@@nonenone5413 nah, the defendant had no basis to object, he was just trying to take control of the court away from the judge and he foolishly thought that saying "objection" would somehow give it to him. The judge was right to admonish the defendant for his behavior.
@nonenone54133 жыл бұрын
@@Danimal1177 you are incorrect. A party can raise an objection for anything they find questionable. The court then rules on the objection. That's how the process works. If an objection is not raised, then the party forfeits the right to contest the issue later. A party has a right to object, but not a right to have it sustained. If it is overruled in the lower court, the party has reserved it's right to contest the issue on appeal. If they never objected, then they can't contest the issue on appeal. Thus, a party may object merely to preserve rights and expand their options on appeal. They have that right. It doesn't really matter if you, or the court, thinks they have a basis to online or not. They have a right to online on any grounds they believe fits the situation. It's really shocking how you don't know people's basic rights in court.
@Danimal11773 жыл бұрын
@@nonenone5413 well it's obvious you are not a lawyer based on your blatant ignorance of the law and criminal jurisprudence. The defendant tried to "object" to a defense attorney appointed as standby counsel. That's not something a defendant can object to. I obtained a permanent injunction against a vexatious litigant. I don't know what's stopping the Court from suggesting this remedy. @jeanharper96833 жыл бұрын
@@mrjones2721 No, the judge only called him a vexatious litigant - a hint to the attorney to a legal remedy. It is incumbent upon plaintiffs to file the appropriate motion with exhibits, have a hearing where the judge grants PERMANENT INJUNCTION AGAINST VEXATIOUS LITIGANT in open court. Once that happens, the Clerk of Court can legally refuse ANY filings the VL tries to file. Clerk has the power.
@mrjones27213 жыл бұрын
@@jeanharper9683 As of the current moment, he has been legally declared to be a vexatious litigant. I don’t know whether it had already been done at the time of this hearing. Even after someone is declared a vexatious litigant, the system doesn’t always work as smoothly as it should. For example, in one California case I’ve been following, the VL is supposed to get permission before filing a motion or new case, but the electronic system doesn’t automatically refuse if she tries to file without permission, and the judge isn’t nearly as proactive as she should be about smacking the VL down. Blandino isn’t able to file through the system, so he whines and whiiiiines at the judge to let him “make a record” and file motions orally. The judge mostly refused to let him make oral motions, but has to let him “make a record” in the interest of making the case appeal-proof. Blandino’s antics don’t get him anywhere, but these types never notice that.
