A Total Car Disaster

The plaintiff admits she does not know the defendant. She says her car broke down on the side of the highway and she left it to go buy a new battery. The plaintiff says her car wasn’t there when she returned and found out it was totaled, allegedly by the defendant. She’s suing for balance on a car. The defendant says the accident is the plaintiff’s fault because she left her car. He’s countersuing for defamation.

There is a minimum amount of insurance you need on a car for public liability and Public damage..PL and PD. You do not need "full coverage". The only people who may require that, would be the people who have the title to your car. The people you are paying for it.

If a law says you may not drive a vehicle without insurance....does that apply to a vehicle "parked" alongside the road way in the proper area? Nobody could say how it got there. Maybe it was towed. When it comes to "legal" stuff, you can't "assume anything". Yes she admitted to driving it there...but she wasn't driving it at the time of the accident. That is a possible way she got out of it.
