Since such costs are not included in any final settlement it allows the rich to file frivolous lawsuits & bankrupt the poor by dragging them through the courts to either coerce a settlement or force them to sell anyway to cover the fee's. You don't find this in other Western countries there the loser has to pay the winners legal fee's.

She's trying to pull a con to get the home for free so she's claiming her current lot is aligned with the stars, which is something should would have no way of knowing without advanced math, physics and astronomy that are way beyond the community college required to be a nurse. To have calculated the alignment of her house to the stars to such an exact degree that a property 50 feet away won't do would be quite the feat. The Egyptians would take note. It was built one lot over from where it was supposed to be built. I have purchased property all over the country and I usually go out at identify the 4 corners of my property using a variety of methods. Some areas are easier than others. Sometimes I get GPS coordinates of the property corners or boundaries and other times I don't. The purpose of building inspectors is to ensure the home is being built to the building code of the municipality.

nobody cut corners. it was a residential subdivision, meaning the surveyors already surveyed the entire subdivision and drew up maps which were submitted to the city, at that point, the properties are found from the platt maps, not hiring a surveyor to find them.

Yokel laws! When you bulldoze and build a house, nothing is “accidental’ about it. The mistake was the building company’s - not the land owner's or the county's. The land was not surveyed nor verified by the county or the landowner - that is the construction company’s responsibility, not the landowner’s. The land owner can counter sue - for a whole range of restitution and compensation. The construction company is also guilty of trespass.

the surveyors had already come and gone and left platt maps for everyone else to use by the time the contractor was in the picture.

That is another universal law they should have. A survey of the land each time a house is sold, instruct the owner's of the property lines and also any renters. It would save many people having fights and going to court. Give them photos of their property lines. I have had residents take out the survey rods and place them inward of our property, taking away from our property. This is against the law and there is a state statute against it.

the survey was done. it's a subdivision. they are surveyed, subdivided and maps are submitted to the city before any construction begins. the contractors use the maps to find property.

I know a lot of people are like - how could this happen? But this is more than a mistake - this is the second one of these kinds of things I've heard in the past few months. The other one in CT - and the developer sued the owner of the property then, too.

it happens a lot more often than that. When a subdivision is created, the land is surveyed and divided into lots and the surveyors create platt maps which are then submitted to the city which the contractors and everyone else use to identify properties in the sub division. The contractor takes the map and then takes measurements from surveyors marks or landmarks to find the exact location of the lot. Sometimes they fuck up. Like everything else, human error happens. Sometimes the surveyors fuck up and the maps are a little off. Mistakes happen. The problem is that people think the developer did it for nefarious reasons, like intentionally trying to steal property (you can't gain ownership of land by building something on it). They never believe it's an honest mistake. Houses have the illusion of permanence and immovability in people's minds, it's inconceivable that one could accidentally be built in the wrong spot.

Builders normally have insurance but I bet they don’t want to involved the insurance or their premium is going to jump. That was a very stupid mistake. She should not have to leave the property. She can demolish that house if she wants to. She did not ask for it, why would she have to pay for anything? Ask the judge to demolish it

Not lawyer, not legal advice. That being said. To sue for damages you need two things. 1. Liability 2. Damages Owner is not liable. Owner incurred no damages to the builder. They messed up. they need to own it. If anything, the builders are in fact 1. liable. 2. have incurred damages to the land owner by a. modifying the attributes of the property that was important value to her purchasing it, b. caused her to pay more tax, c. likely has to end up paying more to get her project built because she needs to undo the work these builders did. She can sue the builders.

she can sue the builders but if she did then she would be entitled to the 70k value of her lot. She currently wants them to incur 850k in losses, which is why they sued.

She is handling it properly. Doing nothing and letting them fix it is what it looks like to me. Its their problem. Let them pay all involved to resolve it. Best call on her part. Put up no tresspassing signs and wait to win in court.
