It is hard to say that "someone has respect for someone, so they must be innocent", and take that as the holy word. All due respect to Burgoyne, but 2 words come to mind: ADELAIDE CAMP. Here you have Rory Sloane saying that it and what the coach did at the time was the best thing, nothing but respect, turned him into a better man, father, and husband, yet look the toll it took on Josh Jenkins, and caused the team to lose arguably the 2nd of the two best players they have had since Jarman and Modra, in Eddie Betts. Huge Respect = innocence doesn't fly anymore. The problem here is that neither side really has had the chance to speak out and back up their claims or defend themselves. That is where the AFL failed, and both the defendants and plaintiffs could take the AFL and Hawthorn to court directly, as this has created an even bigger mess than it has.

The huge problem with racism charges as for other discrimination is that the so called crime, if it be such, is a thought and is very much dependant on the one who complains. A truly tolerant and gracious society does not pursue such things as it solves nothing and makes things worse. The AFL should stop all this indigenous focus, and all the promotion of the acceptance of sexual deviancy and focus on footy.

The accused have been exonerated, but the accusers who didn't allow themselves to be interviewed on their claims still get a payout. How is that possible? Has the AFL opened the floodgates for anyone to make claims of abuse and racism for an easy payout? Have the accused now got a case against the AFL who by providing a payout have inferred that wrongdoings did take place which in the eyes of many confirms that the accused were in the wrong and are racist. That might open the door for a claim against the AFL for compensation for loss of reputation through actions by the AFL that they haven't consented to. The accused have also incurred significant legal costs they should be compensated for. What a mess, but also a predictable outcome.

Comments at Gil's press conference were slightly different. Basically the AFL investigation/independent panel is over because a deal has been reached. The complainants have agreed to not pursue their grievances through the AFL process or take action against _the AFL_ in other jurisdictions (court, HR Commission). However, it does not affect the rights of any party to the investigation (and those that did not participate in the investigation) to pursue claims in other legal forums if they want to. It's on the parties on either side to take external action if they want to. AFL also reserves the right to make a finding against Hawthorn.

There was no payout. The findings of the independent panel revealed (or were likely going to reveal) the complainants allegations could not be substantiated, and further, that the AFL didn't possess the powers to exact the justice they were looking for. The AFL concluded matters by negotiating immunity from civil action, but not from the accusers pursuing civil action against Hawthorn and its former coaches where the standard of culpability is less and where monetary settlements are common. Despite appearances, this is not a peaceful ene to proceedings, it's merely an end to the AFL's involvement in proceedings. There will be more fallout to come.

I don't doubt that they have received something to go away in the hope that this will just become a distant memory in the future. i think the afl are sort of innocent victims in this farce. the hawks knee jerk reaction to the accusations was very wrong. they believed the accusing party without investigation or scrutiny. they never gave their accused a platform, they had given them a trapdoor. so the afl hasn't wiped its hands, rather , shown that the accusers could not be proven to be telling the truth. thats why clarkson burt and fagan were never called to give evidence. no evidence to give. no charges to be answered. hawthorn blew it big time.

At first I thought the whole thing was complete BS but some of the stories about clarko in sam Mitchell's book are pretty full on. Making sam hand his phone over when his wife was in hospital, and texting him on days off asking the last time he played well in big games. Seems like clarko is pretty controlling, despite the success. Hawthorn had some of the best players and leaders of all time. The credit should be theirs much more than "master coach" clarko.

Rob o is correct is wondering how this was resolved. This was a debacle from the beginning. As someone who has family experience in being accused (falsely in our case), there has to be a proper process followed to ensure the closest truth we can get to is discovered. There was obviously something happening at Hawthorn that has greatly upset, outraged the people speaking out. Equally there has to be fairness to the accused because people with nothing to do with the situation, who were not there, start adding their opinions based on biases. The accused becomes targeted and if they happen to be innocent it is a trauma that cannot be explained to those who haven’t experienced it. I don’t like Clarkson - never have - based on his (IMO) arrogant and abrasive personality. But he should have been given the right to privacy whilst the matter was dealt with, not forced to go through an ill-informed scrutiny by all and sundry. This happens too much across all aspects of life now - sport, politics, crimes. Robbo is correct in wondering how this has all rapidly come about in the face of really serious allegations. Now all parties are going to have question marks over the allegations and denials. We have to get better at keeping investigations under close guard until a picture emerges of what is being dealt with and who the involved parties are. Often in these situations there is little of the context revealed that can only be revealed by both parties to a situation. The FL will be glad to get this off its back but it was a balls up by Hawthorn from the get-go. In a rush to do what is seemed to be “right”, a fair process was not followed. Maybe a mediation process was needed right from the start. To have allegations made and not inform the alleged perpetrators except via the press is disgusting. We cannot do this. Too much is at stake. All players should be given avenues for them to raise issues as and when they occur - they shouldn’t feel intimidated by a club, the AFL or wider community. Let’s get better at this.
