Stop raising rents to good tenants !!!!! My landlord just raised my rent 10 percent. I would fix everything myself and never was late.

@@WIREassociates Hi there! Thanks for making this video! :) I have a few questions for you, if you don’t mind and have a moment to spare? I would be ever so grateful! I live in Southern California and I just got a notice from my landlord to raise my rent by 28%! They want to raise it by $455 more a month! I did _NOT_ receive any exemption notice for the tenant protection act of 2019. I spoke with a neighbor that has the same floor plan as me, and she even has air conditioning, whereas I don’t, and she only got a 10% raise. The difference between us is that I am renting there with a section 8 voucher, and I know for a fact that the management company that took over a few years ago in 2016 absolutely hates section 8, as they initially tried to evict me _ONLY_ because of me being on that program (I was only allowed to stay because I was resourceful enough to be able to track down the phone number of the owner himself and begged him to stay - he allowed me to stay, but the management company was so vindictive that they raised my rent by hundreds of dollars and I had to then beg them to not raise it so severely because the government wasn’t going to cover such a high rent amount - that owner is now dead and nobody has contact information or even knows the name of who owns the apartment complex now). Are people who are in the section 8 program exempt from the tenant protection act of 2019? I read something about affordable housing places/owners that have contracts with the government are exempt - but there’s nobody else in our 40 unit apartment complex that has section 8 besides myself… It is _NOT_ an affordable housing complex. Rent at our complex is WAY more expensive than the places that are considered affordable housing. Along with the notice to raise my rent, they included documentation from the city about the fact that there is a tenant/owner mediation organization available for me to contact if I have any issues, and when reading it, it almost seems like the city council voted to not implement/enforce the tenant protection act 2019 regarding rent increases, and made an ordinance about that fact, saying that they will simply provide a mediation process instead… Can they actually legally do that? Just ignore such a law? Isn’t that law supposed to apply to every county in the state, unless they have their own rent control law going on? Also, last question: If I learned that they are indeed breaking the law by wanting to raise my rent by 28%, how would I go about figuring out what the correct max rent raise percentage amount is that is legally allowed, because that requires knowing what the city CPI/cost-of-living percentage increase is (5% + cost of living/CPI)? Does the law say that they want the percentage CPI increase for the previous 12 months? Or the amount of months since the last rent increase (my last rent raise went into effect on January of this year, 2022, and they gave me this notice on November 2nd, but the rent raise won’t go into effect until February 1, 2023). The law refers to the CPI percentage figure being your “regional“ figure, so I don’t even know if they mean city or county or state or what. When I called city hall, they had no idea what our city or county CPI percentage figure is or where to find it. Many thanks in advance if you can help me at all on this matter. I hope you will be able to answer back soon, because they didn’t even give me much time at all to respond to them about this (even though it doesn’t go into effect until February 1, they said I have seven days from the date of the notice to respond if I have any issues, and of course they wrote a date on the letter that was four days before they actually clipped it to my door, and 5 days before I got it in the mail lol). It’s beyond stressful, because I am pretty confident that the government will not cover such an enormous rent amount. So I wouldn’t be able to afford living here anymore because the portion I pay would go up so much, and I am already struggling so much that I had to turn off my landline and Internet. : / Hope you are doing well!

Landlord raised rent by more than 10%. She gave me a 30 day noticed, and I pointed out that it had to be a 90 day noticed. She corrected it appropriately but increased it by $50 more on top of the $150, originally rent increased. I questioned the legality of that, and now she has expressed that if I don't pay the $200 she won't accept my rent. I live in the unincorporated area of Los Angeles. Can you provide any info on this matter.

LA city has a different relocation assistance depending upon how long you lived there and your income level. LA city can be up to 22,000

Thank you, there is so much misinformation out there on the internet, one of them being, that a condo or SFR is only exempt if is owner occupied. Some sites say the same as you, but others do not. It was getting confusing. I own 2 rentals neither is owner occupied, and Solely owned by my husband and I. Was thrilled to find out that we are exempt AND had no tenants or renewals since 2019/Jan 2020. We also haven't raised their rent or asked them to leave, but gosh, I like knowing that can do either and not have to comply with AB1482

As long as you give them the exemption language, you're good to go! (And as long as there isn't a local rent control or just cause eviction ordinance).

This is good information. I have a single family residence rented so it’s exempt from the AB 1482 right. I gave a notice to move to my tenants which they totally ignored and just gave me this AB1482 papers where they said they didn’t have to move and I had to pay them relocation $$$$$. Which now I know it doesn’t apply to my case . They haven’t kept up with the house as specified in the contract.

The AB 1482 exemption only applies to exempt properties IF the exemption notice is given, i.e. you needed to give them the AB 1482 paperwork saying that the property is exempt. But, if you're going to evict for them violating terms of the lease, then AB 1482 doesn't matter because this is an "at fault" reason to evict.

I beileve o read in the law that depending on the number of units on the property. So, if there are four units or more, the landlord must ask the most recent tenant to move. No matter what size the unit may. (Similar to "last one hired, first one fired.)

Hi there as always thank you for your very informative videos. Question how to be prepared for la city inspection when they saying all units will be inspected . Also as a on site property manager what are considered emergencies that I need to attend to when out my office hours.

Thanks for the information. So 2019 we moved in one of our church member single family.I believe this single family home is in a trust and once her daughter use to live in this home. So 6months ago the daughter of the church member took over interms of dealing with any repairs and sending the rent checks to her instead going through the mother. We have no lease and haven’t had one since we moved in and in October of this year she wants to raise the rent to market value we pay 1400 now market value could be 2.5x what we are paying now. What do should we do

If you were not given a Tenant Protection Act exemption notice, then this is probably not a valid increase...discuss with an attorney ASAP.

@@WIREassociates Oh no. I renewed their lease the end of 2021-before knowing about this requirement. That means there has been a renewal after the deadline... is the exemption considered lost forever?

I've read through the entire act several times but cannot find an answer to whether or not a tenant has to be month-to-month before giving a no-fault just cause termination. I will be taking over a property with a tenant on an auto yearly renewal tenancy (that has been in effect since 2015). Can I give a no-fault just cause notice if they're not month-to-month?

Discuss with an attorney before taking over the property. The lease should have a provision for terminating the tenancy.

Hi Christian. Just found your channel and love how informative and helpful you are. You've helped me understand a lot of confusing info! I have a situation I am hoping you can help with. My parents own a duplex in Riverside county. They live in 1 unit and tenants occupy the other unit. My parents moved in in March of this year and the tenants have been living in the other unit for about 4 years. Would my parents still be exempt from AB 1482 even though they just moved in this year? The property is in my parents name, not under a corp. We are hoping to raise the rent from $1600/mo to $2000/mo but aren't completely sure if we are exempt. Any help would be appreciated.

Hi Vanessa, thanks for watching! You'll need to run that one by an attorney (these ones can give guidance on this as well 👉 www.wireassociates.com/eviction-attorney/). It's unlikely it applies in this case because your parents were not owner occupants at the beginning of the tenancy. Here's what the law says, a duplex is exempt "...in which the owner occupied one of the units as the owner’s principal place of residence at the beginning of the tenancy, so long as the owner continues in occupancy."

Good question! There's at least one attorney I know who says that if a property is less than 15 years old, then the exemption form isn't required. I'd still give the notice of exemption as there is no downside.

Hi Christian, thanks for making this informative video. I have a question about this law. Me and my girlfriend just start looking for homes to live in and find a potential duplex. The owner/fmaily trust occopied on unit but just passed away. And there is tenant occupied another unit which is under rent control. Am i able to buy this house and raise the rent or evict the existing tenant? Thanks!

It will depend on where the property is located, for example, if in LA, then no you can't get the other tenant out (easily). Other areas, you could terminate the tenancy to do a major remodel.

Yes, most likely. Not for the new ADU because it's less than 15 years old, but for the main structure. Discuss with an attorney.

You said that single family homes, condos, and owner occupied duplex, as well as properties 15 years old or newer, are exempt…but then you state “A summary of properties subject would be any residential non owner occupied duplex or bigger in the state of California”, which doesn’t make mention of a property’s age?

That's correct, the age still matters. TBH, the vast majority of rental housing stock in California is over 15 years old.

Thank you! My question is, with this in place, how much can they increase your security deposit when you’ve been living in the apartment for over 8 years and have already paid what was asked, which was solely one months worth, when you moved in?

Maximum security deposit is two times monthly rent for an unfurnished unit in California. They could increase it to that.

So you have recommended some website to me which I have done and also called many attorneys, which will not give advice without acquisition or consultation fee… My main question is in El Dorado County, it looks like a relocation fee is owed if you request a tenant who has been there for many years to move due to a family member moving in or remodeling which is the two reasons I received. Do you happen to have a computer where you can check relocation fees per county? I tried to look up El Dorado and pulled a site but the site also quotes Sonoma County

I don't have a website for EL Dorado relocation fees. If there isn't a local regulation requiring higher fees, then it defaults to one month's rent.

Give the tenant their walking papers, pay them the relocation fee, and get rid of the charity..... I mean PROPERTY. You will be much better off financially. I believe it's still legal to sell rental property in LA.

If I understand this correctly regarding a single-family residence that is exempt from rent control I heard you say that the landlord can raise the rent above 10% that there is no cap. Did I understand that correctly? So my landlord can raise my rent in San Bernardino county in a SFR let’s say 20% and there’s nothing stopping him from doing so, is that correct?

That's correct, if exempt from AB 1482, a landlord is not capped on rent increases and could theoretically raise rent 20% on a month-to-month tenant. There are anti-price gouging regulations in place during certain emergencies, but that 's another discussion.

Hi Christian, My landlord never gave me an exemption notice until it was on a 60 day notice that doesn’t have any reason for termination. And in the notice, it only has paragraph that says rent caps and just cause doesn’t apply to the property. Doesn’t go into the exemption law and my knowledge by signature. I’m being told, because it’s on there that it’s binding and I’m not entitled to have a just cause termination and I’m not entitled to relocation assistance. In your opinion, is that valid? Thank you in advance if you’re able to reply. Your videos are very helpful with so much confusion in the world.

Does it have the legal language printed on it, i.e. the paragraph from the law? I personally feel like the AB 1482 disclosure should have been delivered before, not at the same time, but the attorney will help sort it out.

Thanks Christian this is very helpful. However It would be more comprehensive to mention that after giving the 1482 there's a 30-day waiting period, and what landlords cannot do during the 30-day period.

@@WIREassociates no, it's to notify tenant re 1482 exemption. After landlord gives tenant the 1482 exemption there's a 30 days waiting period.

@@shereew Haven't come across that, TBH, but whatever your attorney advises. That sounds like it's related to 30 day change in terms of tenancy to an existing tenant...I could see a strict interpretation for an existing tenant that 30 days would be required, but haven't seen it enforced in recent deals I've worked on.

Hi Christian - hoping you can answer a question for me or point me towards someone who can... I've been renting my unit here in LA for over 9 years. A few months ago a city inspector was called by another tenant in the building to after requests for repairs went unanswered. The inspector cited the following; 1. Missing certificate of occupancy for 13 studios 2. hazardous wiring 3. hazardous plumbing 4. missing fire suppression system 5. missing exits 6. unmaintained roof. A few weeks later another resident and I were served 30-day eviction notices. We were both current on rent. The LA RSO office then sent building owner a letter nullifying their eviction, as it was illegal, and sent us a copy of the letter. A week later we received notice from the landlord that the evictions were being rescinded. I'm not sure how to proceed here - the landlord doesn't have a cert. of occupancy, and hasn't had one for at least 9 years. Are they allowed to continue to ask for/collect rent from me? Thanks

Hi Question: At what point does it become harassment with how many times the landlord is showing the property to sell. It has been ongoing for a great length of time with no offers excepted. Just seems like it's gonna go on forever without any outcome. They are scheduling three times a week and is a big inconvenience for the family household. What can we do to protect our privacy and rental status/rights/safety !? Thanks for your time. Have a great day.

If they are legitimate showings and you're given proper legal notice, then it can't really be considered harassment, but you should discuss with an attorney if you have reason to suspect otherwise. I've read some comments online (and maybe also heard it here?) that the no-fault just cause reason of withdrawing from the rental market can't be used if you are withdrawing it because you want to sell the property. Is this true? If so, why aren't you allowed to terminate a tenancy if you no longer want to deal with renting the property and just want to sell it and get rid of it? My landlord broke the lease when almost 8 months still to go or in 4months we had signed lease and moved in.. he wanted to sale the house, and he paid me two months rent as compensation .. but on last he mentioned that he will charge me cleaning fees and paint repairs.. i was bit hesitant as i used house for 4 months and leaving because of him .. is there way i can push back on charging for those things..

Yes, you can. You can take him to small claims court and attempt to get the money back. He's lucky you let him off the hook for the lease...technically you could have said no to a buyout.

I recently discovered that the apartment complex I live in does not and has never registered for a Certificate of Occupancy. I am currently in the process of filing a Breach of Contract claim - Oct. 2021 Does this mean that the rental/lease agreement is void? Do you assist tenants in these situations or just landlords? Thank you for sharing - GREAT INFORMATION! The only documentation I have ever signed was the initial rental/lease agreement; but have received several "Changes in tenancy" / "rent increases" / "ownership changes" - and never signed by the same person. SEC. 91.109. CERTIFICATE OF OCCUPANCY. 91.109.1. Certificate Required. In order to safeguard life and limb, health, property and public welfare, every building or structure and every trailer park shall conform to the construction requirements for the subgroup occupancy to be housed therein, or for the use to which the building or structure or trailer park is to be put, as set forth in this article. No building or structure or portion thereof and no trailer park or portion thereof shall be used or occupied until a Certificate of Occupancy has been issued thereof. EXCEPTIONS: 1. Unless it is specifically required by other provisions of this article, no existing building or portion thereof shall require a Certificate of Occupancy, provided: A. The occupancy housed therein is the same for which the original building permit was issued; and B. The use of a building or portion thereof housing a Group A or E Occupancy and constructed prior to 1934 has not been discontinued for a period of more than six months. 2. No structure, the architecture of which inhibits occupancy, shall require a Certificate of Occupancy. 91.109.2. Change of Occupancy. (Amended by Ord. No. 185,587, Eff. 7/16/18.) Good morning, I own a condo that is exempt from AB1482 and I plan to send my tenant an AB1482 exemption lease addendum. I see that your form has a place for a tenant signature... 1) What if they don't sign the form? Can I sign and mail the form to them or must they sign? 2) I like to use Rocketlawyer for things like this. I fully expect that they will not sign the document. Is that an issue?

Not an issue if the tenant doesn't sign. The law only requires that you provide notice with the appropriate language. Just keep proof that it was properly served to the tenant.

Thank you for the video. I am still kinda of confused. We currently rent a SFR have been for the last 6 years in San Bernardino county. The rent the last two years has been 2600 dollars. The landlord wants to raise the rent to 3300 dollars which is closer to market value. That far exceeds the 10 percent. We also never received any paperwork stating anything about the AB1482. Do I fall into the AB1482 or can the landlord raise it to 3300 ??

Yes, you need to provide the exemption language. You should discuss with an attorney...there's a school of thought that the exemption disclosure should be given and then wait 30 days for the change in terms of tenancy.

The answer is no to this question - "DOES IT MEAN that the single family house owned by individual who does not reside in that house cannot get exemption?" A tenant occupied single family home is exempt if it meets the other requirements. If the owner of an owner occupied home rents out 3 or more bedrooms then they lose the exemption.

Tenant subleased from landlord month to month. Tenant there 1.5 years. Couple months ago notified Tenant they were showing building. Only gave few hours notice until other Tenant said you have to give 24 hr notice. Tenant notified today by landlord owner sold bldg and landlords lease ended on Jan 31 (6 weeks from today). Landlord said new owner might me reaching out for tenants to renew lease without current landlord with possible increase. Home/bldg very old..very old. Not updated at all. No heat provided to anyone other than the landlord apt, which he also sublets. Apts are not on separate gas/heat meters. Can you please provide some guidance here? Unsure if owner is exempt but don't think he is. Can you give best and worst case scenarios here for tenant please? Does tenant have to leave by Jan 31? Is 10% the cap to raise rent? Is there relocation assistance for this type of issue? Not sure of all the questions to ask honestly. Location san francisco. Thank you sooo much!

Discuss with an attorney...doesn't look like it's exempt. If one of the duplexes has its own Assessor Parcel Number (APN) and the owner lives in one side and lived there when the tenant moved in, then most likely that one would be exempt.

While tenants with leases prior to July 2020 are not required to have the notice of exemption in the lease, that notice did have to be provided to them prior to July 2020. Good question and maybe I should do a video on just this point because it is confusing. Of course, I always recommend discussing your scenario with an attorney. If a tenant was in place before July 2020 and the landlord hasn't renewed the lease agreement, then it looks like the exemption notice can be delivered. If the tenant did receive a lease extension after July 2020 and the landlord didn't provide the exemption notice, it's possible that the landlord has lost the exemption and the attorney will clarify.

Take out the explanation for renewed leases for existing tenants...that issue is accounted for. I understand needing to steer clear of providing legal advice. As best you can, can you offer your opinion on what is different about a long term tenant that was not provided notice of exemption by the deadline vs a long term tenant who signed a renewed lease that the landlord failed to include the notice of exemption. It would seem to me that in both scenarios, the landlord failed to meet the legal requirement to enforce the exemption until that tenant moved on.

@@williamhollman698 It wasn't a deadline of July 2020, that was essentially the start date to start including it in the lease. Because it says this: "for a tenancy existing before July 1, 2020, the notice required under clause (i) may, but is not required to, be provided in the rental agreement." It basically says that a landlord can give the exemption notice as a separate document for tenancies that started before July 2020. This is also the interpretation that I have heard from attorneys who I know. But if the landlord creates a new lease or extension after July 2020 for that tenant, they need to include it in THAT document because the law says this: "for any tenancy commenced or renewed on or after July 1, 2020, the notice required under clause (i) must be provided in the rental agreement."

Text is not a legal way to deliver a Notice to Terminate Tenancy and you would be owed relocation assistance since it's not an owner-occupied duplex and therefore not exempt from AB 1482. My tenant stays in our property for 12 yrs, they filed a complaint, the city came to inspect, we are asked to repair many things, in addition the tenant block us from repairs by contractors, and demanded us to renovate. They are the previous owner , and we bought the unit in excellent conditions, but my property is destroyed, water leaking over the garage , and the diner ceilings. They don’t want to move out. Can I evict them during the period where the repairs are going? only they’re gone, we can move forward for the city’s requirements. Thanks

Discuss with an attorney...if they aren't allowing contractors and vendors in after proper notice, then they can be evicted. Depending on where the property is, you may be able to give them a 60 day notice to terminate tenancy, but you should immediately address any health and safety items.

@@WIREassociates Did not consult her as she's been swamped with cases and has spent considerable time with me already. But I informed her that my 1 year lease calls for a SIXTY day notice to terminate on BOTH parties after the expiration of the lease. Here is an excerpt: "..continued payment of rent shall constitute a bimonthly tenancy." My reason for this clause was: good enough for a landlord, good enough for a tenant. Fair is fair, right? The law states "or other period less than a month." My guess is this is the reason she said 30 days is ok. If I decide to go this route, THEN I will consult her advice. Many years ago I called a local radio station and asked my question (on the air) about my 60 day stipulation. They (2 attorneys) could not answer right away and said they would respond after a commercial break. Their opinion was that it is invalid since I collect rent monthly. I had issue with it because my 1 year lease was NOT invalid even though I collect rent monthly. In other words, how often rent is collected should have no bearing on the lease term. Not trying to confuse the issue, but this is what we have to deal with when the GOVERNMENT people confuse things.

I'm no expert, but have seen many videos and seminars. I believe you are exempt from 1482, but are subject to rent control rules in the City of Los Angeles, which are much more strict than 1482.

I’m not sure if you answer this, but after seven years of perfectly paying my rent and my landlord has decided to give me a 60 day termination notice… Most likely because she’d like to raise the rent with inflation… Do I have any rights? I don’t know if I can pull that kind of money together in 60 days and still pay rent… She did not provide a reason… Instead she selected number three properties or tenancy is not subject to the TPA… Your Tennessee if any in the premises is terminate 60 days from service… Can you please tell me what this means if you have anything extra about it

Reach out for legal assistance ASAP through lawhelp.org. Did the landlord give you an AB 1482 exemption notice before this? If not, then the notice isn't valid. The attorney will help sort this out.

Current 3 bd/2ba with Section 8: $1600 Fair Market Rent per huduser.gov: $2510 Current 3bd/2ba comparables: $2800-$3000 (same CA zip code) What if the rent hasn't been increased in 15 years because the mom&pop landlord didn't know how to run their house rental like a business. And now that they realize they should've been raising the price over time to help with the much-needed rehab (house built 2005), can they ask the tenant to leave (giving 6-12 month notice) and pay a month's rent of relocation cost? Or, what if the tenant is okay with a higher than 10% rent increase because they are on section 8 and know that their portion of the rent can't be over 30-40% of their income and the HUD will cover the rest anyway?

To terminate the tenancy, it'll depend where the property is (as long as there isn't amore strict local just cause ordinance). If not, then your plan should work. If you want to raise the rent, then I'd discuss with the local housing authority (who runs Section 8) to see if you can give a much larger increase. That will require a 90 day notice for the increase, BTW.

I am still not clear with your explanation on time code 2.34 "If a property is a single-family home or a condo or an owner occupied duplex, meaning an owner lives on one side of the duplex, that property will be exempt from AB 1482." My understanding based on your explanation is.... It is not necessary for the owner of single-family home/ condo to occupy their property to get exemption. The owner of single-family home or a condo will get exemption regardless occupying the single-family home/ condo or not even if the tenant lives there. The requirement to occupy the property to get exemption is only applied for the owner of duplex only. Please explain to me if my understanding is wrong.... thank you.

I's 3 different things that are potentially exempt: 1) Single family home - tenant occupied 2) Condo - tenant occupied 3) Owner-occupied duplex - one side tenant occupied, one side owner occupied.

Thank you so much for this invaluable information Christian. Additional questions for you re: AB1482 properties: How often can LL increase rent for a month-month tenant in a 1 year? (tenant has been m2m for years now.) I read that LL can increase rent twice a year for month-to-month tenants. Is that true? If so, how does LL calculate their 2nd rental increase later in the year? (I know that it cannot be more than 10% with given 5%+ CPI change). Would the 2nd rental increase be an additional 10% from the current base then? How much notice is required for 1st rent increase in 1 year? 30 or 60? And how much notice required for 2nd rent increase in same year? 30 day or 60 day? And just to confirm - duplex properties that are individual owned LLC is exempt from AB1482, right? Are properties in revocable trusts exempt from AB1482?

To be clear, only owner-occupied duplexes are exempt. If it's owner-occupied and in a trust or an individual owned LLC, then it's exempt. For a property subject to AB 1482 right now, the rent increase would be a maximum increase within 12 months of 10% (since CPI plus 5% goes over the max of 10%). This can be done in one or two increases, but no more than 10% total for the 12 months, e.g. two 5% increases or whatever combo adds to 10%. Each increase (whether one or two) would be a 30 day notice, since it's 10% or less for the year. *The 60 increase is gone for increases over 10% in a year, it's now a 90 day notice.*

Please help… I have been living in a rental townhome for 3 years. He raised my rent last year for more than 10 percent, and on the new rental agreement I am a rent to rent tenant. Yesterday he called me to inform me that he wants to raise my rent from $1650 to $2200. He said he refinanced the house and he needs to raise my rent to make the mortgage payment. He is not an LLC or any of that. I told him to give me a day to think. I wanted to get informed before talking to him today. Please help me. Can he raise the rent? How much? Did he give you the exemption notice for AB 1482? That will determine whether he can give that increase. It will need to be a 90 day notice for the increase, as well.

Hi Christian, My tenant signed a lease last year on September 8th and wants to sign a new lease. It's a single family home and older than 15 years. I plan to increase the rent from $1,400 to $1,600 per month. While researching if I could raise the rent by $200, i came across your video about AB 1482. Still a bit confused, I want to confirm since I did not attach the AB 1482 information to his current lease this is okay since I am exempt. Is this correct? And being exempt, I am allowed to increase the rent by $200? thank you in advance for your help

You need to give the AB 1482 disclosure stating the property is exempt in order to have the exemption. You should discuss with an attorney whether you can still give the form since it wasn't with the lease last year.

@@WIREassociates wow, ok, I was at court and the lawyer and the process server said they serve me a summons in March 4, 2022 and then serve me a 3-day notice on July 22, 2022. The judge and I was confused about what was said. I filed a motion to quash and was shock at the lawyer and process server for what was told yesterday at court.

Here's what the law says: "Housing restricted by deed, regulatory restriction contained in an agreement with a government agency, or other recorded document as affordable housing for persons and families of very low, low, or moderate income, as defined in Section 50093 of the Health and Safety Code, or subject to an agreement that provides housing subsidies for affordable housing for persons and families of very low, low, or moderate income, as defined in Section 50093 of the Health and Safety Code or comparable federal statutes."
