Hi Attorney, gusto ko po sanang malaman kung may other remedies pa bukod sa adoption. Gusto ko kasi na mawala na lahat sa papel ung biological father ng anak ko. The facts of the case: Nagkaanak po ako when i was 18. Nabuntis ako one month bago ako mag 18 and nanganak nako nung 18y.o na po ako. Nagsama kami ng ex ko for 5 years. Yung ex ko po na yun ay kasal din po. Nung nanganak po ako, di ko po naasikaso yung BC ni baby at sya na ang nagprocess. He acknowledge the child as a father. Sya po nakalagay sa BC. Naghiwalay kami nung 2019. 2020 nung totally cut na po ang communication namin at never nang kinamusta yung bata up to now. So parang inabandona na din talaga nya yung bata.Kasal na po ako this year and gusto po sana namin ilipat na ng apleyedo ng asawa ko yung anak ko sa pagkadalaga. Bukod sa adoption process, may ibang paraan po ba para maging legitimated na yung anak namin. Or any other way po para hindi adopted yung bata? Salamat po. Sana mapansin.

Hi there. So, these are the facts of your other question. Yes, pwede nyo i-adopt ang illegitimate child mo para maging legitimate. The biological father who acknowledged the child in the birth certificate just needs to give his written consent or agreement to the adoption. It is required pa din kahit adult na ang bata kasi adoption will terminate their legal relationship with the child.

If wala na kayong contact sa biological father, just execute an Affidavit, preferably signed by the child na wala na syang knowledge as to the whereabouts of his/her biological father. In view of the fact na adult na ang child, the court may disregard the father's consent kasi wala ng parental authority yung tatay nya over the child

Hi Jisun. Tulad ng sinabi ni Mae, DNA test po dapat. Blood test can only give information about blood type and other medical information. Pero hindi nito mapapatunayan kung mag-anak ba yung mga tinetest.

Hello. Same case here. Punta ka sa Nakalistang adoption agencies listed sa ICAB. Fill up the application at sila ang magpapadala nang application nyo sa Philippines. Ang Sabi sakin, you must have a legitimate reason for adoption; financial reason is not good enough. My case, patay na yon mother and the father, my brother has a drug issue. I’ve submitted our app in 2019. Nasa NACC na ang app. I heard the new law shouldn’t take more than 6 months but we will see. Good luck to both of us.

Hi po! I have question regarding adoption. The prospective adoptive couple was recently matched by DSWD. As per the case study report, the mother of the child relinquish her parental authority over the child and they signed the Deed of Voluntary commitment and it was also notarized by an atty. Now, with this scenario, I'm just curious if the court would require the mother of the child to confirm this - Deed of Voluntary commitment during the actual proceeding? Thank you!

Good morning. Your lawyer can ask the City Prosecutor to stipulate the existence and due execution of the Deed of Voluntary Commitment so that the biological mother need not be presented in court. ☺️

Hi. If the adoption is not challenged and nullified, the adoption enjoys the presumption of regularity. So, even if it was an "illegal" adoption, the child is still legitimate and enjoys all the rights and benefits of a legitimate child in terms of succession.

Hi Jerrymae. Sorry for the late reply. Pinanganak na ba ang baby? Sana pinanganak na kasi hanggang hindi pa nasisilang ang baby, hindi mo pa pwede i-adopt. Traditionally, adoption involves a child na pinanganak sa mga biological parents nya at may na-isyu na birth certificate. Hindi pa pwede i-adopt pag hindi pa nasisilang. Kung ang gagawin nyo po ay ipapalabas sa birth certificate na kayo ang magulang pagkasilang nya, magiging simulation of birth po yun na isang krimen sa ilalim ng Revised Penal Code. Kaya, ang gagawin nyo po ay hintayin na maisilang ang baby, ma-isyuhan ng birth certificate na nakapangalan ang biological parents nya, then mag apply kayo ng adoption sa Regional Alternative Child Care Office o RACCO ng lugar kung nasaan naroroon ang aunti at uncle mo. Administrative proceedings lang po ang adoption kaya mabilis lang po at hindi magastos. Good luck!

Hi Jennie. Thank you for your question. Anak ng husband nyo with another woman pero hindi naka-indicate sa birth certificate na sya ang tatay? Ngayon, gusto i-adopt ng husband nyo ang anak nya? If the purpose is only to establish paternity and filiation, pwede naman syang mag-execute ng affidavit acknowledging the child as his own. Yun nga lang, illegitimate pa din yung status ng anak nya. But with adoption, magiging legitimate na ang anak nya. Mag-file kayo ng adoption case. Both of you will have to be co-petitioners in the adoption case.

Hi Mae. I'm happy to inform you that a new law was passed. Republic Act No. 111642. You can do the adoption here and the adoption need not be done through the courts. Administrative na lang sya. Pero hindi pa in full effect ang batas. The National Authority for Child Care (NACC) is stll being organized. In the meantime, DSWD can help you with the initial steps for your husband to adopt your child. Good luck!

Hi. If the adoption decree is already final, check with the court if napadala na sa Local Civil Registrar yung decision sa adoption case and if the LCR has already amended your birth certificate. If not yet, kuha ka ng writ of execution from the court so that the LCR will be directed to issue a new birth certificate. Congratulations!

Republic 11222 po yun. Applicable sya sa mga inampon na di dumadaan sa korte at pineke lamang ang birth certificate para ipalabas na biological na anak ng nanay yung bata. Ang purpose ng batas ay para i-correct ang pekeng birth certificate at gagawing legal adoption. Sa DSWD na lang ang proceso at di na dadaan sa korte

Hi Grace. Yes, pwede mo sila i-adopt. Kelangan lang ng consent ng biological father nila. Siguro naman papayag yun kasi matagal namang wala sa poder nya ang mga bata. Magpa-assist po kayo sa DSWD for the study report tapos mag-file kayo ng petition for adoption sa Family Court sa lugar nyo.

Wala pong age limit sa adopter. Kelangan lang at least 16 years older than the child to be adopted, unless anak ng asawa nyang Pinay yung ia-adopt, kung saan pwedeng kahit hindi na minor yung ia-adopt.

Pwede adult adoption kung anak ng asawa ang ia-adopt. Pwede din kapag relative up to 4th civil degree. Lastly, pwede din kung ang ia-adopt yung taong trinato na bilang anak for at least 3 years.

Yes sir. You can request the court to have the surnames of the children changed. Change of name is one of the legal consequences of adoption.

@@Jingryl Hi there. It really is an issue with biological parents when their kids are adopted. I guess if you, your future wife, and the children can talk about it and unanimously agree that adoption is for the best, that can prevail over the biological father's objection.

Good question. Hindi po pwedeng kapatid lang. Sa adoption, magiging parent-child ang relationship. Kung gusto mo maging kapatid sya, pwede naman ang magulang mo ang mag-adopt sa kanya

Hi Attorney, paano ko po kaya maadopt ang pamagkin ko? Kami na po nag alaga sa kanila since birth, kapatid ko po yung mother nila pero iniwan na po samin yung mga bata. Hi Febee. Hindi ka qualified to adopt because of the age gap. 9 years lang ang gap nyo. Dapat kasi 16 years ang gap. Pwedeng less than 16 years kung biological parent yung mag-aadopt. Pwede naman ang mommy at daddy mo ang mag-aadopt para magkapatid na kayo.

Adoption lang po. Mabilis lang po yan. Una po pumunta kayo sa DSWD para sa mga unang steps like certification that the child is available for adoption as well as custody report. Isama nyo ang kapatid nyo at ang bata sa DSWD for counseling and advice sa steps. Adoption is affordable naman. Get a reasonably priced lawyer.

The legal relationship between the biological parents and the adopted child is terminated. Ang recognized parents na ay yung mga adopters. Kung kinuha ng biological parents ang bata ng walang pahintulot ng adopters, pwede sila kasuhan ng kidnapping.

Hi Maria. If you are already a resident of Canada, you can apply for her adoption through an adoption agency there. Tell the agency, you want to avail of the inter-country adoption process. Make sure that the adoption agency there is accredited by the Philippine Inter-Country Adoption Board. Good luck!

Hi there! If resident ang lola mo ng US, the adoption is through the inter-country adoption board. Ang gagawin nya is to look for an adoption agency sa US na nag-aasikaso ng inter-country adoption. Iko-course dito sa Pilipinas ang application. It will be decided by the Inter-Country Adoption Board. Good luck!

Kung may pruweba kayo na imposibleng nanganak yung babae, then simulated birth nga yan. Pwedeng kasuhan ng Simulation of Birth. Criminal case yun. Pwede syang makulong dun. Pangalawa, pwede nyo din i--question ang birth certificate ng bata sa kadahilanang simulated yung birth. Pag na-cancel ang birth certificate, then mapuputol ang legal relation ng bata at ng tatay nyo.

@@elitegirl24 Wala pong age limit. Ang importante, ang age gap between the adopter at yung bata ay 16 years. Kung ready na kayo mag-adopt at may available na bata for adoption, I advise you to go to the nearest DSWD para matulungan kayo sa proceso ng pag adopt. Dadaaan kasi sa kanila ang adoption for case study report.

Hello Ai. Kung walang parents o guardians ang bata, ibig sabihin neglected sya, pwede syang dalhin sa DSWD for adoption by interested adoptive parents. The child will first be under the foster care of the DSWD then the child will be declared available for adoption. But if the child has parents or guardians, the adoption can be made only through or between said parents and the interested adoptive parents. The adults will initiate the adoption, with the consent of the child of course.

Hi Maria. May bagong batas ngayon, ang RA 11642 na hindi na kelangan court action ang adoption. Adoption may be done administratively, sa National Authority for Child Care (NACC). Pero hindi pa operational ang NACC. In the meantime, sa DSWD ang proseso. So, ang payo ko ay sumangguni sa pinakamalapit na DSWD para matulungan kayo sa plano nyong mag-adopt. You can adopt a relative or even a stranger. May mga bata pong available for adoption na under the custody and care of the DSWD. God bless po 🙏

@@michellefantone7912 Mag-file kayo ng protest o anu mang letter na hihingiin ng PNP regarding dun sa benefits ng tatay nyo. Papansinin kayo kung formal ang reklamo. Regarding dun sa bata, pwede kayo mag request sa PSA ng birth certificate ng bata. Kung walang adoption papers, baka simulated o peke ang birth certificate. Pwede din ipawalang bisa ang birth certificate para hindi makakakuha ng share sa benefits o mana mula sa tatay nyo. For all these, kelangan nyo kumuha o mag-hire ng abugado. Good luck!

Yes, you may adopt even if you're not married. It's not required that the adopter is married. For as long as the adopter is psychologically and financially fit to be a parent, even if single, he/she can adopt a child.
