I was interested in being an officer some years ago. But, after a bad experience with them, even with my parents escorting me to drive my car home with dead headlights. Those cops were ready to throw me in jail. Lucky my parents, sat in the car and watched as witnesses should something bad happen to me by the actions of those officers. I decided to work in health and take legal courses in college as well. To know my rights, against officers who knowingly abuse the system in their favor.

I've experienced this and seen this so many times, you'll never be able to convince me this isn't why a great many of them become officers. I grew up in the 2000s, right before body cams became popular in the early 2010s and the sadism I experienced from police was chilling. They seemed giddy at the opportunity to physically abuse a teenage girl, like they had thought about doing this since highschool. I hate that bodycams can't show us the expressions of police. I feel it would be very telling. The betrayal in this young woman's voice and expression is heart breaking. She really thought that another black woman would be on her side. I wish it were that easy....

I have to disagree with Audit the Audit conclusion. If you don't resist the seizing of your property when no warrant is produced, you lose all legal protection. You can't hope to win a lawsuit because you will appear to willingly surrender the property. Also you then wave the right to the need of a warrant so whatever is found on the phone then could become admissible in a court of law. Their force seizure of the phone is what got her out of jail, got the phone returned, and is what is allowing her lawsuit to move forward. The only thing I could criticize this young lady about is she didn't ask for the warrant. Saying those words should have stopped the seizure in its tracks. Now, they could make a counter claim that they were now detaining her, but they still couldn't legally seize the property unless it was evidence in a crime. And good luck getting a judge to agree that a phone is somehow evidence in a arson case. They would be right back where they were with an illegal seizure. This would assume that they think the lady would film her activity or text about it. Which they could get the text information from the cell phone provider by providing a warrant to them for it. So the only physical evidence would be on the phone is video, picture, or text messages. She got released the next day because somebody more higher up got involved, learned about the interaction and the illegal seizure and got her released immediately. Hell, it may have even been the forensic investigator assigned to check the phone who would have inquired about the chain of custody on the phone and then realized it was improperly seized by the officers the previous day. And yes, the forensic investigator would enquire about the chain of custody because they would be the ones giving testimony in a court of law. But I'd also argue that the police department has now compromised their investigation. Even is this young lady poured gasoline on the floor, stuck the match, tossed it into the gas, and burned her own residence down, but because they mishandled this investigation so early a lawyer could argue that the police department was retaliating against their client who was suing them. And any and all evidence might get tossed. This is why you hear that charges have all been dropped when police are facing justifiable lawsuits in a case. Because the investigation is tainted by the police department with jurisdiction and unless some higher level department of public safety can create a case (feds) the person all but gets a free pass.

It’s called obstruction and they use it all the time. For example a murder investigation and you were a witness.

Yup. Also make sure to record EVERY encounter you have with the cops. No matter how lame the circumstances are. Remember they are not your friends. They are not here to help you in any way. It's your job to know your rights and protect yourself with video evidence. Give 1 word answers as much as possible and NEVER allow them to do searches on your property. If they pull out a weapon and command you to surrender, don't resist no matter how innocent you are. If they have the chance to discharge their weapons, they will do it. They thirst for blood. Your life isn't worth proving a point. You can prove your innocence in court and also file for lawsuits. But at that moment, just tone down your ego and sumbit. If possible, post your bad encounters online and make sure to expose their faces clearly, including their badge no. names, etc.

The fact that they asked to pick her up and bring her to the office was enough notice to believe they were targeting her as a criminal and not a victim. If they thought she was a victim they would have pulled up to her home to see what she knew.

I see both sides, a lot of this generation are addicted to their phones. I am serious when I say they are caught with it during a secured test. The phone is NOT taken from them, but instead put in a baggie in the same room with them. it is read multiple times they can't have it on their person. This could have been solved if the cop explained it better the first time instead of going on the power trip.

Why do officers believe someone is going to "relax" as they are being assaulted? I will never understand this. It is your natural instinct to resist to some extent. If an officer puts you into some kind of hold that causes pain you are naturally going to try to make that pain stop? Telling someone to relax while physically hurting them and escalating a situation rarely works. It's sickening.

@@VictorKDurand As of January 2024, she was indicted for 2 counts of battery against the officers which, in my opinion, appears retaliatory for the suit that she filed. Unfortunately, she did not appear in court, and an arrest warrant has been issued. This does make her case worse; however, it is understandable to me after she was treated in this manner.

I don't disagree with your assessment but that is the thing about qualified immunity. Officers get a free pass even when they do wrong. DAs refuse to follow through on the charges once an investigation gets compromised so nobody can bring a case before the Supreme Court to get qualified immunity revisited. Because ultimately that is what would happen. And there have been way too many of these cases for the Supreme Court not to be restrictions on QI. The solution is to file lawsuits which the police department pay off before going to court. Or more correctly the insurance company with the police department pay off before it goes to court. So yes, this will continue to happen. Until somebody gets crazy enough to actually file a case against somebody who was a victim of police abuse of power.

They have that upper hand in breaking the law as they so please, just to cut their long hour shift short by not giving a shit. Besides most of these individuals should be psyche evaluated because most of them have narcissistic, psychopathic, ego driven characteristics. These are easily identifiable traits with many people who get into any type of work field with no care in the world trying to cut corners and abuse their power of position.

Sadly, the Black community has a lot of reason to be very aware of their rights, and to teach each other about their rights. I can readily see why she might have had some education (even with the inaccuracies mentioned in the video) and practice at dealing with cops. Her family and friends already have social historical reasons for distrust, and the cops have confirmed that in this episode.

This is infuriating and the reason why I keep my phone encrypted. It breaks my heart to see a young woman experiencing how the police will lie, antagonize, assault, then charge you with a felony with a laugh and a smile. I hate how they can charge you for what your body does naturally while adrenaline is pumping through you and you're trying to defend yourself. It's also a really complicated issue. To gain access to the phone actually requires two warrants. One to seize the device in order to gain possession of it, but to actually access the DATA on the phone requires a second warrant.

@@komlat253 I think she sniffed out the LEOs were undertaking a ruse believing they would have it easy with a kid, then she suspected they were going to arrest her triggering her alarm response - if she was a little more clear headed, she would have stated she will not give a statement if they insist on taking her phone, ask to be taken home removing any stated reason for the police to take her phone, if LEOs insisted on her phone state she will call for a ride, forcing LEOs to reveal their reason for taking her phone. On the bright side, if she is going to college, the city will be paying a portion of it now.

Based on the known info, i imagine her house was on fire, and fire was put out, the female cop told her she could go to the station for an interview and they would send her back afterwards, so she hop on and went alone, with the cop that she trusted. She willingly became a hostage. Thankfully her brain somewhat worked a bit after they put her in handcuffs, and she did eventually got that one call out, released the next day.

I would say that the one thing she should have done immediately after being informed that the phone was being seized was to ask for a warrant. If they admit to not having one, they also admit that they have no right to seize the phone. If they still insist on seizing the phone, comply but inform them that you're going to go through the legal system.

@@theGreenChangeling Unfortunately they can legally seize the phone, whether exigent circumstances exist allowing them to retain possession and search its contents is up to a court to decide. Here the officers didn't provide a legitimate legal reason for seizure of the phone or even notify her she was being detained until she was arrested. It is really hard to say what the officers were thinking - could have intended to arrest her, could have manufactured a basis for the arrest for intimidation or believing the arrest would help get a warrant, could have just wanted to seize the phone, etc.

I love how they are backing her into a corner. It's 3 AM, they had her waiting nearly an hour before finally getting back with her, she's still in a not 100% good place mentally because of the fire (on the phone with her mom to reassure her that's she's alright), and they're surrounding her in a police station giving her ultimatums which seem very unfair given the circumstances and how vague the officer is being. Add all that together and you have the perfect firestorm for a lawsuit brewing. I hope she gets justice

These situations can scar people mentally in really bad ways. I was falsely arrested and beaten twice when I was young by officers. Also has a boss accuse me of stealing and had loss prevention bully me in the back office. It gave me honest phobia of people with authority. It took me YEARS to get myself comfortable enough to have a decent/good relationship with my managers, bosses, and not have an anxiety attack when talking to officers. I felt the need to secretly record practically every interaction with all my superiors for years... This officer in this video is despicable. It is a rope walk. If it is an interview they can question but not seize property but the person and property are free to leave anytime. If it is detainment, they can ask questions but can't treat silence as an admission of guilt and the person can't freely leave. And if it is an arrest, they still have to have a warrant to seize the property and have to stop any questioning once a right to an attorney has been evoked. If you know your rights, there is very little the police can do. And once they detain you, they have to have probable cause to arrest you. Although they got a lot of leeway in this area initially, if nothing comes of the investigation then they could be looking at another lawsuit.

The one thing I don’t like about this channel is the robotic take on these interactions. I appreciate the non bias and fully legal approach but in many cases like this one audit loses all sympathy and doesn’t take into consideration the stress and fear these people are in. This is a legal issue based on precedent, officers aren’t disciplined for their actions caused by stress or fear yet we are expected to act without emotion in these same situations.

*The LEOs did a crap job of investigating* - better approach would have been to collect her voluntary statement, say she has to turn off her phone during questioning, take possession of her phone at the end of the questioning, then release her, even if she had to be restrained to collect the phone. *Instead they concocted this overly elaborate ruse,* aggravated a cooperating suspect by her by making her wait, lost the chance to collect a voluntary statement from an unsuspecting suspect, and exposed the department to liability for false arrest.

If they did, they would have been issued the warrant. Instead, they used bully techniques and violated her civil right and their authority. They did so because they receive no penalty for doing so. Cops typically get to break the laws with impunity, and this is a perfect example of how they get away with it. The simply spin the rule to cover their atrocities. There was not "good faith" here. Only police corruption, and excessive force.

This is why Qualified Immunity should be ended. If LEOs were held to personal civil liability they would NEVER just follow orders of a superior. They would only act on valid legal orders

@@GamerGuts420 Make them carry their own liability insurance. If the insurance keeps having to pay out, the cop would become uninsurable and no department would hire them because they couldn't get insurance.

Vicerally, I agree. However intellectually, I know that if that were common practice, they would never/rarely drop charges in order to stave off felony charges against officers. The things is with these bastards, for every idea where you say, "There outta be a law...", you have to always consider how they would react. You might make a worse situation than before.

Blind obedience without the intellectual capacity to question illegal orders. The military used to give mandatory yearly briefings explaining that it is illegal to follow an order that a reasonable person would realize is illegal. Police should be given the same.

@@cvr527 They might be, but I think one of the main problems with police is that they bristle at *any* civilian questioning or challenging them in any way, so once the civilian challenges them, whether or not the cop is in the right, the cop will just use any means necessary to force the civilian to do whatever it is the cop has told them to do. You see it over and over again in these interactions. Police can often barely tolerate being interrupted or talked to "disrespectfully", let alone refusing to comply with a command, lawful or not.

She just learned the hard way, it's not BLACK VS WHITE, it's US VS THEM. I'm gonna go out on a strong limb here.... The apartment owner is rich and has ties to city officials / police chief / mayor. They are all doing this under instructions from the apartment owner. The owner 100% believes it's the defendants fault and not something to do with their apartment. They already think she's guilty and is treating her as such. Guilty before proven innocent is the new normal now that the rich and powerful so obviously control our police departments
