After viral video, Hudson man sues Hernando County deputy, Walmart for false arrest

The man at the center of a viral video of an arrest at a Spring Hill Walmart is pushing back.
Tony Nguyen of Hudson said he's suing Walmart, a loss prevention officer and the Hernando County deputy who arrested him. The lawsuit calls for more than $10 million over claims of racial profiling and false arrest.
"I'm just happy to be alive today," Nguyen said. "It could have went south. I could be dead."

Walmart has been doing business with Tony for years via Walmart membership card after the initial 1 year trespass. That negates any legal claim Walmart can now backtrack to say that the trespass was indefinite in order to cover for their error. Moreover the Loss Prevention Officer misidentified Tony for Cody, who was previously a problem for him. After later being informed he misidentified Tony, including the fact that Tony drives a different vehicle to the one Loss Prevention reported Cody drives, The Loss Prevention Officer despicably lies and says Tony and his girlfriend also regularly accost him too in order to cover for himself instead of taking responsibility for his mistake. Cody and his girlfriend have never had any encounters with The Loss Prevention Officer and he and Walmart must be held accountable.

Seems to me that if he was trespassed previously, then he violated that order. Therefore, even if his removal was due to an incorrect identification, he was still in violation of his original trespass. His removal was therefore lawful. Case dismissed -- verdict for the defendants (WalMart & HCSO) Perhaps the other guy, the one that was not actually there, will sue this guy for bringing him so much notoriety. Let's see how that plays out. 😅

Walmart rescinded that initial trespass by allowing Nguyen to get a credit card with them. So no. He didn’t violate that order. Walmart entered a financial agreement with him, thereby voiding trespass. And by virtue of Walmart willing to do business with him, he had a reasonable expectation to believe the trespass no longer applied. The police officer even knew this was a mistake, hence the apology.
