In the case of the girl, I’m so sorry for her situation. The point is, she should have asked company for permission before recording the service user. However,the truth is most healthcare companies (Especially Private)DON’T care about their employees, it’s all about the service user (Who generates Money for their business) and this is why no matter what they do , companies don’t care and if possible they could even make you pay for the actions of these service users?(Whether their actions or inactions were your fault or not is again something they clearly don’t care about). Totally unfair.

Hi Ada, thanks for posting this. I'm a British care worker and the stories I hear from recently arrived African care workers are shocking. They are being g paid less than British workers and have to pay for their training and transport. Ada, its no good telling the UK government to have compassion, it's not in their DNA. African care workers are beìng ripped off, exploited and ending up in indentured servitude. Such a shame...keep up the good work.

many companies use the laws to suit themselves so they do not have to give workers all they would be entitled to like holiday and sick leaves ,i not sure the uk policies but countries do use this as government assistance might give employers some money benefits to employ people and give the employee 3 month trial and then they can sack them and then get another worker for 3 months then it goes on and the company makes money ..look into this

They demanded for evidence and the only means is to record. If she is part of a union they can sort this out for her to go back to work. Even when your employer is aware you are part of a Union they deal with you carefully.

No they don't. Most big companies do not recognise Unions. You can use your union rep for advice, and they can guide you in certain situations; it is still a good idea to join a union so you can be more aware of your rights. But, they cannot help you if you have gone against your company policies, which is why it behoves one to read these policies carefully before signing your contract. Unions are not for getting people out of trouble, and filming or recording a service user for any reason is gross misconduct. Did this lady ask her manager what kind of evidence was needed? Also, if it is a contracted job they have to give you a couple of warnings before sacking you. If it's an agency, yes they can let you go right away.

They do not exist to get people out of trouble and as I said in an earlier comment, most companies don't recognise them in 2023. What you said about no legit employer with job availability will ask you to pay for COS is 100% true and our people will not listen these care employers (both domiciliary care and support work) are only interested in cheap labour except for very little organisations. They reduce wage to the barest minimum of 10.42 and use them for a job which obviously deserves more, make unreasonable demands and dismiss them at will. I advise people care worker role is not worth it (except for a very few companies) you will hardly and rarely see a British taking up a role as a caregiver. Run far away from agencies too. I know a Nigerian lady that spent 7million Naira for COS alone excluding other fees yet they don’t have shift for her such a sad turn of events.

Ontario health Canada, refused saying that I should get a lawyer. But this was 2013. She should have gotten a colleague to help her, witness what the client was doing to her.

@@AdaKings Another tip moving forward, if a client is rude or disrespectful, always record in the daily notes. They are legal documents so managers have to accept them as the truth, therefore it is evidence. Also, your company should have incident forms to fill in each time something like this happens. You have to create what's called a "paper trail" so that an investigation can be launched. Unison can explain all of this, but managers should be informing people during on-boarding process.

I understand your stop paying for COS advice but let’s be a bit objective here. Some people in the UK who lost their jobs and visa are forced to pay for it otherwise where do they get another Company with COS that’s willing to give it to them freely? Nowadays getting a Healthcare company with sponsorship and that ARE WILLING to sponsor is nearly an impossible task! Luckily for me I got a company who happily sponsors me without me paying a dime but this was after more than a year of searching and countless REJECTIONS! Some don’t have up to a year to search ! Some have papers that are expiring soon and what would you rather they do? Become illegals? Not supporting buying COS but then people are trying to survive here by many means! The whole situation is just sad.

I think our people just bring these people here, do not fully place adaptation measures in place and things to flow. The employer should have dos and don'ts of the care work. This has nothing to do with the company. It is a data privacy law that most countries have including Nigeria. It is a sad case but when the law is broken, there are no sentiments. All this is only happening because the lady in question bought COS, which sane company will bring you in and will lay you off like that, i know the lady was wrong but that's not enough to sack her. It is because they know she cannot report that's all. They needed proof and she gave them proof, how else was she supposed to prove what she was going through. The companywas just looking for a way to sack her period.

Ada with all due respect, you and all the KZbinrs that have promoted this cheap labour movement caused the predicament some people are going through. I remember vividly arguing with your army of people who was against me when I said coming to the UK is not going to heaven. I clearly stated the need to calm down and do things the right way, but your people thought I was being a hater. I am not happy that our people are going through these problems, but my question is what did you guys think would happen? Did you think they wanted you guys for what? They allowed here to be used and dumbed! All of you coming here through this route are nothing but cheap labour for the UK and means to help them build their economy. This is not about sentiment, rather it is about the law - do people know their employment rights? Do people have access to proper and professional legislative advise? If they find out you have committed any gross misconduct - you'll be sacked - no question asked. Remember this is about working with/support of vulnerable people of the society and you should not work there if you have no experience. Also, make sure you're qualified as an immigration solicitor before you can give advice people on immigration matters, otherwise, you'll be prosecuted.
