So law of self defense did a breakdown on this. 1 the airman did nothing wrong legally speaking. Its a dam shame this happened. Tactically speaking if someone is knocking on your door announcing themselves as police opening the door with a gun in your hand is a bad idea. A: If you dont beleave they are police, dont open the door, call 911 they will be happy to verify if the officer is legit or send help if he isnt. B:if you do think they are police why are you taking chances of somthing like this happening. You dont sprout a halo if your intentions are pure and the cops do not know who you are or what you intend, they go on what they see from their context. Now heres the spicy part The cop did nothing wrong legally or Tactically speaking. 1 he was responding to a domestic violence call, those are incredibly dangerous you can simply serch youtube and spend all day watching dv calls turn to gun play. 2 if you knock and announce yourself as police or sheriffs dept in this case and the occupant opens the door with a gun in his hand, it is reasonable to beleave the occupant intends to use that weapon on you. In that situation You do not have time for ask and tell, if you dawdle around with warnings and commands your going to eat a bullet, If you wait for him to raise the gun, your going to eat a bullet, gunfights happen that fast. There is only time for reaction. The justification for self defense is based on what the person knew and saw at the time of engagement and measured through the doctrine of innocence,proportionality, reasonablness, imminence and avoidance. It is possible for 2 people to shoot each other and both have a justfiable self defense claim.
