowners are responsible for all of the repairs and maintenance in their homes. This is why it is important to budget and save money for these types of emergencies. Some home insurance policies even help with this.

thats the beauty of being self employed . it costs more because a plumber or other type tradesman is usually self employed and not a hourly worker sent to you from a large corporation . large corporations have not yet found a way to have enough skilled tradesman desperate for work to hire them for 15 bucks an hour but they would if they could .

Why do people have to be “grateful” for getting someone to do their job? Price gauging in emergency cases is wrong. It should be illegal. I think $3k plus to fix a gas leak is unreasonable.

I wish JM would have asked what the plaintiff does for a job, sometimes those that pull in the most, physicians, attorneys etc are the most tight fisted when it comes to paying others for their services. My elder sister was a legal secretary for a few years, and the attorneys in our city paid their secretaries and receptionist chicken feed. She managed to get a better paying job, as a secretary, with benefits elsewhere. Bottom line, it was 'Buyers Remorse'. He was as he said their saviour at the time, their scourge once the house was warm again!

True. I used to work at a call centre for an online retailer and we had a doctor who would call and try and bully us into giving him free stuff. He was an absolute asshole. I actually looked up his name because i didnt believe someone so vile could be working with patients.

I worked in a law firm that was so frigging cheap they even used to charge the clients 2 cents for every sheet of paper that was used in their case. We had to write down under each client's name how many sheets of paper were used on their case daily. Then they would mail the client a monthly bill. For example, one lady received a bill in the mail for 2 cents one month--and it cost the firm 40 cents for a stamp to mail it to her!!

@@jeffreyhathaway2800 Lol i think all firms do that. I used to work for a law firm and i believe we charged 2 cents per sheet as well. I now work for an accounting firm and clients still get charged for most print jobs but i dont think it's per sheet. The law firm was much more stingy though and always on our asses if we forgot to code a 10 cent print job.

@@Lemonade_Stand_ I worked for several law firms over the years and that was the only one that did that (the others probably just included it in the clients' final bill somehow). They used to spend more in postage--imagine spending 40 cents (the stamp price then) to get their 2 cents! Clients would complain because they didn't want to buy a 40 cent stamp just to mail two pennies back!!

I had a plumber in Massachusetts when my heating on demand system shut down in a winter storm. He came down at 6:00 AM shoveled a path to my heat air intake vents which were clogged with ice. And he didn't charge me a dime. Been using him for jobs at a reasonable price ever since.

I moved into a house and the shower was dripping water. I was charged $650 for the plumber to fix it. I thought that was high, but was so happy that the dripping stopped. Thank God for plumbers and electricians.

These Plaintiff's are terrible litigants. I was on the Defendant's side the whole time- he has every right to charge what he wants and if the Plaintiff's couldn't get anyone else there- that's on them.

I live in Boston...Massachusetts Attorney General fined several plumbers and heating companies in 2021 and 2022 for overcharging and price gouging consumers--paid thousands in fine

He might've been able to complain to department of consumer protection/affairs on the grounds of predatory pricing. That the guy had him over a barrel because he refused to give the estimate once the work already began and by then he couldn't stop him from completing the job. He would've had to call the cops at that point to throw him out of the house basically.

I'm a MA resident (without the ugly accent because I'm not originally from here😂)..I can tell you the reason the defendant charged $300/hr was because it was an emergency call plus inclement weather. Usually emergency calls can double or even triple in costs because people are typically willing to pay outrageous prices when their hands are tied. Not saying people can't charge what they want, especially independent contractors, but someone should have discussed the rate before getting so deep into it. This falls on the plaintiff. I assume the reason he didn't ask is because in the moment it didn't matter. Sounds like others told him he overpaid and now he's got "buyer's remorse."

All service businesses have a math they use to set service pricing. And after hours and emergencies are extra. Because now your emergency becomes our emergency to work extra hours. Its not a rip off. Its business. Why should the worker work overtime for regular hourly pay?

I had a customer stop me in their driveway. I was about to do some vinyl siding repair. She said the neighbor across the street has someone fixing her siding for a third of my price.... I started to pack up and leave. My price is my price. I wasn't about to do it that cheap. Then, a scooter dragging vinyl siding tied to a rope tied to the back of the scooter pulled around the corner and to the neighbors house. It was perfect timing, lol. She, of course, rehired me all went well.

It would have cost them a lot more, if they hadn't found someone who could come out straight away, as they would have had to stay in a hotel AND then pay a plumber to solve the problem, which could have taken days. They are just being totally ungrateful...

This even happens with some commercial customers as well... they are happy to get you out to do the work... they sign your service ticket knowing all the hours you charged, and then they haggle you and don't want to pay the bill months later. I'm a contractor... I know....

Really good case. I do understand their frustration, they paid $500 for a permit that was not requested. However, they should have asked questions there before paying the rest of the check.

They legally had to have a permit. Most city’s require that. It is so the city can go out and check out the plumbing repair to make sure the house is correct for the gas to be turned back on so it doesn’t blow up.

Even at the end he’s crying about being charged for the permit that was taken off the bill. The plumber was able to skip that step because his repair was an emergency. The plumber reduced his charge by $500 because he didn’t get the permit. Doesn’t he realize that was a blessing, getting a permit would have taken more time. 🤦🏽‍♀️

He didn't reduce the charge, the total bill was $3,200, the $500 was technically a deposit to get the ball rolling so that $500 was taken off of the total bill leaving an unpaid balance of $2,700. The guy thought the $500 was strictly to file a permit, but it was really a deposit for the plumber to start the work which I'm sure he told him he would have to file a permit first and the customer misunderstood.

It's simple, ask what the call-out fee will be and then when he's seen the work that will be involved, ask for a quote, if you don't like it, pay his call-out fee and find someone else.

Although I agree in theory, there is something called price gouging and there are laws against that. I think the plumber definitely took advantage of the guy because he was desperate. The plumber should have been able to tell him what his hourly rate was before he even started and he didn't do that.

I got a complaint once over the cost of an emergency repair from the customer's father because I charged his daughter $100 to replace the battery in her car. I said "sir, I way undercharged her. I went to the store where she and your grandchildren were stranded, I started her car and followed them home, went to the store for a new battery, then installed it. At best I made $30/hr. while having to postpone dinner 'till almost 9pm; how many professionals do you know that would do that? He thought she'd brought the car to me and I had ripped her off, he apologized, thanked me, and sent me another hundred.

Plumbers are expensive, double time after hours and weekends. I had a section of cast iron pipe removed during normal hours due to rust. $800 for 3 hours work.

People also think being a plumber is beneath them. If it isnt a pretty job, or something that requires a degree, people don't feel like they deserve to be paid well.

Plumbing rates are ridiculous. But you call them when you absolutely need them. They become the big D in the house, while they're there. But on a serious note, get a trade kids - you'll be far happier and more wealthy.

If a plumber or oil company is called after hours theres always an inflated price for it....trust me we got charged an extra amount of cost to fix our oil furnace but after they looked at their records my furnace wasnt cleaned correctly and i got a free trip for that night....especially after the guy who was the owner of the company slammed my front door and knocked stuff off the walls and cracked my living room window on that side....He also woke up both kids which wasnt a pleasant thing to do....

In an emergency situation that may be after hours, who is going to have the time to call the plumber's board? They should have honestly asked for an estimated price at least after they found the leaks. Most likely with their situation they would've had him fix it anyway, but at least they would've had an opportunity to object to that price. The plumber was also unprofessional not sending them an invoice. He had their money and I'm sure he felt no obligation to give them anymore of his time, but it could've saved him from having to appear in court. I'm surprised he didn't countersue them a couple thousand to appear.

Why wouldn't he be. He isn't a thief. Licensed plumbers get paid very well, because they deserve to be paid well for a job professionally and well done - especially during emergencies, holidays and after hours.

Plumbers do some gross stuff. They should be paid well for doing the stuff we don’t want to. It requires an apprenticeship it’s manual labor. You want cheap then you wait and be cold.

Nope. We moved into a gut Reno with all new plumbing. Found 5 gas leaks. FYI - women for some reason can smell gas better than men. My wife found the leaks that even the gas co inspector missed.

And we don't have problem with any service taking advantage of people having a serious problem that needs immediate attention. I get having a charge for having to show up, especially after hours, but to take the rate and make it 300 an hour is bullcrap and completely unjustified. Just because you can do something doesn't mean you should!!!!

$300/hr × 40 hrs a week = $12,000 That's $624,000/year JM gets paid EIGHT MILLION DOLLARS/year. Kind of insulting that she said "We're all in the wrong business" when the plumber said how much he charges.

I agree that it sucks when one has a plumbing issue as it costs a lot...just like if something goes wrong with your car and you have to take it to the repair shop..it is the same if you have to call an electrician to your house...cost of everything is sky high. We can just pray that nothing breaks down in our homes. The plumber came out in the hour of need and fixed everything, and what I find an issue here is when the plaintilff says something along the lines of "at this point i wanted him (plumber) out of the house". Plaintiff was so grateful to have the plumber there for most of the day fixing his problem, and as soon job was done and payment was required, he got anxious about the plumber and wanted him out of the house as if the plumber had turned into a dangerous person. REALLY! This is sad thing about us humans..as soon as we don't need the other person..he becomes a threat when he asked for his payment. If someone haggles with you after you spent the whole day fixing their problem, it can get annoying.

My soon to be ex is a plumber, if you call him on off hours, it will cost you. Best to get hotel, turn off gas. Never, never, never, crank up heat. Common sense. Let's blow up house too. 😩
