Fr. It's actually a waste of tax payer and courts resources and time. They really should just have advocacy groups wanting to end guardianships be the ones who manage everyone in them. They want people to be independent and can offer them the least restrictions or independence without draining them. Would be much more cost effective and clamp down on this type of mismanagement.

Now that the State of Florida permanently revoked the professional guardian certification, I would not be surprised if criminal charges are filed. She needs to go to prison for a long time for what she did to her wards under her care.

That any other "competent adult" in Florida can file a writ for someone else to be declared incompetent, seeming to lack adequate lack medical/legal oversight, and there is no way to get out of it besides fleeing is absolutely broken.

This is why it is becoming dangerous to retire in Florida because of the potential of being placed in an involuntary guardianship. Like you said, any competent adult can engage the right attorney and file the petitions for incapacity and for appointment of a guardian. The laws need to change to make it much harder to petition a court for guardianship.

This goes back at least ten years. Palm Beach County had judges who appointed their spouses to these positions. The then-chief judge removed them after backlash, but there was not ANYTHING done to prevent future fraud. As long as the judiciary appears to do their job, they will continue to turn a blind eye until the next person forces an investigation.

There is also some crazy law I saw on a video a while back about family members not being able to sue hospitals for malpractice, including it causing your death if you are not married in Florida, and your spouse and or kids are the only ones that can sue on your behalf.

Guardian ship needs to change. Ine basic rent utilities insurance protection services of phone ,banking etc. medical. The rest for the client. Care givers get paid by hour or contract time. The government and medical insurance covers that. Should be they pay the guardian and no money to guardian from clients.
