Most non US citizen would be shocked by what happened and most of them would confront them. This is not how you treat old ladies anywhere in the world except in the US. Unacceptable.

Why can't you just point out the bravery of confronting an officer period. Born Americans are just as fearful of approaching officers with misconduct allegations as non citizens.

Isn’t it funny how police can immediately charge a citizen for resisting arrest all while carrying around “qualified immunity” where it takes months to years to prove their unprofessionalism? I’m an advocate for getting rid of qualified immunity and letting officers carry their own insurance similar to malpractice insurance that doctors and nurses carry.

This officer has dehumanized anyone he believes has "committed a crime". Basically just because a Walmart employee said a confused old woman tried to steal he saw her only as "shoplifter" and not the elderly dementia patient she is, its really disheartening to see.

Just think for a second. Close your eyes while you read this. They have body cameras on and yet and still reviewed the body camera and yet wrote up a summary that contradicts what the body camera showed. 🤔.

The fact that the old lady had a dislocated shoulder and several lacerations was kept in a room without being treated for hours in so much pain in handcuffs while these psychopaths are outside laughing and celebrating is utterly disgusting. If they were facing a band of looters armed with baseball bats fleeing from a department store with various merchandize, they would probably not try to make any arrest by citing the value of the stolen goods does not justify the use of force to stop them.

Sure, the guy was a little too forceful, but what would you have done here? She has a mental illness so we have to just let her walk? Also, you have to consider that English did not appear to be his first language. That would be intimidating-approaching law enforcement for abuse and knowing you may not understand 100% of what is said and you may not be able to say 100% of what you’re trying to say. Some people fail to see how immigration strengthens a country. This gentlemen was most likely a first generation immigrant judging from his heavily accented English. There’s your example of diversity helping to create a better community.

Various states' ACLU branches have an app you can get for filming police that auto-uploads to their servers and notifies anyone else around with the app that something is happening. I really wish more people used it. It would make filming police much safer.

As a former Walmart employee, it disgusts me the absolute lengths the employees took to make this situation a million times worse than it had to be. She was trying to pay. They saw her up close. They helped escalate the situation and I hope this haunts them.

Update. Austin hopp was sentenced to 5 years and as of today he is still incarcerated and recently he was unanimously denied early release. The female cop got 3 years supervised probation and fines. 5 years is light imo.

The crazy thing is the females officers legal defense was she literally wasnt physically and mentally capable of being an officer and it was the departments fault for employing her. Her lawyer said she was not "mentally capable of processing verbal and visual content at a rapid enough pace" to do the job and was never appropriately trained for arrests.

I don't understand what the crime was?? Did she steal from the store? Was she resisting arrest? . Because she said I'm going home the officers are supposed to let her go? Many criminals and suspects are high and strung out on drugs, making their cognitive ability to communicate damaged. Police officers are there to enforce laws not diagnose people as to what medical condition forced them to commit a crime or resist arrest. A person could suffer from severe PTSD and go on a violent attack, having PTSD doesn't automatically make you free of charges or arrest. And the woman was violently resisting arrest. In my book the police officers get a B+

What really shocks me is that this was a response to an alleged incident. An incident which at that point in time amounted to hearsay. They were prepared to apply 'force' to this 'wrong doer' based on what they were told, but hadnt verified. This makes me wonder if those officers were acting to fulfill some kind of quota for arrests, and that behind their actions is a systemic cause, unidentified by this isolated incident.

The smile, her whole dementor - within seconds - she reminded me of dementia patients I saw in the care home I used to work in. She’s not all there. Clearly! How the cop didn’t factor this in is beyond me. Although he probably noticed but too sociopathic to think “this lady is old and seems confused, I’ll be gentle.” The guy who stood up for this vulnerable lady Is a hero. Dementia is a terrible thing and these people are sooooo vulnerable and should be protected, her walking alone down the road is a reason for concern. It took almost a year for this video to be released and the police chief said it was the 1st he heard of the incident. So one of 2 things, you choose: 1. He is an F-ing liar! 2. There is so much dysfunction and bad policing in his station that not one, NOT ONE officer told him about this. Not an anonymous e-mail, note slipped under his office door nothing. That’s also the biggest incentive for departments to keep officers like this in check. Hitting that department and cities piggy bank will absolutely have an impact. It could go further with more individual responsibility but still. She also likely would get nothing or some small amount over many years as opposed to a department or city that doesn’t have the money and can’t just claim hardship/bankruptcy to avoid paying it.

Should we pass local ordinances that explicitly read that if an older person tries to commit a crime police officers should just let them go? Better yet, the state legislature should pass a law that reads if the theft was less than $14 police officers should not intervene. Would you agree with that? Did you see the part where they read that police officers should not attempt to play psychiatrist. How do you tell a person high on drugs that looks like a mess from a legit older person with dementia? A police officer is supposed to be a doctor that can tell one from the other in a glance? Should a younger person with schizophrenia be allowed to walk away from trying to commit a crime due to their disability? Who makes that decision at the moment and place, not from a desk? If the officer is guilty of trying to detain her, then Walmart is also guilty for calling the police on her. Or, nobody could tell between a senior citizen with dementia from a 30 year old after years of meth use. BTW: I am not saying they should not have gotten in trouble. If they did tamper with evidence, they deserve whatever they get.

My grandmother suffered from dementia. This was both infuriating and deeply saddening to watch. How could anyone treat the elderly like this is beyond me. Walmart escalated this over $13 in goods...

It's obvious she didn't truly understand what was going on, she probably forget what she was doing and didn't realise it. Walmart could've seen this and understood it. But people like to exert any power they have no matter how little it is. Even small things like reporting people, I know a guy that will report any post that he thinks will get removed from facebook for no other reason that just to have that small power.

We had a police chaplain for a family friend when I was a kid. From what I can tell, cops tend to form a 'good ole boys' club and joke about these things among themselves as a defense mechanism to protect themselves emotionally from the stress of the job. This is the sort of behavior that manifests when that mentality is allowed to get out of hand by their leadership. The tip that this is what's happening is that the two primary offenders were both fairly young. I bet they had picked up that culture from the department and didn't have the training or experience to learn when it wasn't appropriate. Of course I'm not defending any of them, but as a disinterested observer, I really wish the lawsuit had gone to discovery. But then I'm also not the person who would have had to risk $3 million to make it happen.

Look up the footage of them watching the body cam Cam and laughing and joking about it none of them are human they literally quoted how that somebody's grandma and the sound of her arm popping and cracking wow joking about how loud it was proved they knew she was injured in still didn't call an ambulance and wrote down minor lacerations in the report

I work in a nursing home and this hurt to watch. The minute I saw him put her arm in the C clamp and go "you done?" I knew he almost certainly broke something. Elderly with dementia are so fragile, they accidentally hurt themselves and break hips constantly. There was no reason for that tiny woman to be manhandled like that other than LEO wanted to throw his weight around..

As a former IHSS caretaker who had to care for many elderly folks with dementia (including my own mother until she passed), this absolutely infuriated me. It takes so, so little to do permanent harm to these folks (my mother died from a subdermal hematoma after slipping and falling in the bathroom). I always imagined our basic human instinct is to treat our elderly peers with as much care and caution as possible. The conduct of these officers would be unthinkable for nearly anyone else; even hardened criminals probably show more basic human decency to their elders than these scumbag officers.

Update as of May 2022: Former Officer Austin Hopp was sentenced to 5 years in prison with 3 years of probation after accepting a plea deal

And to make matter worse, not only was she made return the items (thus no actual theft being committed by technicality), she accidentally exited the store without paying. Her condition inhibited her thought process at that point and I’m sure she would’ve had otherwise gladly paid. Poor lady.

@@DistinguishedSombrero if the staff are trained to look for people with these medical conditions it would of gone a different way. had one happen to me in the uk. women could not find her car and we look everywhere we got our manager to help and he notice something was up called the police and she was know for having dementia and has walked to the shop while her husband was asleep and brought her cars keys with her. the police took her home and all was good

@@liamhil12 It shouldn't even have to be a matter of "training the staff to recognize medical conditions" but just using common sense. I work retail and we get all kinds of people both old and younger who you can tell are "not all there" mentally and we've never jumped to accusations of theft. You can almost always tell when someone is knowingly trying to pull something or just genuinely doesn't know what they're supposed to do, and in the latter cases we deal with them appropriately and as respectfully as we can while trying to help them through their condition.

And I can tell when someone mite not be fully there mentally. I ve even defend a few from others who have got nasty at some of them for being loud.

Her mental health shouldn't even need to be even raised. How can you be this comfortable doing this to a paper thin, frail elderly woman? I mean this piece of excrement even laughed about it. He actually enjoyed it. Probably got hard. No amount of training fixes evil. No amount of training fixes a sociopath. No amount of training can fix the essence of a man. Most American police are sociopaths. I mean they feel this comfortable preying on the most vulnerable members of society; senior citizens, the mentally challenged, women, children, puppies and most recently even kittens they shot dead in front of children. I hate it when people say "they need better training".

Since the items were recovered no crime had been committed. There was no reason for the cops to even approach her let alone almost kill her for $13 of groceries that never left the store. Lastly stealing would imply intent. She is not a criminal and has no history. She simply forgot to pay. A mistake many of us have made. She's a 72 year old grand mother with dementia. If you fail to acknowledge that than please do not breed.

For those wondering, I found a few articles that said former officer Austin Hopp was sentenced to 5 years, and a CBS News article saying former officer Daria Jalali was sentenced to "45 days in jail, 36 months probation and 250 hours of community service".

I like how the guy says “I didn’t see her running” and the officer is like “yeah, you didn’t see it, so now you know” or whatever and it’s like HE DIDNT SEE IT BECAUSE IT DIDNT FUCKING HAPPEN, DUMBFUCK… the officer ended up getting 5 years and mandatory 3 years of parole… should have gotten at least 10 years for the brutal assault plus the higher standard police officers should be held to, and the extra punishment you should get for doing that shit while your badge and uniform protects you from almost any possibility of immediate consequences… fucked up country we live in

cops dont do well in prison hell def get what he deserved!! thats how i view it. and I had a great aunt with severe dementia I took care of her for a few years, she almost never even remembered me, it was the saddest thing.. I did everything i could everyday to try and make her day better. my great uncle died about 3 months after she did too. they were married for around 40 something years.. I believe pol either go to heaven or hell and once in heaven all life's troubles go away.. i believe theyre together in peace. im sure your grandfather is the same❤️

Update for those wondering. Officer Daria Jalali pleaded guilty for failing to stop her partner. She received 60 days jail with 5 years probation. Officer Austin Hopp received 5 years of prison and 3 years of parole. The police department needs some sort of reprimand for not doing a better job of internal investigation.

From my limited knowledge, there isn't near enough accountability. Also, in situations where police departments run their own internal investigations; anyone should be able to see why that is not the way it should be done.

How do the cops try to delete bodycam footage, and not get fired? They committed a crime, with a nice little digital trail proving destruction of evidence. They committed a crime long before they went to trial for other crimes, and weren't prosecuted.

I find it despicable that Wal-Mart refused to allow her to pay for the items. If one of those employees stepped in and noticed her diminished mental condition, and then allowed her to pay, then this confrontation would not have happened.

there is no denying how horrendous all of this behavior was but i like to try and think on the brighter side. now that this is all over she got 3 mil which is easily a life changing amount of money. not nearly enough to warrant such behavior OBVIOUSLY but surely she is happy that she can now buy the entire damn walmart and fire all those assholes to begin with and they 100% deserve it for being THAT petty to a little old woman like that

They likely thought she was on drugs… They are Walmart employees… not trained in mental health or other medical conditions. They did what they are trained to do… The police on the other hand is trained and def needs a lot more training. Walmart needs to have rules that only security or property protection department can confront any theft and those should be trained better.

100% ... over the past year are so my mom has started to show signs of early onset dementia, or maybe just normal onset ... not sure whats considered normal but she is 60 ... ANYWAYS .... seeing stuff like this terrifies me bc I could see it happening to her. Earlier this year I encountered her walking around the store I work in while she was supposed to be at work (she is a paralegal) and she had no idea why I was there ... she had forgotten I worked there and had forgotten she was on lunch break and never retrurned ... legit scared the shit out of me... its so strange cause its like so random ... normally she is fine but then just out of the blue something like that happens.

The employees trying to block her at Walmart, even when the woman offers to pay for the items, the cops who chose force first on her, and the fact no one thought it was weird that this was happening to an elderly woman is disgusting. People claim to live in a civilized society and a free one at that, in reality we just live in a prison state, run by rich kids and bullies.

I don't know if I'm cursed or blessed, but I learned this as early as age 5 and continued learning it repeatedly. While I have PPD from it (difficulty in gauging the risk level of an individual or group), I am no longer able to be caught off guard by society, and when it goes away completely, humans will start to care about each other again. But we have a ways to go. Last time, it took a super volcano and near-extinction for us to get along. It makes you wonder if we're meant to just be another "evolutionary cul de sac", as George Carlin put it, not meant to inherit the stars, and not meant to evolve. Stuck in our ways, we fizzle out like every other species before us.

Obviously no one here has ever worked retail. Not defending the treatment of her by the police but let's see how everyone acts if someone comes in a store you own and steals from you and see how you act. We have the benefit of hindsight. Did anyone in the video know she had dementia at the time? Had she not shoplifted, none of this would have happened. Do you know how many people who steal, claim they just "forgot"? Now, once it becomes clear this lady is old, has mental issues etc this should have gone a completely different way. While it's truly a sad video to watch and see her get treated this way, unfortunately no one knew anything about the situation as it happened. I watch video after video and it seems a small thing always is turned into a bigger thing and escalates. In almost every case, we know if things now that the people in the video didn't know at the time. It would seem people should take away a few things. One, the police dispatch needs to inform their officers better. Many times they have no idea what is actually going on and make bad assumptions. In this case, the cop gets a call of a shop lifter and views it as an uncooperative suspect who is trying to flee. The police officer should have been smarter but simply wasn't, but had he known the "shoplifter' was an old lady with dementia before the call, I can't help but think this would have gone better. Citizens also need to not break the law. They put themselves in situations that allow police to make these calls. Now, we know this old lady had no clue what she was doing, but technically she did shoplift. Once you walk out the door with the merchandise, you put yourself in position to be at the mercy of the police or store security. We can't trust that these people are going to make the right call so don't put yourself in that position. There are many other videos where people technically break the law but the reaction by the police is over dramatic. Understand, this isn't defending the police in their actions just saying no one would be there if they had not have done certain things or broken certain laws. We don't allow the police the luxury or the excuse of incompetence or ignorance of the law, so that has to also apply to people when they break laws. It seems in most of these videos the breakdown happens after the offense and it's the reaction of the police and usually the overreaction of the police that makes these videos. That can lead to other questions, like why are police overreacting so much in cases like this. I think we have to look at the quality of the police officers we have now (as in this case, the officer made a huge wrong call) but we also have to look at the job they have to do and the bs stories they hear. Overreaction to small cases is a very common theme in these videos. Knowing what the other cases are that make people think like this to me is also important to understand, is it just incompetent police or is there justification sometimes bc the last 3 cases like it led to something else? My best advice is don't put yourself in a position where a cop has to get involved. Sometimes easier said than done but and so many videos the people in the video did something that had the police brought out to start an unfortunate chain of events. Again, it doesn't justify the behavior by the police, just my two cents

The worst part is that this dude probably went home to his wife and kids, and complained about having a tough day at work before cracking open a cold beer and eating a hot meal. It amazes me that these officers KNOW the bodycams are there and still does this. This is just pure stupidity, single digit IQ. These people involved should not be ANY kind of job that requires much thought (ESP bc these dinkleheads actually reviewed the bodycam and STILL didn't think anything was wrong). Should be pressing one button all day, made to screw bottlecaps onto soda bottles, or some other dumb sht that a braindead monkey could do.
