The summary gets one very important part wrong: 1:05 up to here is accurate but what they get wrong is that *the decision to file this evidence under a different case number wasn't made by some random officer, it was made by the crime scene technician, the lead investigaor and (MOST IMPORTANTLY) Prosecutor morrissey.* so when the prosecutor spent the whole morning saying she had no idea what this evidence the defence was asking for even is, saying she has never heard of it or seen it etc she was flat out lying. which is why she took the stand to try and explain herself.

Please get this right . The CASE is dismissed with prejudice because the prosecutors were engaging in criminal behaviour by not providing FULL DISCLOSURE to the defence . Those responsible must be charged and if found guilty should be disbrred and jailed .

no, the director is creative mastermind. Directors guide the actors through scenes, and help the camera operators get the right angles. This movie hired 2 armourers to handle all the guns. 1 of them is in jail. The state Sheriff believes Hannah brought her own live ammo to the set.

That's the issue, the cops should have investigated that guy Torsky, they didn't, they logged the evidence in a different case number and never told anyone, including the lead investigator about it. That's the issue here.

The prosecutor wanted to make this tragedy seem like a gun range. Morrissey objected for 30m to reject movie script as evidence. This was a film set, not live fire training. The armourer hired to make the guns safe, was goofing off and created a lethal working environment.

It’s so ridiculous how politically biased some of these responses are in the comments. Everything and everyone that doesn’t conform to their political beliefs, is automatically a conspiracy or a cover-up. There is clear evidentiary support for this ruling, but commenters would rather trust Qanon.

Hannah should absolutely get a new trial. Did she know the rounds were live? Did she deliberately put the live round in the gun. Did she deliberately put a live round in Baldwin’s bandolier and a live round in Ackles bandolier as was stated?

It bc obvious the pain caused by this case seeing Alec crying. Makes me mad. Its a case of shaping behavior to fit a crime on the books, and a celeb as the defendant is a prize for prosecutors if not career boosting but profitable due to entertainment value. What other Trials was Alec Baldwin at risk for? He promptly settled with Director Hutchinson's family, sans trial. Who else would be suing him over the gun discharging or as to questions of double jeopardy: When different jurisdictions are involved, double jeopardy doesn't attach. Presuming questioner means a State Civil or Criminal Courts vs. Federal Civil or Criminal Courts...

Because “played a role” is a legal finding. Hannah Gutierrez-Reed was the armorer on set, which means she was responsible for gun safety. That’s why she was convicted because it was literally her one job to prevent gun-related injuries. Alec Baldwin is an actor; his job was to act, not to check guns. The prosecution tried to prove that his allegedly reckless behavior on set made him also legally responsible for Ms. Hutchins’ death but screwed the case to heck before a jury could decide guilt or innocence.

1. The real irony here is that this happened to an actor like Alec Baldwin, known primarily for comedic or character roles where he is not usually doing stunts or using weapons, on a period movie. Meanwhile , the market is full of movies with mindless and gratuitous violence, where prop or real weapons are the norm, as is extreme fighting, martial arts and crazy dangerous stunts, but everybody is OK with that because no real accidents like this one happened. YET. 2. Isnt't it kinda meta that this happened in a time where the gun control debate is as crazy as ever? So people can even get killed by guns in a fictitious movie? I am personally pro second amendment, but clearly the American obsession and fetish with firearms has to be analyzed, this is getting ridiculous. 3. The way that Baldwin was attacked over this in the media is unfair. He is an actor, not a prop or firearms professional, the whole safety issue was someone else's job. A bit careless? Maybe, but definitely not prison sentence level.

Actually, the Judge dismissed the charges with prejudice (toward the Prosecution). This is considered a 'not guilty' verdict, and also mean Baldwin cannot be retried. The Prosecution and NM Law Enforcement Officers conspired to conceal (until the last minute) evidence that the Armorer herself brought the live rounds onto the film set. Prosecution were seeking to confuse the Court. As concealing such evidence until the last minute, denies Defense the opportunity to properly address that portion of their case. And that is improper conduct of the highest order, in legal proceedings. You can definitely expect some NM attorneys to get disbarred over this. What's crazy is that the Armorer's own attorney has now filed a motion to get her conviction overturned, and her record expunged, clearly not understanding that this makes her look more guilty. lol

I DESPISE ALEX. DESPISE. This was the right decision. There is not enough evidence to say he was negligent. No evidence to even suggest he did this intentionally. @@robertalbano2025no it wasn’t. He was handed a gun that his armorer and AD said was “cold”, I.e. not loaded, and he behaved accordingly. Actors act. Armorers ensure gun safety. The job of set armorer exists because nobody in their right mind would rely on actors to ensure gun safety.

Clearly you didn't watch the trial in its entirety. Hannah's defense team had an agreement to turn everything they had over to Baldwin's defense. Since Hannah's case ended in March, this friend of Hannah's father came forward with the evidence.

The bullets came from Troy Teske, who is a friend of Thell Reed, and Thell Reed is Hannah Gutierrez-Reed’s stepfather who trained her to be an armorer (very poorly, apparently). Teske actually tried to give his evidence to HGR’s defense attorney and was also on the defense witness list for HGR’s case but her defense lawyer realized Teske’s evidence and testimony would only hurt her case so he was called off. Then Teske gave his evidence to Santa Fe police and they decided to hide it for some unfathomable reason. There’s no big mystery here.

This needed to be investigated and it didn't is the issue here.......... You need to ascertain every aspect of any evidence; it was the LE job to look at different evidence and how it was presented. This was not done in this case, in fact, they went great length to hide it. When someone come to the police station, lodge and evidence, and leave a statement, the cop needs to follow up on that. That wasn't done here.

Nope, actors never check the guns. The weapon/prop is handed to them with Blanks and they use it. This in TV, Movies, ect. Brother worked on some sets I visited.This wasnt High Profile with A list actor there would been no charges against him to begin with. Even if was convicted likely would got probation, at other end might have done 4 months in Prison. But with all problems with this case, not Charged, then Charged, dropped, Charged again, then hiding Evidence that the Judge said could find him not Guilty, no way they Charge again so its done

Prosecutors do not get to violate a defendant’s constitutional rights (which they did here) then get a free do-over, because then what would stop them from violating the defendant’s rights again? This dismissal was a punishment for the prosecution and investigative team, which they richly deserved.

He wasn’t cleared, it was dismissed with prejudice for prosecutorial misconduct. He may well have been found not guilty but he wasn’t cleared. Really the concealed evidence is only barely relevant to his case, it’s just that bad a case of what the judge seems to feel was intentional prosecutorial misconduct.

@@User5_ title is 1 thing, but the actual job duties is another. “Executive producer” doesn’t mean he’s in charge of daily operations. It could mean he’s the money man, or the one in charge of the script. Or it could be just honorary, so that he could have it on his resume for future projects (to get funding & such.)

😕🍺.. he's guilty for negligence he should have checked that weapon... If it was a Black or Mexican they would be doing life in prison without parole..!!!!

Nope. Hannah Gutierrez-Reed was the armorer on set, which means she was responsible for gun safety. That’s why she was convicted because it was literally her one job to prevent gun-related injuries. Alec Baldwin is an actor; his job was to act, not to check guns. TV, Movies, Actors never check their Weapon/Prop.

They didn’t retry him. This was his first (and only) trial. They chose not to bring the first set of charges to trial then changed their minds and brought a second set of charges, but jeopardy doesn’t attach until an actual trial begins.

This case should be taken to the United States Supreme Court. I'm sure they'll overrule the judge just like they overruled the Trump hating judges who made decisions against Trump.

First of all, this is a state case, not a federal one. Any appeals would end at New Mexico’s highest court. The (federal) US Supreme Court has nothing to do with this. Second of all, the case law underpinning the judge’s decision is VERY solid. “You can’t hide evidence from the defense” is not difficult to understand. This case is over and done with, end of story.
