Remember Scott Peterson?
17 years ago he was convicted and received the death penalty for killing his wife, Laci, and their unborn child, Conner. Well, he was re-sentenced today to life in prison without parole. This after his death sentence was overturned by the California State Supreme Court.
Attorney Terri Austin and Criminal Defense attorney Mark Eiglarsh join Dan to reason why Scott did or didn't do it.

Just because he's spent 17 years in jail doesn't make him guilty. Our system has proved that over and over. I'm not saying he's not quilty; I just want actual proof. Many people are in jail on circumstantial evidence. There should just be a block on the death penalty for cases without factual evidence. It's been proven time and again that personal witness testimony is biased and not fact. I actually went thru the trial and saw/heard nothing but hearsay. Fact driver?? Unbiased coverage?? What I just watched was not only biased but it scares me that these ppl are experts. As a woman of color who was wrongly arrested and I did settle with the city, a fair trial to every person means a lot to me. I watched the trial. There’s so much evidence that was excluded and little evidence aside from him being a cheater that was presented. There was a home robbery across the street. The mailman was left out. Aside from having an affair, where’s the evidence. The guy on the right is aggressive and I don’t trust people who can’t even look at things down the line. I couldn’t understand why he was convicted. The police should not have released his alibi. How does her body after 4 months remain exactly in the same place? They should’ve kept his alibi a secret. Why don’t they go down each single piece of evidence and tips that was left out?? Bc they just “feel” he’s guilty. That’s the problem with jury’s too… they “feel” vs evidence.
@sophie8394

You watched a trial that wasn't televised? How did you manage that? The BURGLARY theory has been deemed by the court to have no merit. The burglary happened on the 26th. Proven. What do you mean the mailman was left out? Bc that's what the documentary told you? That was just one of their many lies. The mailman, Russell Graybill testified. In fact he testified that nothing was out of the ordinary at the Peterson home that morning. Laci's body wasn't in the same place. Not sure where you're getting that. She washed ashore less than 2 miles from where Scott was fake fishing. Loosened from her weights during a storm the night before and carried by the tide.

Exactly! They are basically saying I was there and only my opinion counts. There are definitely things that makes him look suspicious. However, he should not have been convicted based off the effidence they presented. The cops were caught in lies on the stand, the D.A was caught lying in court. As soon as they brought Amber Frye in everyone convicted him. ( she was basically an undercover cop)The media coverage was CRAZY! He didn't speak to them so they vilified him. He agreed to both searches, but wanted his lawyer to look at a document before the second one. They said he was no longer cooperating. The jury was highly suspicious , and acted atrociously after the trial, and during deliberation. I do find it very suspicious to drive an hour and a half to go fishing just to get out on the water for an hour, on Christmas with a pregnant wife. He traded her truck 2 weeks after she went missing. Which shows he didn't think she was coming home. So I am not saying he is innocent. However, it is TERRIFYING the way the media acted in this case and the way the jury, and police handled themselves. We have standards for a reason, and they didn't live up to them in my opinion.

@@sophie8394 what solid evidence was that again? The cadaver dog that hit the scent failed certification, the cadaver dog that was certified never picked up the scent, there was zero physical evidence in the house, in his truck, in his boat and in his warehouse, there’s multiple people saying they saw Laci walking that same morning, the police couldn’t locate the bodies until AFTER they announced where Scott Peterson was at that morning, coincidentally enough another pregnant woman surfaced in the same condition as Laci did in that same place only difference being they couldn’t locate that poor woman’s baby, you have burglars that were picked up because of a robbery that occurred across the street from the Peterson home and their first reaction is “I had nothing to do with that pregnant lady,” you had a fisherman trying to say it’s possible to throw a 150 pound body with multiple weights attached over the side of a boat without capsizing it or damaging any of the boat yet in the reenactment the judge didn’t allow the boat was capsized every time, there’s evidence Conner was handled outside of the body give the condition he was found in with multiple threads wrapped around his body and electrical tape pinning his ear down, the hydrologist the prosecution called admitted he had no expertise on how water currents would effect a body despite trying to say tidal action could’ve caused Conner to exit Laci’s body, hell Amber couldn’t even get the guy to hint at him having anything to do with the murders in all of her recordings. Scott tells Amber he lost his wife a couple of weeks before she went missing, and this would be his first Christmas without her. And, by christmas, Laci really was gone! On the day he said that to Amber he bought a secret boat no one knew about. He also made five anchors, four of which were never recovered. The one that they did have, didn't match the cement in the driveway, which is where Scott said he'd used the rest of the missing cement, proven in court. Laci didn't know about, nor had she ever been in the boat, yet, a couple of Lacis hairs were found, wound tightly in some pliers. Agreed to take a lie detector test, but backed out after his father advised him not to. Upon returning home, he immediately washed his clothes, ate, and took shower. After getting out of shower, instead of just calling Lacis cell phone one more time, he calls her mom and tells her Laci is missing. He told, at least, three people he'd been playing golf, before finally sticking to the fishing story. Speaking of fishing, Scott told the detectives that going fishing that morning had been a last minute decision. But, this was an obvious lie because he'd purchased a two-day fishing license dated for the 23rd & 24th, a few days before. Or, maybe he's just psychic, and predicted he'd be making that "last minute" decision! When he took the detectives to his warehouse, he led them to believe the power was out, when the truth was, only his office in the warehouse had lighting, but the warehouse, itself, was only lit by a sky light during the day. When he went to the station to answer questions, he was already refering to Laci in past tense. Saying, "Laci was pregnant." Shouldn't that be IS pregnant? It wasn't past her due date. He did the same thing in his interview with Diane Sawyer. By then, he'd been made aware he shouldn't do that, as he immediately corrects himself saying, "is amazing" after he'd said 'was'. A huge red flag for the detectives on the case. On the night of Dec 24th, the day Laci went missing, Scott was already inquiring about grief counseling for Lacis family. Really??? She's not even yet gone a full 24hrs! I've never heard of anyone doing that over someone being missing for only a few hours! It just seems like Scott knew she wasn't coming home. The next day, Scott called the detectives asking them if they'd be bringing in and using cadaver dogs. She hadn't even been gone a full 24hours, and, he is inquiring about cadaver dogs! Another huge red flag to the detectives working the case! He sold Lacis car while still missing, before her body was found. And, inquired about selling their home before she was ever found too! He even wanted to sell it with all their furniture! Supposedly, he doesn't know if Laci is dead or alive, but has no problem selling her car and their home, with all their stuff in it? He told lie after lie after lie. Of course the big, well known lie was when he called Amber from Lacis vigil. Right before, during, or after just doesn't matter, at all! His mistress should've been the last thing on his mind at any moment during that event. It was well known he didn't want children, and wasn't thrilled about Laci being pregnate. Even telling his sister-in-law he was hoping for infertility. Laci telling her mom Scott wouldn't touch her belly to feel baby kicking. He didn't participate in the searches for Laci, opting instead, to secretly go to the bay, park his car, and just watch the search that was going on in the bay. Instead of showing grief about his wife being missing he, instead chose to flirt with his sisters baby sitter. Offering to make her drinks he called, "flirtinis". The baby sitter was so weirded out by Scott, she left! In one of the recorded calls with Amber, Scott tells her that if the police find any evidence, he'd lose his freedom. Not a confession, but close enough! When the due date, of the birth of his missing baby came around, he didn't have a gathering of friends & family to remember Laci & Conner. No, he didn't do anything at all to remember them. And, that would've been fine, if he chose to do nothing, no problem. But, he DID choose to do something. Since that day was also Ambers Bday, Scott chose to celebrate it, by hiding a bag of jewelry and a CD, etc for Amber to pick up. It seems it was Amber he wanted to remember & honor, not his missing wife & baby. When a body of a baby washed ashore, and then a body of a woman who had been pregnant washed ashore shortly after, within just a couple of miles from where he says he was 'fishing', he never even called anyone about it to see if it was Laci. About a week or so later, he was caught trying to flee with just about everything he owned, BUT his golf clubs and golf shoes. I add that he didn't have his clubs & shoes because Scott tried telling the cops that he was just going to play golf, not flee! However, the list of things he had with him is just as long, if not longer than my list here. What avid golfer goes to play golf with everything he owns BUT his clubs & shoes? I could go on & on! I know there's more, but I'm drawing a blank on the rest. Can anyone else think of anything I've forgotten? Okay so, one or two things on this list would be maybe a coincidence. three or four things --- sketchy, but okay. All these things plus more --- he's guilty, guilty, guilty! And, I don't even have it all listed here.

I don't think there is any question that reasonable doubt exists. No question about it. Between police misconduct, the doctor who incorrectly dated Connor and Laci's remains and the burglars who were never properly investigated...those facts alone should really be enough for a new trial. I absolutely believed it was Scott in the beginning as well, just like the media wanted everyone to believe! It wasn't until years later that I started looking into other possibilities. Remember, a treasure trove of incriminating evidence against S Todd and G Pearce existed. information about any investigation of this tip. Lt. Aponte gave a signed statement to defense investigators which said the prisoner had been interviewed by MPD, and that MPD had received a copy of the taped phone conversation. Instead of this information being disclosed during discovery. The only information provided to the defense about his tip was a simple notation on a CD which included 10,000 other tips about the case. -Merlin, the trailing dog owned by Cindee Valentin, trailed Laci's scent to the Gallo Winery in the airport district, on the night of December 26. Not far from the burglars residence. -December 31, a gold Croton watch, identical to Laci’s watch which disappeared the same day she did, was pawned by Deanna Renfro. Highly unlikely this is just a coincidence. It gets better. The families of Deanna Renfro, Steven Todd and the Tenbrinks know one another. -Diane Jackson reported seeing 3 men with a VAN and a SAFE in front of the Medina’s house at 11:40 a.m. on December 24. There is no debating this. The burglary happened the same day Laci disappeared. Both Todd and Pearce pled guilty to burglary charges 12-24-02. His first call on this date was listed incorrectly under the name Harsh and was given Bates Stamp number 14789. The call was given to Detective Holmes. Harsh(man) said that he had called 3 or 4 days earlier on the day that he had seen a pregnant young woman being pushed into a van. There had been a man standing over her as she squatted to urinate with her back up against a chain-link fence. The man was described as 30’s, tall, thin, with ponytail, dirty blonde to gray hair, scrubby looking. When she finished, the woman was shepherded back to the driver’s door of the car, where another man’s arm was seen pulling her into the car. He said the young woman was wearing black pants and a red shirt. He said she had a scared look on her face." 4. Jan 3rd, he went to the Command Post in the park and relayed this to the officer on duty. Over 40,000 pages in the discovery and nothing about this report was in it. 5. February 2003, Harshman’s wife spoke to a relative of hers who lived in New York about the sighting of Laci Peterson near the corner of Scenic and Claus. Mrs. Harshman’s relative shared this story with an NYPD detective. This NYPD detective was so concerned that he contacted the MPD and spoke personally to Detective Grogan on February 14, 2003. What did Grogan do with the information? Nothing at all. 6. pre-trial hearings in May of 2004, DA Investigator Kevin Bertalotto noticed the Harshman tip and insisted that Grogan call Tom Harshman and speak to him personally. @sophie8394 What evidence? Canine scent detection is not reliable scientific evidence. It's fallible evidence. Scent dogs are a tool. DOG EVIDENCE First of all. Eloise Anderson and Trimble were not the only team the police called to search at the Berkeley Marina. Ron Seitz, whose dog was also certified by CARDA, was called to search the marina. (9 RT 1774.) X. Seitz used one of Laci’s slippers to scent his dog. (9 RT The CourIn sharp contrast to the sunglasses used by Anderson to scent Trimble, there was no evidence at all suggesting that Scott had handled the slipper. I think cannot allow any of the dog tracking evidence in, period. He didn't want Trimble's because there was never a CARDA certification provided. Anderson admitted that she wanted to make sure that the scent article was uncontaminated by any scent other than Laci’s. (8 RT 1562.) Nevertheless, she did not do the missing member test at the Marina with Scott’s scent. (85 RT 16133.) Defense did indeed ask Anderson about the failed test. GERAGOS: Okay. Well, at the time that Mr. Kopp asked you about this in February, he, you specifically said the trailing exercise you did not include in those reports was the time when your dog was asked to trail a vehicle trail and failed; isn't that right? Do you remember him asking you that? ANDERSON: Yes, and I believe I said I don't believe so. GERAGOS: You said "I don't recall --" ANDERSON: Or I don't think so, or I don't recall. GERAGOS: I'll, you want me to read it? ANDERSON: Please. GERAGOS: "I don't recall an exercise where she was asked to trail, other than the one that's in her records." Is that what you testified to? ANDERSON: If that's what it says, that's what I testified to. GERAGOS: Referring to page 1544. ANDERSON: Okay. GERAGOS: Okay. Now, specifically there was no mention of this videotape in any of your records; is that correct? ANDERSON: That's correct. GERAGOS: Okay. The way that this videotape, and you had this videotape, didn't you? ANDERSON: I found out when I went home, after I testified, that I had it. I didn't think I had it at the time. GERAGOS: Okay. And the reason you had it was that Mr. Rebmann had mailed the videotape to you, correct? ANDERSON: That's correct. And I didn't think that my dog was on it, so I never looked at it. >>>>> GERAGOS: Now, when did you call the district attorney about this? ANDERSON: I don't recall. It was after February. GERAGOS: Okay. It was after February. Wasn't it when I executed a subpoena on Contra Costa on August 3rd? Didn't you call the DA, of this month, on August 4th, and tell them Wait a second, I got a tape? ANDERSON: No. GERAGOS: You didn't call them on August 4th? ANDERSON: No, I didn't. Well, I don't, I don't know who might have called them on August 4th, but I had the tape before this month. GERAGOS: You never before - ANDERSON: In fact, I turned this tape over to the sheriff's department in March or April. I believe it was March. GERAGOS: Okay. Now, did you know that I had executed a subpoena on Contra Costa on August 3rd for all of the records? August 3rd of this month? ANDERSON: That's correct. >>> GERAGOS: Okay. That's where she circled back to you because she lost the scent as soon as the person got in the vehicle, correct? ANDERSON: Incorrect. GERAGOS: Okay. Well, she didn't follow the direction the vehicle went in, did she? ANDERSON: According to what I was told after the fact of where the vehicle went, she did follow the direction of the vehicle. GERAGOS: Oh, and who told you that? Was it Mr. Rebmann? ANDERSON: No. I believe it was the people that drove, the subject and her husband. GERAGOS: Mr. Rebmann told you specifically that the dog had not followed the vehicle trail and the dog had failed, and, as he had expected, that the vehicle, that your dog could not do vehicle trailing; isn't that what he told you? ANDERSON: No, that is not what he told me. ----Opinions of two nationally- recognized experts in dog-scent identification on the validity of Eloise Anderson’s conclusion that Trimble detected Laci’s scent at the Marina. Both experts, Dr. Lawrence Myers and Andrew Rebmann, have concluded that Trimble’s purported detection of Laci’s scent was totally and completely unreliable. First, Rebmann does not believe it has ever been demonstrated that any dog, including Trimble, could follow a non-contact vehicle trail. (Ibid.) Rebmann personally knew Eloise Anderson, as she had attended one of Rebmann’s training seminars with Trimble in 2002. (Ibid.) At that seminar, Anderson claimed that she and Trimble could follow a vehicle trail. Yet, when Rebmann constructed a double-blind, vehicle trail test for Ms. Anderson and Trimble, she and her dog failed the test. (Id. at HCP-000039, HCP-000040.) Furthermore, according to Rebmann, the dog had not demonstrated a sufficient proficiency in this skill in prior trainings. (Id. at HCP-000040.) B. Second, Mr. Rebmann states that Ms. Anderson’s search omitted the “missing-member” procedure, by failing to let Trimble sniff Scott Peterson beforehand. (Exh. 5 at HCP-000039.) Consequently, Ms. Andersoncould not insure that on December 28, 2002 Trimble was not following Mr.Peterson’s scent, rather than Laci’s scent, as he drove the boat out of themarina. (Id. at HCP-000040-41.) C. Third,Mr.Rebmann noted that there was a four-day delay between December 24, when Laci’s body was supposedly at the marina, and the search on December 28, which sharply reduces the reliability of scent detection. (Id. at HCP-000041.)

Guess you didn't research much. There was no forensic evidence, eyewitnesses, video surveillance etc ever proving the States theory. Even the SF Medical examiner (Boyd Stevens) explained to the lead detective that it would be highly unlikely that 32 lbs would submerge the body. It would just float. He also said the currents would likely take the body out to sea. She was found nearly 4 months later. How do currents flowing Southbound at 4 knots place either body where they were found. -Conner (baby) was determined to be alive until Jan 3rd by both the States expert and the Medical examiner? Furthermore, Dr Charles March testified there is no way that Scott and Laci Peterson's unborn baby could have died any earlier than Dec. 29, 2002. Dr Allison Galloway determined the baby could have even been alive as far along as Jan 14th. -Conner was found above the high tide line and water break. -The baby's left ear was permanently flattened against the head and a rectangular piece of material was over his ear. -Plastic wrap knotted around his neck that had to be cut off, not far from a plastic bag which was never tested. -The criminologist and medical examiner, both concluded that the twine could not have wrapped around Conner’s neck accidentally. Dr. Cyril Wecht noted, "never in a million years." -Laci had a missing neck that is not consistent with any known disarticulation in aqueous environments. -Laci's uterus was at least 10 cm (3.9") smaller than it should have been, explaining why the incision to remove Conner was not visible on her body, and the injured 9th rib, postmortem injury is in the same location where such an incision would have been made.

Go ahead, prove it. When and where did Scott transfer Laci's body from the truck to the boat in broad daylight? And why didn't a single witness see or hear him killing Laci or transporting her body anywhere? -Why did any and all forensic testing come back negative for biological evidence of a dead body in any alleged crime scene? They even tested the water in the boat, Negative results. So how is he guilty if Laci was alive after the 24th? -How did Conners body end above the water break and high tide line if he was in the ocean? -How did his left ear get permanently flattened against his head and a rectangular piece of material was over it? -Why was their no animal feeding on Conner whatsoever? - How did plastic wrap get knotted around his neck that had to be cut off, not far from a plastic bag which was never tested? Dr. Cyril Wecht, who examined Conner's body but who did not testify, told Greta van Susteren that Conner's head measured 28 cm circumference and his neck measured 20 cm (On the Record, October 27, 2004). 28 cm = 11.02360 inches; 20 cm = 7.87400 inches. He confirmed the measurements in another interview with Fox News, and expressed his disbelief that the twine accidentally wrapped around Conner's neck. He also conjectured about the baby being in a bag. -Why was Laci's uterus was at least 10 cm (3.9") smaller than it should have been? Certainly explains why the incision to remove Conner was not visible on her body, and the injured 9th rib, postmortem injury is in the same location where such an incision would have been made. -Why did police ignore evidence, tips and sightings that points in a completely different direction? Isn't it standard police practice to track down a missing person's last known whereabouts? It's not like they didn't have credible eyewitnesses that seen her walking on the 24th. Some called multiple times. Police ignored them. Sounds like tunnel vision and incompetence led to her death since the science proves she was alive after that day. - Why was there no cadaver scent if Laci had been dead in the boat, warehouse, truck or home?

The only bullshit is the media and police lies you have absorbed for 20 years. AMERICAS MOST WANTED TIP, IGNORED BY THE MPD. Four days after Steven Todd and Glenn Pearce were arrested, America’s Most Wanted ran a story on Laci’s disappearance. An anonymous call came into their hotline. We refer to it as the AMW tip. The caller said he had a conversation with two men who were bragging about Laci’s murder. The second man was unnamed, but the tipster gave a description and knew where the second individual lived. It was reported that the first man said “when they did it they thought it was going to be just another murder case . . . now it’s a big case all over TV and news . . . and they are blaming the husband and they are not getting any attention.” went on to say how stupid everyone was. The caller went on to say that he knew where the first man lived with his mother; his mother has the same last name. The last name is worth mentioning because four days earlier, the Modesto Police had encountered the Mother. She was present at her neighbor’s home when police came looking for the Medina’s stolen property. There was a strong connection between the Doe family and burglar Steven Todd. Certainly, this would merit follow-up, especially since the AMW operator stated this caller was 100% sure. Unfortunately, the extent of their follow up was this: This tip was given to a Modesto police officer, the same officer that encountered the mother four days earlier. This officer drove to the sons house, which was one block away from where he had encountered the mother, four days earlier. The son was standing outside. The officer confirmed his identity and asked where he was on December 24th. He said he was “locked up.” The officer called the jail and a deputy confirmed that John Doe had been in jail on the 24th, so the officer did not ask any other questions. The tip did not say he had murdered Laci, the tip just said “they did it.” It is not clear at all who “they” are. However, the officer asked no more questions. The officer never asked why it would be reported that he was bragging about the murder of Laci Peterson; whether he knew anything about Laci’s whereabouts; or about his mother’s connection to the Medina burglary. It was recently verified the first man WAS NOT IN JAIL during December of 2002. The deputy that had confirmed he was in jail had used an intake document that only estimates an inmate’s jail stay, it was not updated once he was released. The MPD screwed up big time.

The 2 guys who were robbing the house across the street, told the cops that they had done it on the 26th and not the 24th, as they were trying to distance themselves from the crime against Laci. And for the sake of keeping their laser focus on Scott, they believed the robbers. The problem with this is the fact that by the morning of the 26th, as confirmed by neighbors, the street in front of Scott's house was a parking lot with reporters and camera by that time with reporters waiting like sharks to interview anyone they saw in the neighborhood to get an interview. So anyone who believes that they did it on the 26th, I've got some land I want to sell them when the tide goes out, yet the police took their word. Furthermore, One of the robbers had a brother in jail where all phone calls are recorded. in a conversation with his brother he states that a lady had confronted them when they were robbing the house. Once again, this was ignored so they could keep their laser focus on Scott. Also, a women who had ties to one of the robbers pawned Laci's watch on Dec, 29. But again, this somehow was ignored. Furthermore, the states case is totally predicated on the fact that Scott killed Laci on the night of the 23rd, and instead of getting rid of her body in the dark of night, he waited until daylight and went to a place where their were plenty potential witnesses to get rid of her body. I don't know about you, but that just doesn't pass the smell test for me. Also the states case is totally dependent on the fact that Laci was already dead on the 24th before Scott went fishing. The problem with this is they have now found the path that Laci took the dog for a walk and have found 11 people who saw Laci walking her dog that morning. The irony of this is that 4 of them stated they had called the police to report this, and phone records show they did in fact call the police, but yet this was shoved under the rug, as it would have completely destroyed the states case. Also, a neighbor lady reported that she had found the dog running loose with it's leash on and took her to Scott and Laci's house and put him in the fenced in back yard where Scott would later find him. Also, the mailman stated that the dog, if it were home, it would go crazy barking at him, and said there was no barking that morning. All of this backs up Scotts story that Laci's plan for the morning was to take the dog for a walk and then go shopping, which if true, destroys the states case All actual evidence points to the two burglars were the murderers to get rid of a witness. As big as this case was, do you ever wonder why it wasn't televised? The reason is two fold. they did not want America to see what a railroad job they did, and there would a lot more people screaming bloody murder, and they didn't want any of those people who saw Laci alive to see the trial, otherwise they have may approached the defense team and destroy the states case. Scott haters really need to start praying that Scott does not get a new trial, because he will be found not guilty and walk out a very rich man when the truth is exposed of all the cover-ups

@@Tboy439 You got that right about the dumb luck of the burglars and the even dumber female friend who pawned the watch. Bad timing since before this happened, I haven't ever heard of any robberies like that in that neighborhood in all the years that I lived near there and roamed through it. In broad daylight too? And all the nice homes there, they chose THAT one? Wow, that sucks. Back in the 80's, I remember a cat burglar who was a fugitive from Texas that was creeping around Modesto. MPD actually came in my house and all my neighbors houses by the airport looking for him. They told us who they were looking for, why they were looking for him and they believed he may have been hiding on one of our properties. Sure they were really robbing the place? Is that what they admitted too. I find something off with that too.

True, the MPD were incompetent. They failed to follow up on the sightings of Laci and they failed to properly investigate the burglary in regard to her disappearance. There are over a dozen credible sightings of Laci and McKenzie. The MPD lies until this day, insisting they found the woman that was mistaken for Laci. That never happened. Then there is Russell Graybill who told officers on 12-27-02 that the gate was open and McKenzie was not on the property when he delivered mail to their house between 10:35 and 10:50 that morning. The MPD claimed that Laci had gone missing before Karen Servas put the dog back in the yard and closed the gate. That information alone shows that Laci was walking McKenzie when Graybill devered the mail. Otherwise the gate would have been closed and McKenzie would have been barking at him. Officer Callahan …“[Graybill] said he entered the area around 1030 to 1045 in the morning. He said he couldn’t remember anything unusual from 516 Covena, but remembered the gate was open at 523 Covena. He said usually the dog barks at him from behind the gate. On 12-24-02 the gate was open and he did not see or hear the dog at 523 Covena.” (See Exh. 3 at HCP-00008.) December 27, 2002, Graybill was interviewed Officer M. Callahan and Detective Skultety of the Modesto Police Department. According to Callahan’s handwritten police report, Graybill stated the following in response to the officer’s question “what he remembered from December 24, 2002 when he delivered mail in this area”: ……………“[Graybill] said he entered the area around 1030 to 1045 in the morning. He said he couldn’t remember anything unusual from 516 Covena, but remembered the gate was open at 523 Covena. He said usually the dog barks at him from behind the gate. On 12-24-02 the gate was open and he did not see or hear the dog at 523 Covena.” (See Exh. 3 at HCP-00008.) More text from the habeas document: Graybill was the Petersons’ postman, and he delivered mail to the Peterson home between 10:35 and 10:50 a.m. on December 24, 2002. (Exhibit 2 [Declaration of Russell Graybill] at HCP-000005-06; Exhibit 19 [Russell Graybill’s Delivery Record].) Graybill knew the Petersons’ dog, McKenzi, and explained to police (and has recently declared) that McKenzi would bark at him no matter where on the property the dog happened to be. (Exhibit 3 [Statement of Russell Graybill] at HCP-000008.) Whether the dog was in the front or back yards, or even inside the house, McKenzi would bark at Graybill. (Exh. 2 at HCP-000005.) Graybill There was a schedule that Graybill printed out showing his scan times for December 24. It includes a notation about the time he delivered mail to the Peterson house. This was entered as Exhibit 34. He arrived at his first scan at 10:19 a.m. and at his last scan at 3:41 p.m. for a total of 5 hours and 22 minutes delivery time. This is all documented in trial records. The gate was open and McKenzie was not on the property at the time he delivered mail to the Peterson house between 10:35 and 10:50. This proves Laci was NOT missing since we know Karen Servas put McKenzie back in the yard before Graybill delivered the mail.

Brent Rocha testified that by the 26th, the media was "encamped" around the house. The volunteer center was set up at the house and a large number of family, friends, and volunteers were in and out of the home consistently since the evening of December 24th. Are we really supposed to believe that Todd rode his bike through the park and eventually right by the Peterson home on Covena Ave on Christmas Day, and did not happen to notice the police cars, police tape, police on horses, police searching the creek in the park, media vehicles, and family, friends, and volunteers? We're supposed to believe, since the "detectives" did, that this burglar, who already has a criminal history and is observant enough to notice the mail sticking out of the mailbox, missed all the chaos and police activity on the street? And while we're talking about timeline, does it really sound reasonable that an elderly woman is feeding her cats outside at 3:30 in the morning? The Bike: Steve Todd claims he used only his bike and backpack to transport all the items he stole, except the safe. He claims he had his friend use his small white car to transport the safe to his house. The police went to Todd's and Pearce's home and found some of the items that were stolen from the Medinas. Let's take a look at a list of just the items that were never recovered: Fire Fyter Safe 2500 Antique Ivory Hand figure pliers set 4 cycle gas trimmer Rolling tool box 3/5 Drill Small pliers 32 piece airtool Craftsman reciprocating saw Reciprocating blade Craftsman sabre saw sabre blade Polaroid camera Canon camera photo lens portrait lens regular lens power winder finishing sander Black & Decker drill Louis Vuitton bag FF Safe 2500 $189 Linx knife trimmer line drill bit Bypass pruner grip wrench pliers set tool -plier automotive tool 2 poly rope Bostich brad nailer clutch driver mechanic tool set power bit 65 pc. Bit set recon. Edger stud sensor 24 inch tool box tie nipper B&D hedge trimmer ratchet tie down Polaroid 600 camera bag, canvas camera accessory new French door keys Binocular, Bushnell 2 sm. Binocular gun bag for Beretta Trimmer, speed space Jewelry box, walnut Jewelry box, oak Numerous tools in the tool box Not only does this completely discredit Todd's story and reveal that he is being anything but truthful about his story, it brings into question: How did he transport all of these items to his house? And how long would it take to load and transport all these items - plus the items that weren't recovered? Remember, Todd says it wasn't until the morning of the 26th between 4:00 a.m. and 5:00 a.m. that he even entered the home, and was home by 6:30 a.m. to wake up his friend and get him to load up the safe. We know from trial transcripts that people started arriving at the Peterson's home by 8:00 a.m. on the 26th to begin their search for Laci, and there likely was media still on the street from the night before. How in the world did he transport all of those items without one person seeing him? There is no doubt that a vehicle other than a bike was needed to transport this list of items - something more like a van. The "van" is a whole issue in and of itself and will be another article posted in the near future. For now, remember that a neighbor reported seeing a van at 11:40 a.m. with a dolly and three men in front of the Medina's house on December 24th, the morning Laci disappeared. The Mailbox: Simply from the testimony of the Medina's and the mailman we can actually place Steve Todd in front of Laci's house between 10:35 a.m. and 10:50 a.m. the morning she disappeared. (The "detectives" couldn't figure this out - we had to - after Scott is already sitting on death row.) Susan Medina testified that as she and her husband were pulling out of their driveway at 10:32 a.m., on December 24th to go to Los Angeles, she had her husband put some outgoing mail in their mailbox. She testified that because she works from home, she has a special mailbox to help ensure that none of her mail would be stolen. The outgoing letters would stick out of the mailbox, but once those were taken, the incoming mail would drop deep down into the mailbox. Incoming mail could not be seen. They had this specific mailbox due to the amount of transients walking down their street and she wanted to be sure her mail was safe (they had a problem with homeless people coming out of the park entrance on Covena Avenue and walking down Covena on their way to the Mission). Medina testified that when she returned home on December 26th, she had 2 or 3 small letters in the mailbox which were not sticking out of the mailbox - you had to reach in and pull the mail out. So, for Steven Todd to see mail sticking out of the mailbox would mean he saw their outgoing mail on December 24th. The mailman testified that he picked up and delivered mail to the Medina's house sometime between 10:35 and 10:50 that day. So, from Steven Todd's own statement, we know he absolutely did not see this "full mailbox" on Christmas Day, like he claims, but instead saw it sometime between 10:32 and 10:50 on the morning Laci disappeared, December 24, 2002. An eye-witness to the burglary: Perhaps the most compelling evidence that makes it obvious that the burglary occurred on December 24th is the tip from a neighbor who called to report seeing three men and a van in front of the Medina's house at 11:40 a.m. on Christmas Eve. She reported seeing a safe being removed from the house. Her information was deemed so credible by the police that that a flyer requesting information and offering a reward was made based on her information.

@Zahra-lc3mj

I think both didn’t do it. It’s easy to blame the husband or ex husband but it’s known the cops didn’t explore other leads. Like OJs eldest son for example with bipolar disorder and an obsession with Nicole who was a chef (had access to knives), and threatened to stab an ex girlfriend before, he hated and fantasized about his stepmom Nicole. The glove was small because it belonged to OJs son, and the blood was somewhat a match because it was his son. OJ was known to be so squeamish of blood- movie directors didn’t think he’d play a good villain. He had his son see a shrink and get medication for rage and bipolar disorder. The son Jason stopped taking the meds right before the murder. OJ also hired an attorney for himself and Jason right before the infamous Bronco chase. Why hire one for his son? LAPD didn’t ping this as strange? As for Peterson, there were burglars who robbed the house next door to Laci and Scott’s on Dec 24th and a nurse who recalled seeing two dark skinned men walking to a white van holding Laci by the arms and telling her to shut that dog up while the dog Mackenzie was barking like crazy. Having an affair doesn’t make Scott guilty of murder. There were other lies also put out there as well. For example, the marina was searched right after she went missing multiple times and Lacis body was not found in the water Scott was fishing in at all in December or January 2003 or February 2003. Her body and Connors body suddenly appears there in April. 4 months later.

Scott seemed way too confident to have actually done it but way too unsympathetic and over her before her body was even found to believe she was still alive. I'll bet it wouldn't take long to tie one of the robbers to a regular stop along Scott's sales route; a feed store, a service station, etc.

I watched every part of the trail and was completely in disbelief what was happening at time what was thrown out the entire time it was crazy the amount of misjustice Nancy grace was a monster that completely broke the law the entire time a new trial they would lose the date of death in trail was December 24 she died on January 3rd she was held captive for 10 days while they were on him recording him media watching him chasing him 24/7 this is the most bias bullshit I've every seen u should be banned from the internet TV and everywhere u could possibly be which is why u say it because u want the haters to bash u to be relivent as u know it's the only thing u can do for viewership because ur so completely stupid I hope u both go to jail for the damage u have done in this situation alone open investigation and giving out information the entire time that's a crime u know miscarriage of justice if ever there was one like hey killer come here if u dump body where been searched for days we will believe u had nothing to do with it because we want Scott for this for being a cheater even though body dumped from land off bridge let's say it was his underweight raft of a boat that a single man couldn't carry a heavy 150 limp body let alone be able to handle throwing off a boat that would have sunk if u leaned at 5 degrees off balance so date of death differnt from trial premeditated no longer aloud alibi proof he wasnt the one who did that to her the police are his alibi they were recording him 24/7 as well as media hounds stalking him u provided the evidence that he didn't do it alone morons bias u are so bias its redicouls why didn't u mention the 6 dead pregnant women in the area at the time over this cheating guy who thought he was in the dog house by being caught and she took off he didn't know she was missing missing until her body showed up which then u showed him in a downward spiral dyed his hair his dad had to keep him from killing himself he attacked the camera men he was a mess after the news then amber started her whole parade of being mislead and that she was going to take him down saying crazy things on the recordings u all played every night on the news what she got for the day it was a circus not a justice system and the judge who would refuse his defense from having any info the prosecution lost evidence to hide it didn't add up seriously cops changed dates of robbery which wasn't allowed in court no real evidence was allowed like the neighbors who knew her who saw her after he left with supposed dead body dog was inside when he left found in neighborhood later when he was long gone 13 strangers who saw her walking dog that morning in a time pattern that proved he was on boat at time and then at side peice house screwing her when laci went to confront the robbers 2 men in white van and 3 people say they saw her with so men what she was wearing 1 with dog and one that said she was being taken and called 911 to report they saw what looked like a kidnapp but no officer came out to scene or did mote then take the call that was recorded and played on media Nancy grace said it was a lie Scott put out but when played it was a older women that later was on media saying what she saw happen but no one investigated old lady but media guy it's insane the whole thing total insane he's been in prison for 20 years, Micheal Patterson was only 12 years before released he was with wife durning death covered in blood had multiple motives lies hidden weapon but had less coverage then this which has no evidence at all that he did anything but cheat on his wife who was pregnant like 80% of men have done please this is all a plea for government media fed to change laws for what not sure but some real sick bs I'm sure

Wrong. Here's why Scott Peterson is *NOT GUILTY.* *From the trial evidence:* _Scott purchased a boat launch ticket at 12:54pm when he arrived at the Berkeley Marina. Scott gave this receipt to the police the evening of Dec. 24th when they asked him if he had any proof he'd been at the marina._ _Scott estimated being at the bay for about 90 minutes. From the time Scott bought the ticket to when his cell phone records show him leaving the area is about 78 minutes._ If Laci's body went into the Bay during that 78 minutes, is there any way he could *NOT* be guilty? If Laci's body didn't go into the bay during that 78 minutes, is there any way that he *CAN* be guilty? So what evidence from the trial proved, beyond a reasonable doubt, that her body went into the bay in those 78 minutes? I can't find it. And neither can anyone else. *Scott Peterson is NOT GUILTY.*

It wasn't a close case in the media. Talking heads like you already convicted him before he was arrested. Remember? But so far as actual evidence, I am not sure if I have heard of a husband convicted of murdering his wife on less evidence.

@@johndurrer7869 kind of weird that your asking this question when all the commenter did was offer condolences for lacy and her unborn baby’s death… weird. But given that she was 8 months pregnant, I was born at 8 months so safe to say her “fetus” or “baby” whatever you want to call it, was fully developed at that point. But still, weird response to a person offer condolences for a persons death.

@@Emily_Gray73 there was no reasonable doubt for the jury, the judge or the Supreme Court Justices who, after examining the evidence in this case on direct appeal in 2020, unanimously upheld his guilty conviction. His direct appeal was shot down, 18 of the 19 claims in the habeas petition were deemed moot or to have no merit and most recently his feeble attempt at a new trial claiming juror misconduct was turned down. What does it take before it sinks in? He's done.
