This whole forced to live in a foreign country thing seems like a reach. They are living in an equally developed country with there father. And they both grew up learning the language of the country they are living in. Also they are allowed to come back to the United States.

The real question is when Kelly fell in love with her husband and got married in US, why didn’t she file for her husband’s American citizenship? I’m surprised why no body is mentioning it!!! There is something FISHY going on in Kelly’s life.

It sound like because she didn’t follow the judge rules. That’s why she lost custody. Let this be a lesson. The judge is in control follow the judge rules document everything that you do everything the other parent do any purchase you make any scratch everything

Krystal Henry they do. Their father is german in Germany there is "blood-right" (Ius Sanguinis) meaning regardless of where you are born if at least one of your parents is german you are a german citizen aswell.

And I understand that. However, the court documents acknowledge that they do not have duel citizenship in any other country. And the bottom line is this, they were sent to France although no one in the family is French or has any connection to that country. I believe this was to prevent exactly what is happening, another country taking over jurisdiction on claims of duel citizenship. In the United States, if a couple is divorced in a state and custody is determined in a state (in this case California) then the jurisdiction remains in that state indefinitely unless it is petitioned with the court of that state (California) to move it. Therefore, the outrage is really since the parents, and both children (who were born in the US, except Daniel, and living there at the time of the divorce and custody proceedings) jurisdiction should not have changed from the state of California. The children should have never left in the first place. I've read all the court documents and comments people have said about Kelly revoking his visa. The evidence shows that whether she was responsible or not 1) the California judge was negligent to not investigate the reason or happenings which caused the revokation of his visa and if any of the "allegations were indeed true, 2) investigate if she was in fact sending the children to live with a criminal father and 3) not following up and making sure that he was reapplying. The courts got lazy and didn't want to deal with it. The ruling was that the children be in Monocco temporarily. The father deliberately did not rectify his visa, kept the children knowing that as he let time pass the children would have less connection to their original home and country and he could then further alienate their mother by gaining citizenship for himself and his children and get jurisdiction moved to Monocco where it would serve him best as they would protect their citizens and not Kelly the American. The United States, for whatever reason has relinquished jurisdiction on case that involves three American citizens for reasons that no one knows. It is a scary precedent to set for any person in the US who chooses to have a child with someone who is not a citizen.

Krystal Henry Thats funny, cause the lawyer of Rutherford has accused Giersch of trying to change the kids citizenship. And the lawyer of Giersch released a statement that no attempt to change the children us-german *dual* citizenship has been made. So regardless of whether or not they were dual citizens when the decision was made in 2012 they certainly are now. As again all children born to at least one german parent have a natural right to german citizenship. She repeatdedly tried to allienate him from the kids culminating in an attempt to get him barred from the US and completely cut him out of his kids life. And THANK GOD it backfired. The Judge made the only right decision. He cant travel to see his kids in the US, she can travel wherever she wants so the kids ought to live with the father who has every right to his children and she should visit the kids. The only fair and sensible thing to do in a situation like this. A scary precedent? No its a great precedent as it shows that there is the possibility that the US will protect your rights to your children even though you are a foreigner.

He could travel to the US on his German passport. And BOTH parents have tried parent alienation. And rights of foreign parents should be protected, but so should the rights of American parents. Again, you are failing to acknowledge the original judge in this case did not look into why or how the visa was revoked nor did she investigate if the allegations were true. That's how this all happened! One person can not revoke your visa because they do not like you. There were allegations of criminal activity under the Patriot Act. The government determined Daniel could no longer be here but where was the investigation? If it was serious enough to make him leave the US why isn't he in jail? It just makes no sense.

Krystal Henry You said you've read the court documents. If thats the case you would know that the Judge clearly suggested that it was her who tried to alienate him from the kids while he was promoting a relationship between the kids and the mother. She desperately tried to find dirt on him for example by putting at least two private eyes on him finding nothing btw. You'd also know that the mere allegation coming from Rutherford via her lawyer was enough for the US state department to revoke his visa there was no investigation neither was it that particular Judges job. There is no evidence that he did anything wrong anywhere. What you are suggesting is that he should have reapplied for his visa which would then start an investigation. Sometime these investigations can take years in that time it would have been not possible for him to travel to the US to see his kids and all that thanks to her. How in the world on what possible planet can that be considered fair? The Judge saw through her ploy and made the right decision. btw, she has every right to her kids. She can move to france anytime she chooses to be closer to her kids. France is their home. She ought to get over it. They go to school in france they have their friends and grandparents in france the daughter has been living in france longer than in america already the son was 5 when he moved to france he is now almost 9 and has settled in france who in their right mind would argue that france is not their home? What she would do if she really was this lion mother she acts like on TV when she repeatdedly drags the children into the media (something the father is against and that violates a 2011 court order btw) she would move to france get a job and be closer to her kids.
